Case Number; 17-03406 Probable cause exists for the charging and/or arrest and/or detention of the defendant based on the following fact and circumstances: The following occurred in the State of Washington, in Mason County, and supports probable cause that S/Bruce F Fanning, DOB 07-05-57, violated RCW9A.32.050, Murder 2", a Class A Felony. At approximately 0756 hrs on 04-01-17, Bruce F Fanning, DOB 07-05-57, called Macecom and reported he had just shot and killed an intruder who was showering in his place of business at 1520 E Trails Rd., Belfair, Mason County, Washington, There are two houses on this property, one a home and the other a place of business, Patrol deputies responded and found the victim, Nathanial J Rosa, DOB 03-18-86, deceased in the bathtub where Fanning had told deputies he would be. Post Miranda and waivers, Fanning told me and Detective Willard that he went to his place of business to work and found an intruder showering, Fanning first told the intruder to leave and the intruder aggressively responded with non-understandable verbal threats, Fanning thought the intruder was drunk. Fanning said he was afraid. ‘Fanning left this building and went to his other building on the property and retrieved his firearm, Panning returned and said when he saw the suspect had not lefiybe shot Rosa 3 times thra the shower curtain with a Smith and Wesson .45 caliber firearm, Fanning said there was no verbal confrontation between them before he shot. Fanning said he didu’t know the burglar. Fanning said he called 911 after he shot Rosa. Fanning could not explain why he didn’t call 911 prior to returning to his place of business. Detective Rhoades reported he found 2 bullet holes in the shower curtaitrat the scene.
