AUTHORIZING AN AGREEMENT WITH THE VILLAGE OF
VOORHEESVILLE REGARDING SAFETY ENHANCEMENTS TO
RAILROAD CROSSINGS ON COUNTY ROADS

WHEREAS, Two County highways with busy railroad crossings go through
the Village of Voorheesville (“Village”) and the amount of train traffic has increased
substantially due to the number of crude oil shipments to Albany from the Midwest
as a result of increased shale oil production, and
WHEREAS, The current railroad crossings are a significant safety concern
because of the high volume of vehicular traffic and the explosive nature of shale oil,
and
WHEREAS, Because of recent upgrades performed by the Railroad (“CSX”) to
the crossing areas, there is an opportunity to install a safety system referred to as a
quad gate system, and
WHEREAS, The quad gate system creates a barrier that prevents vehicles
from “zig zagging” around the gates, thus restricting potential access when a train
passes and reducing the possibility of a potentially catastrophic accident and
derailment in a populated area, and
WHEREAS, Because of the aforementioned improvements to the crossing
areas by CSX, the anticipated cost of the quad gate system has been significantly
reduced, and
WHEREAS, By Resolution No. 588 for 2013, the Albany County Legislature
authorized the Albany County Executive to enter into an agreement with the
Village to assist with funding (in the amount of $27,500) of an engineering study to
determine the feasibility and cost of a quad gate system, and
WHEREAS, The County and Village entered into a Memorandum of
Agreement on April 15, 2014, regarding the above, and
WHEREAS, In a report dated August 10, 2016 Bergmann Associates,
engineers for CSX, estimated the construction costs for quad gate systems on
County Routes 201 and 306 in the Village to be $288,962, andWHEREAS, With engineering and legal costs it is estimated that the total
costs of designing and installing quad gate systems on County Routes 201 and 306
in the Village will not exceed $400,000, and
WHEREAS, It appears that State grant opportunities are available, which
might pay for a significant part of the cost of installing these quad gate systems,
and
WHEREAS, The Village has proposed partnering with the County to install
these quad gate systems with the cost, after any available State grants, to be borne
80% by the County and 20% by the Village, and
WHEREAS, These quad gate systems would significantly increase safety at
the CSX crossings of these two County highways and also improve quality of life in
the Village, now, therefore be it
RESOLVED By the Albany County Legislature that the County Executive is
authorized to enter into an agreement with the Village of Voorheesville for the
installation of quad gate systems at the CSX Railroad crossing of County Routes
201 and 306 in the Village of Voorheesville with the cost thereof, after any State
grants, to be borne 80% by the County of Albany and 20% by the Village of
Voorheesville, and, be it further
RESOLVED That the County Attorney is authorized to approve said
agreement as to form and content, and, be it further
RESOLVED That the Clerk of the County Legislature is directed to forward
certified copies of this resolution to the appropriate County Officials.

an agreement with Synthesis Architects LLP to provide design and construction
administration services for the Atrium Renovations at the Times Union Center in
the amount of $975,000, and
WHEREAS, By Resolution No. 10 for 2016, this Honorable Body authorized
an amendment to the agreement with Synthesis Architects LLP regarding
renovations to the Times Union Center in the amount of $60,000 for a total amount
not to exceed $1,035,000, and
WHEREAS, The Commissioner of the Department of General Services has
requested an additional amendment to the aforementioned agreement with
Synthesis Architects LLP to provide redesign of the exterior stairs due to the
unanticipated discovery of a duct bank during construction and other miscellaneous
unforeseen structural conditions associated with the renovation of the Times Union
Center walkway in the amount of $190,965, now, therefore be it
RESOLVED, By the Albany County Legislature that Resolution 478 for 2014,
as amended by Resolution 10 for 2016, is further amended to reflect that Synthesis
Architects LLP is to provide additional design and construction administration
services at the Times Union Center in the amount of $190,965 beginning May 1,
2017 and ending April 30, 2018 for a total contract amount not to exceed $1,225,965

