These regulations shall be called the Ship's Met cines and Medical Appliances Regulations, 1991. INTERPRETATION 2. In these regulations ‘the Act” means the Mer- ‘chant Shipping Act, 1951 (Act No. 57 of 1951), and any ‘word or expression to which a meaning has been assigned in the Act shall have the meaning so assigned and, unless the context otherwise indicates— “authority” means, in respect of Class 1 ships, the Minister and, in respect of Class 2 and Class 8 ships, the Director-General; “Class C boat” means a Class C boat as defined in the Life-Saving Equipment Regulations, 1968, published under Government Notice No. R. 141 of 2 February 1968; ““ifeboat” means a lifeboat as defined inthe Lite ‘Saving Equipment Regulations, 1968, published ‘undet Government Notice No. R. 141 of 2 February 1968; “liferaft” means a iiferatt as defined in the Life- ‘Saving Equipment Regulations, 1968, published under Government Notice No. R. 141 of 2 February 1968; “pharmacist” means any person registered as a pharmacist under the Pharmacy Act, 1874 (Act. No. 53 of 1974); “tons” means gross tonnage. ‘APPLICATION OF THESE REGULATIONS ‘3. These regulations shall apply to all South African ships of 25 tons or more, and to lifeboats and Class C ‘boats which may be carried on board such ships. CLASSIFICATION OF SHIPS 4, For the purpose of these regulations ships shall be divided into the following classes: (1) Class 1: Foreign-going ships. (2) Class 2: Ships other than a Class 1 ship— (2) of 200 tons o¢ more; (©) of less than 200 tons which, during their normal voyages of operations, may be at such a distance ftom a South African part where medi- cal assistance may be oblained that the travel ling time to that port would exceed 15 hours at ‘Such ship's normal service speed. Hierdie reguiasies heet die Regulasies betref- fende skeepsmedisyne en Mediese Vitrusting, 1991. VERTOLKING 2. In hierdie regulasie beteken “die Wet" die Handelskeepvaartwet, 1951 (Wet No. 57 van 1951), en thet enige woord of uitdrukking waaraan 'n betekenis in die Wet geheg word, die betekenis aldus daaraan geheg en, tensy uit die samehang anders biyk, br ken ‘apteker” enige persoon wat ingevolge die Aptekerswet, 1974 (Wet No. 53 van 1974), as ‘n apteker gere: “Klas C-boot” 'n Kias G-boot soos omskryt in die Regulasies _betreffende Reddingsuitrusting, 1968, algekondig by Goewermentskennisgewing No. R. 141 van 2 Februarie 1968; “owerheld” ten opsigte van Klas 1-skepe die Minister, en ten opsigte van Klas 2- en Klas 3 ‘skepe die Direktour-generaal; “reddingsboot” 'n reddingsboot soos omskryt in die Regulasies betrelfende Reddingsuitrusting, 41968, afgekandig by Goewermentskennisgewing No. R. 141 van 2 Februarie 1968, “reddingsvlot” ‘n reddingsviot soos omskryt in die Regulasies betreffende Reddingsuitrusting, 1968, afgekondig by Goewennentskennisgewing No. R. 141 van 2 Februarie 1968; “ton” bruto ton. TOEPASSING VAN HIERDIE REGULASIES 3. Hierdio regulasies is van toepassing op alle Suid- Atikaanse skepe van 25 ton of meer, en op reddings- bote en Klas C-bote wat aan boord van sodanige skepe vervoer word. KLASSIFIKASIE VAN SKEPE 4. Vir die doeleindes van hierdie regulasies word skepe in die volgende klasse ingedee!: (1) Klas 1; ‘n Skip op wreemde vaart. (2) Klas 2: Enige ander skip as 'n Klas 1-skip— {@) van 200 ton of meer; of () van minder a8 200 ton wat, gedurende sy notmale reis of worksaamhede, s6 ver van 'n Suid-Afrikaanse hawe, waar mediese bystand verkry kan word, rag wees dat die reistyd na daardie hawe teen die skip se normale diens- spoed meet as 15 uur sal wees. @) Kias 3: 'n Ander skip as 'n Klas 1- of Klas, 2-skip, van meer as 25 ton. STAATSKOERANT, 18 JANUARIE 1991, MEDICAL PRACTITIONER 5. A medical practitioner shall be employed on every Class 1 ship which carries 100 or more persons, and his name shall be entered on the agreement with the crew. INJURY/ILLNESS REGISTER: 6. (1) The master and owner of every Class 1 and Class 2 shio shall cause a register to be kept on board, in the form in Annex 6, which is obtainable fromm the Director-General, recording in detail all medicines dis- ensed from the medicine stock on board and all lost- time accidents. (2) Such register shall form an integral part of every Class 1 and Class 2 Ship's official log-book. MEDICINES AND MEDICAL APPLIANCES TO BE CARRIED BY DIFFERENT CLASSES OF SHIPS 7. The medicines and