Love My probable cause for said belief and accusation is as follows: Affiant vas assigned to investigate this Aggravated Aseault case, Galvest County Sheriff's Offico case number 17-00001028. Affiant reviewed the initial report, which was filed by Kimberly Smalley on March 21, 2017 at approximately 2:00pm with Sgt. M. McGaffey. Smalley fled the report from the UTM hospital in Galveston, Galveston County, Texas on behalf of the victim, Noah Frillou. Frillouis Smalley's adult son who was assaulted on Crystal Beach by several persons during a large disturbance on March 18, 2017. Frillou spoke with Sgt MeGaffey also, but could not remember details from the assault due to his head injury. The only suspect named in the report was Morris Joseph, who has been identified as Big Mo, and Mo by witnesses. On March 28, 2017 Affiant and Deputy M. Alfred traveled to the residence of the victim in this case. Affiant met with Noah Frillou, and his mother, Kimberly ‘Smalley. Prior to the interview Affiant asked Frillou about a message his mother, ‘Smalley, had mentioned to Affiant that Frillow had received about the assault. Frillou showed Affiant a screenshot on his phone that he had saved. The screen dawg Me and my kinfolk wanna talk to you it was @ ‘misunderstanding dawg !! Hope you good hmu when you can”. This message was received on March 18, 2017 at approximately 10:28pm. On March 19, 2017 at approximately 10:43am Frillou responded "Okay", and then followed that message with "mgood". On March 23, 2077 at approximately 12:48pm Frilou Senta message aa “Who all hitme besides big mo". At proximately 4:53; repliod "I just know MOE" Frillow agreed to give Affiant a video statement. The interview began at approximately 12:41pm. Frillou stated that he only remembered a littie of the day before the assault, March 17, 2017. Frilou stated that they arrived that evening, ‘spent alittle time on the beach, and then went back to their cabin. Frillou did not ‘know where the cabin was located, just that it was i t he went to Crystal Beach with his friend| dad Frillou stated that fS giriren ‘one ofher friends, end her boyfriend also stayed at the cabin With jem. Frillou did not know the friends” names. Frillou stated that he remembered waking up on March 18, 2017 and going down to the beach. Frillou does not ‘remember anything else from the day of the assault. Frillou stated that he did not know Morris Joseph prior to the assault. The interview ended at approximately 12:48pm, ‘Same date, Affiant then interviewed Frillou's mother, Kimberly Smalley. This Interview was also video recorded. The interview began at approximately 12:54pm. Smalley stated that she had instructed Frillou to check in with her ‘occasionally. Smalley stated that Frillou did check in with her on Friday March17, 2017, but he did not contact her on Saturday March 18, 2017. Smalley stated that she began to worry, and Smalley texted Frillow around 6:04pm on March 16, 2017 to check on him. Frillou never responded. Smalley stated that close to 7:00pm she received a text message from her ex-sister-in-law, who was traveling with another female who had been contacted by a third party who was in Crystal Beach, advising that Frillou had been hit. Smalley stated that she also received a text from Jill Frillou advising her that Frillou was injured. Smalley then received a phone call from Ji of the same information. Smalley stated that a female named | who did not have Smalley’s phone numbes bad contacted vill to have her contact Smalley. Smalley did not know ifilllliad been at the beach, and did not havo any contact information for hers Salley Stated that she began calling people who she knew was at the beach but no one answered her calls. Smalley then contacted her oldest son, Mason Fiilou, who was not at the beach and advised him that Frou had been hurt and asked hi to wn at the beach for her. Smalley stated that Mason got ahold of who Smaliey ended up speaking with. MMMM cold Smalley hhad Frilou in the shower trying to clean him up but could not gethis nose f0 stop bleeding. ‘Smalley stated that everyone was eling her Frilou was fine, but she knew something was wrong. Smalley stated that hor Nephow, Lane Frilou, contacted his mother il about Frillou possibly having a concussion. Smalley stated that she contacted Mason to help her go get Frifou, and Mason advised her he and his dad were already on thelr way. Smalley stated that sho instructed Mason to take Fri to Baptist Hospital n Beaumont which is 4 local major hospital in their area, and one she had just recently used, Smalley ‘tated that she was not thinking clearly and didnot even think about UTMB In Galveston. Smalley advised that she placed a post on her Facebook account asking for help in solving this assault, specifically ooking for video. Afant advised Morris to call Affiantas soon as he spoke with her Aifiant then traveled to West Orange Stark High School with Officer S. Hilton from the West Orange Police Department in an attempt to make contact with ‘Morris Joseph, who is both eighteen years of age. We learned that Morris had left the schoo! quickly, shortly before our arrival. The school secretary stated that she told him he could not leave yet that school was not over, but Morris walked out anyway. Both orbital areas were broken, one almost completely all of the way around, his nose was broken, the ‘maxillary bone, that holds the teeth, was broken into three pieces. Noah Frillou's cheeks and sinus cavities received multiple fractures and breaks. During surgery ‘Noah Frillou received metal plates around his high cheek bones, outer eve area, and down the sides of his nose onto the Maxillary are. Noah Frillou also received plates to hold his teeth in place, and his jaw was wired shut. Four of these metal plates will be permanent.
