The service allocation on the basis of supplementary list of CSE-2005 onwards had been delayed as the matter was under litigation before CAT/High Court/Supreme Court in case of Shri Ramesh Ram Vs UOI & Ors. Some candidates were allocated service late after judgement of Hon’ble Supreme Court in the matter of UOI Vs Satya Prakash & Anr. Further, this department has allocated service against backlog of vacancies ( for Physically Handicapped) in compliance of the provisions made under PwD Act, 1995, Hon’ble Supreme Court’ direction in case of Shri Ravi Prakash Gupta and Hon’ble Central Administrative Tribunal, Principal Bench’s order dated 8.10.2010 in case of N. Shravan Kumar & Ors and CAT, PB’s various orders on the ground of parity of reasons. Bi ‘The matter of retrospective promotion for candidates recruited through Civil Services Examination 2005 to 2010 (Reserve List) and Civil Services Examination 2008 & 2009 (PH Backlog) has been examined and following has been decided:- (2) _Incases, where a junior has been promoted or is being considered for promotion on completion of prescribed qualifying service, such seniors may be assessed for promotion based on the principle that a senior who has not completed the qualifying service for promotion but has completed minimum of half of the qualifying service and confirmed in the grade shall also be considered for promotion when an eligible junior is being considered for promotion. On being found fit, such officers should be given promotion notionally with reference to the date of promotion of their immediate junior to STS with notional fixation of pay. (b) _ In other cases, the officers may be considered for promotion, on being confirmed in their grades after completion of two years of actual service, based on the assessment of the available ACRs, and may be given promotion notionally from the date their immediate junior was promoted to STS with notional fixation of pay. | of=25 ()_| While the eligibility service of these officers for next promotion will count from the date they are notionally promoted to STS, the actual benefit of pay, subsequent to retrospective notional fixation, would accrue on the actual date of assumption of charge, subsequent to DPC. 3._| All cadre controlling authorities are advised to take action as above.