medical appliances to be car- fied by the different classes of ships, Class C boats, ship's lifeboats and ship’ liferafts shal be as set out in Annexes 1 to Sas follows: Annex 1: Class 1 ships ‘Scale A—Items to be carried on Class 1 ships with no more than 40 persons on board. Scale B—Items to be carried on Class 1 ships with more than 40 persons on board. ‘Scale C-Additional items to be carried by all Class 1 ships carrying chemicals as whole or part cargo. Annex 2: Class 2 ships Scale D—Items to be carried by Class 2 ships with no more than 40 persons on board, Scale E—lItems to be carried by Class 2 ships ‘with more than 40 persons on board. Annex 3: Class 3 ships Scale F—Items tobe carried by Class 3 ships, Annex 4: Ship's lifeboats and Class C boats, First-aid outtit to be carried on ship's lifeboats and Class C boats. Annex 5: Ship's liferafts. Firstaid outfit to be cartied on ship's litera. SHIPS CARRYING CHEMICALS 8. Every ship carrying chemicals as whole or part cargo, in bulk or otherwise, shall in addition to the items shown in Scale A or B of Annex 1, or Scale D or E of ‘Annex 2, carry the items shown in Scale C of Annex 1. Die medisyne en mediese uirusting wat op die verskillende kiasse skepe, Klas C-bote, skeepared- dingsbote en skeepsreddingsviotte aan boord gehou moet word, word soos volg in Aanhangsels 1 tot 5 uiteengesit! Aanhangsel 1: Klas 1-skepe ‘Skaal A—Items wat deur Kias 1-skepe met nie meer as 40 persone aan boord nie in aarraad gehou moet word. Skaal B—ltems wat dour Klas 1-skepe met ‘meer as 40 persone aan boord in voorraad gehou moet word. ‘Skaal C—Bykamstige items wat deur alle Klas 1-skepe wat chemikalie’ as algehele of gedeeltelike vrag vervoer in voor- rad gehou moet word, Aanhangsel 2: Klas 2-skepe ‘Skaal D—Items wat deur Klas 2-skepe met nie ‘meer as 40 persone aan boord nie in voorraad gehou moet word. ‘Skaal E—nems wat deut Klas 2-skepe met meer as 40 persone aan boord in voorraad gehou moet word. (1) Every Class 1 and Class 2 ship shaft carry on board a copy of each of the following publications: (a) The Ship Captain's Medical Guide, 21st edition (or the tatest subsequent edition); (6) the Chemical Supplement to The Ship Cap- fain’s Medical Guide, 1982 or the latest sub- ‘sequent edition): Provided that fishing vessels eed not carry this publication; (6) the South African First Aid Manual, 1985 (or the latest subsequent edition); (@) the register in Annex 6; {e) a copy of these regulations: and (1) the following International Maritime Organisa- tion publications: () EMS (Emergency Procedures for Ships ‘Carrying Dangerous Goods):and (ii) MFAG (Medicat First Aid Guide for Use in Accidents Involving Dangerous Goods) (2) Every Class 3 ship shall carry on board a copy ot ‘each of the publications referred t0 in paragfaphs (c), (@) and (e) of subregulation (1). GENERAL REQUIREMENTS 10. (1) The medicines and medical appliances to be carried on board in terms of these regulations shat comply with the following requirements: (a) They shall in general conform to the stan- dards and requirements laid down by the Medi- ines and Related Substances Control Act, 1965 (Act No. 101 of 1965), where those standards and, requirements are applicable, and shall also com- ply with any special requirements set out in the annexes to these regulations; (b) containers or wrappings or medicines and medical appliances shall be plainly and durably labelled in accordance with the requirements of the Medicines and Related Substances Control ‘Act, 1965 (Act No. 101 of 1965); {c) labets of medicines and medical appliances shall be rendered resistant to moisture either by the use ot an effective fabel varnish that shall cover the label and overlap the edges or by some altemative method the effect of which is not inferior to varnishing; and (d) containers for tablets and capsules shall be capable of reclosure to prevent the access of moisture. (2) The disinfectants carried on board in terms of these regulations shall comply with the provisions of the Foodstutts, Cosmetics and Disinfectants Act, 1972 (Act No. 54 of 1972), and the regulations made there- under. (3) The antiseptics carried on board in terms of these regulations shall comply with the provisions of the Medicines and Related Substances Control Act, 1965 (Act No, 101 of 1965), and the regulations made there- under. PUBLIKASIES WAT AAN BOORD