The Indian Institute of Corporate Aairs established by the Ministry of Corporate Aairs, Government of
India, is a think tank which supports the initiatives of the Ministry on all matters relating to Corporate
Aairs. Anticipating corporate needs for eective functioning, reviewing corporate laws for eective
amendments to cater to evolving business environments, exploring new paradigms such as investor
education, and periodic reviews and updating denitions, components and activities related to corporate
governance are other prominent initiatives of the institute.

Establishing a dedicated Mediation Centre for handling commercial disputes is one such initiative which
IICA has taken up towards contributing in fullment of legislative mandate enshrined under section 442
of the Companies Act 2013, Section 89 of Code of Civil Procedure, Bankruptcy Code, other laws
prescribing mediation and Supreme Court precedents on the subject. This will be a leap in increasing
foreign investments in India, ease of doing business, supporting Startup India, Standup India, ensuring
eective and faster grievance redressal, lesser burdening of Courts under the aegis of the Ministry of
Corporate Aairs. I wish the course participants a great experiential learning.

The Indian Institute of Corporate Aairs (IICA) under the aegis of Ministry of
Corporate Aairs, Government of India, continuously strives to establish
excellence in the eld of Corporate Aairs. Ease of dispute resolution is a
signicant indicator of ease of doing business in any country. Mediation as a
mode of commercial dispute resolution is still unexplored in India. What
contributes most to this is ignorance about the benets of mediation in solving
commercial disputes. Businesses want exibility, condentiality, quickness in
resolution of commercial disputes. Mediation can be a great option. Government
has recognized this under the new Companies Act, 2013 and has provided for maintenance of a
Mediation and Conciliation Panel. This Course on Civil and Commercial Mediation with Negotiation would
help the concerned stakeholders to gain expertise and resolve commercial dispute through mediation. I
