DEED OF UNDERTAKING

I, JUAN DE LA CRUZ, a Filipino, of legal age, and residing at Manila, Philippines

after being sworn to in accordance with law, hereby depose and state that:

1. I am the private complainant in the case for Reckless Imprudence resulting to

Homicide which resulted to the death of my brother, JOSE DE LA CRUZ;

2. JOSE DE LA CRUZ is the owner of a Honda motorcycle bearing the Plate Number
12345 with O.R. # 4567 & C.R. # 9876 involved in the vehicular accident last
December 1, 2000 which resulted to the latters death. The motorcycle was placed
under custody of the PNP- Manila Station upon the filing of the case last
December 1, 2000;

3. To prevent its further deterioration caused by its non-usage for a long period and
to restore it to its pristine condition pending the hearing of the case at MTCC -
Manila City, I have MOVED for the release of said vehicle;

4. I hereby undertake to bring the motor vehicle before aforementioned Honorable

Court when necessitated and for whatever legal purpose.