GEHOU MOET WORD 9. (1) 'n Klas 1- en Klas 2-skip moet 'n eksemplaar van die volgende publikasies aan boord hé: (a) The Ship Captain's Medical Guide, 21ste itgawe (of die jongste daaropolgende ulgawe); (0) die Chemical Supplement to The Ship Cap- tain’s Medical Guide, 1982 (of die jongste daarop- volgende uitgawe). (2) ‘n Kias 3-5kip moet ‘'n afskrif van elk van die ublkasies in paragrawe (0), (d) en (2) van subregula- sie (1) vermeld aan boord he. ALGEMENE VEREISTES 10. (1) Die medisyne en mediese uitrusting wat inge- volge hierdie requlasies aan boord gehou moet word, ‘moet aan die volgende vereistes voldoen: {@) Hulle moet in die algemeen aan die stan- daarde en vereistes soos bepaal by die Wet op die Beheer van Medisyne en Verwante Stowwe, 1965 {Wet No. 101 van 1985}, voldoen, waar dié stan- daarde en vereistes van toepassing is, en hulle moet voorts voldoen aan ertige spesiale vereistes, 008 voorgeskryf in die Aanhangsel by hierdie reguiasies; (0) houers of omhuisels van medisyne en mediese uitrusting moet duidelik en duursaam, coreenkomstig die vereistes van die Wet op die Beheer van Medisyne en Verwante Stowe, 1965 (Wet No. 101 van 1965), geétiketteer wees; (©) etikette van medisyne en mediese uitrusting moet vogbestand gemack ward, af ap die een of ander alternatiewe manier wat nie minder doeltret- tend as die vernismetede is nie; en (4) houers vir tablette en kapsules moet weer dig toegemaak Kan word om die indringing van vo te voorkom. (2) Die ontsmettingsmiddels wat ingevoige hierdie regulasies aan boord gehou word, moet voldoen aan die bepalings van die Wet op Voedingsmiddels, ‘Skoonheidsmiddels en Ontsmettingsmiddels, 1972 (Wet No. 54 van 1972), en die regulasies daarkragtens Uuitgevaarcig. (@) Die antiseptika wat ingevolge hierdie regulasies ‘aan boord gehou word, moet voldoen aan die bepa- lings van die Wet op die Beheer van Medisyne en Ver- wante Stowwe, 1965 (Wet No. 101 van 1985), en die regulasies daarkragtens uitgevaardig. STAATSKOEAANT, 18 JANUARIE 1991 No. 12073 § (4) The insecticides carried on board in terms of these regulations shall comply with the provisions of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act No. 36 of 1947), and the regulations made thereunder. ‘MEDICAL SUPPLIES TO BE KEPT UPDATED 11, The owner and master of every ship shall ensure— (a) that the medical supplies on his ship are replenished as soon as practicable after any such supplies have been used and (0) that the medical supplies and equipment are property checked over by a medical practitioner or pharmacist once a year. EQUIVALENTS 12, Where these regulations required that certain medicines and medical appliances to be carried on board shall also comply with specific standards taid down by relevant South African legisiation, the uuthority may allow any other medicine or medical appliance to be carried if he is satisfied that such other medicine or cnedical appliance is at least as effective shat required by these regulations. EXEMPTIONS 13. The authority may, on such conditions as he thinks fit, exempt any ship from any of the require- ments of these regulations. WITHDRAWAL OF REGULATIONS 14, The Medicines and Medical Appliances Regula- tions, 1976, published under Government Notice No. R. 2020 of 5 November 1876, are hereby withdrawn. COMMENCEMENT 18. Die elenaar en gesagvoertder van 'n skip moet toesien dat— {a) die mediese voorrade aan boord van die betrokke skip so gou moontik aangevul word nadat daarvan gebruikis; en (b) die voorrade en vitrusting een keer per jaar deur 'n geneesheer of apteker behoorlik nage- gaan word. EKWIVALENTE 12. Hoewel hierdie reguiasies vereis dat sekere medisynes en mediese vitrusting wat aan boord gehou moet word, moet valdoen aan spesifieke standaarde 00s deur Suid-Afrikaanse wetgewing neergelé, kan die owerheid toolaat dat enige ander medisyne of Mediese uitrusting wat net so doettretiond is as dié wat deur hierdie regulasies vereis word, in voorraad gehou word. VRYSTELLINGS 13, Die owerheid kan, ondetwarpe aan sodanige voorwaardes as wat hy goeddink, enige skip van die epatings van hierdie regulasies vrystel. INTREKKING VAN REGULASIES 14, Die Regulasies betretfende Medisyne en Mediese Uitusting, 1976, gepubliseer in Goewer- mentskennisgewing No. R. 2020 van § November 1976, word hierby ingetrok, INWERKINGTREDING 15, Hierdie regulasies tree op 1 Mei 1991 in werking.
