RE: Recommendation for Termination

Dear Officer Jermaine Sutton,

I am recommending that the City of Albany terminate your employment for the following
reason(s):

I have reviewed the detailed Internal Affairs report which was prepared in response to the event
that occurred on April 25, 2017 Involving you and Mr. Llewellyn Glover. You conducted a traffic
stop on a vehicle driven by Mr. Glover and used a technique of walkfng to the passenger side of
the vehicle where (with the window "down") you stated that you smelled marijuana. You
contended that when Mr. Glover exited the vehicle, you saw marijuana In Mr. Glover's mouth.
Review of the Internal Affairs report does not support your claim. Instead, the report notes you
were less than truthful.

The final report was submitted to the Office of the Chief of Police with the following findings:
1. Vioiation of SOP A-230 (Improper Conduct) Excessive Force Resulting in Injury or Death
2. Violation of SOP A-230 (Insubordination) Dishonesty
3. Violation of SOP A-230 Code of Ethics

By any objective measure applied to the circumstances in the Internal Affairs report, the force
used by you was excessive and your actions constitute a'violation of the values of the department
that reflect a negative image on the men and women of the Albany Police Department. There~ore,
I am recommending termination of your employment with the City of Albany Police Department.

The City Manager makes the final decision regarding terminations. Within five (5) days of the
date of this recommendation for termination, you may request a termination review by the City
Manager regarding this recommendation by completing and returning the attached form to Chief
Michael J. Persley. Please contact the Human Resources Department with further questions or
concerns.
