This Judicial Affidavit of LEO LAPAZ, who is the said plaintiff of

this case, is executed to serve as his direct testimony in this instant case.

This Judicial affidavit is being offered to prove the following:

A. All the allegations in the complaint including all annexes
appended thereto and which were already marked as exhibits in the
case;
B. All other related matters, facts, circumstances relevant and
material to this case.

This Judicial Affidavit was taken at the office of Atty. Phoenix B.

Hortinela, at Nellys Garden Building, Jaro, Iloilo City.

Questions were propounded by Atty. Phoenix B. Hortinela and

questions were numbered consecutively and each questions is followed by
an answer of the witness.

1. Do you swear to tell the truth and nothing but the truth?
I do.

2. Are you aware that you can face criminal liability for false
testimony or perjury if you will not tell the truth?
I am.

3. Please State your name, age and address

I am Leo Lapaz, 32 years old , a resident of Gustilo, Lapaz, Iloilo
City
4. Do you know Mr. Jose Jaro?
Yes. I know Mr. Jose Jaro

5. How did you come to know Mr. Jose Jaro

He was a friend of my wife, who borrowed money from me.

6. When did he borrow money

He borrowed money from me on January 21, 2016.

7. In what amount did he borrow from you

He borrowed the amount of 800,000PHP(Eight hundred thousand
pesos)

8. Were there any conditions for such lending of money?

The conditions that we stipulated, was that he would pay me on or
before April 31,2016.

9. I am showing you this document, herein referred as Annex A, Do

you know this document?
Yes. It is a promissory note.

10.Who executed this promissory note?

Mr. Jose Jaro, Atty.

11.When was this promissory note executed?

January 21, 2016, Sir.

12.When does the document become due and demandable?

On April 31, 2016.

13.After the promissory note became due and demandable, what did
you do?
I, needing the money, sent a demand letter, demanding him to pay
within 13 days from receipt thereof.

14. I am presenting this document herein referred to as Annex B. Do

you know this document?
Yes. That is the demand letter that I sent him that he should pay.

15.Was there any payment made by Mr. Jose Jaro in response to the
demand?
There was none.

16.Im showing you this document, herein referred to as Annex C. Do

you know this document?
Yes. That is the second demand letter that I sent.

17.Did Mr Jose Jaro make any attempts to communicate regarding

said loan?
No.