WHEREAS, The NYS Division of Criminal Justice Services has informed Albany
County that grant funds are available for the District Attorney's Office in the amount
of $189,105, the Sheriffs Department in the amount of $95,290, and the Probation
Department in the amount of $78,003 regarding the Gun Involved Violence
Elimination (GIVE), and for the period from July 1, 2017 to June 30, 2018, and
WHEREAS, It has been indicated that the State aid will be directed to be utilized
by this partnership to support gun related crime reduction efforts within Albany
County, and
WHEREAS, The District Attorney's Office, the Sheriff's Department and Probation
Department have requested authorization to enter into an agreement with the Division
of Criminal Justice Services regarding the GIVE partnership, and
WHEREAS, The Commissioner of the Probation Department has requested a
budget amendment to incorporate additional funding regarding the GIVE partnerships
overtime expenses, now, therefore be it
RESOLVED, By the Albany County Legislature, that the County Executive is
authorized to enter into an agreement with the NYS Division of Criminal Justice
Services for the period beginning July 1, 2017 and ending June 30, 2018 in an amount
not to exceed $362,398 regarding the GIVE partnership funding for the District
Attorney's Office, the Sheriffs Department and the Probation Department, and, be it
further
RESOLVED, By the Albany County Legislature that the 2017 Albany County
Probation Department Budget is amended as follows:
Increase Revenue Account A3334 Operation GIVE by $2,500

WHEREAS, The Commissioner of the Department of Public Works has
requested authorization for the purchase and delivery of a tandem dump truck in
accordance with the Public Works Vehicle and Truck Replacement Program, and
WHEREAS, The Department of Public Works, through the County
Purchasing Agent, using Onondaga County's Contract, has recommended ‘Tracey
Road Equipment, Inc. for the purchase and delivery of a tandem dump truck and
any warranty work, soxvice and parts for the vehicle, and
WHEREAS, The Commissioner indicated that the purchase and delivery of
the tandem dump truck and any warranty work, service and parts for the vehicle
will cost $243,501, now, therefore be it,
RESOLVED, By the Albany County Legislature that the County Executive is
authorized to enter into an agreement with Tracey Road Equipment, Inc., Albany,
NY 12205 in an amount not to exceed $243,501 regarding the purchase and delivery
of a tandem dump truck during the period commencing July 1, 2017 and ending
December 31, 2017 and any warranty work, service and parts for the vehicle undor
a seven year/150,000 mile warranty, and, be it further

Blvd. Resurfacing Project in the Town of Colonie, Albany County, P.I.N, 1759.78 (the
“Project”) is eligible for funding under Title 23 U.S. Code, as amended, that calls for
the apportionment of the costs of such program to be borne at the ratio of 80% Federal
funds and 20% non-federal funds for permanent repair work and 100% Federal funds
for Emergency work, and
WHEREAS, The County of Albany desires to advance the Project by making a
commitment of 100% of the cost of construction, construction inspection and
construction support now and receive 80% federal reimbursement, thorefore be it
RESOLVED, By the Albany County Legislature, duly convened, does hereby
approve the above-subject project, and, be it further
RESOLVED, That the County Legislature hereby authorizes the County of
Albany to pay in the first instance 100% of both the federal and non-federal share of
the cost of construction, construction inspection and construction support for the
Project or portions thereof in the amount of $1,069,000, and, be it further
RESOLVED, That in the event the full federal and non-federal share costs of
the project exceeds $1,069,000, the Albany County Legislature shall convene as soon
as possible to appropriate said excess amount upon the notification by the New York
State Department of Transportation thereof, and, be it further

to execute all necessary agreements, certifications or reimbursement requests for

WHEREAS, Pursuant to EO 151, Interfaith Partnership Safe Haven extended their
hours of operation for their drop-in shelter to include weekends for overflow homeless
persons during inclement wintor weather, and
WHEREAS, By Resolution 145 for 2016, an agreement with Interfaith Partnership
for the Homeless was previously entered for the period July 1, 2016 through June 30, 2017
to provide emergency and transitional shelter services, and
