PROJECT ABSTRACT
NJAC VS COLLEGIUM
SHOULD THE DEBATE CONTINUE?

INTRODUCTION:

There are 3 branches in our country, which are Legislative, Executive and Judiciary. The
Indian Judiciary administers a common law system of legal jurisdiction in which
customs, precedents and legislation, all codify the law of land. As per constitution, a
judge is appointed to the Supreme Court and the High Courts by the President of India on
the recommendation of the Union Cabinet from the list of names given by the Collegium
system. Collegium system is a closed group of the Chief Justice of India and the senior-
most judges of Supreme Court for the appointment of Judges to that courts.

In the year 2014, NJAC was established through the ninety-ninth Amendment in the
Constitution of India. The NJAC replaced the Collegium system for the appointment of
judges. This project is going to deal with both the systems composition, functions,
procedures and their merits and demerits and will also compare both the systems and
suggest the better one.
