Meutim, kada je u pitanju sloboda kretanja unutar samog Kosova, politiki dogovori,
njihove revizije i odlaganje primene nisu jedini faktori koji je ograniavaju. Sloboda kretanja na
Kosovu uslovljena je i mnogo bitnijim i preduslovima, prvenstveno:
Subjektivnim oseajem bezbednosti graana
Administrativnim zahtevima za slobodno kretanje (lina dokumenta)
Dok je subjektivni oseaj bezbednosti graana proces koji mora tei prirodno i uslovljen je
sutinskim promenama drutvenih obrazaca, jaanjem institucija izvrne i sudske vlasti i
stepenom tolerancije itavog drutva, administrativni zahtevi su problem koji je lako reiv.

Otvaranje glavnog mosta na Ibru za saobraaj ili nalepnica preko relevantnih delova
tablica malo e znaiti graanima, privrednicima ili studentima sa severa Kosova koji ne mogu
da putuju dalje od tog mosta i uestvuje u ekonomskom, drutvenom i politikom ivotu ostatka
Kosova jer nemaju kosovsku linu kartu ili vozaku dozvolu.
O problemu
Prva grupa dokumenata se na Kosovu tretiraju kao nelegalni, ali se kao rezultat
sporazuma iz 2011. line karte koje izdaju srpske institucije za svoje graane na Kosovu i koja
se vode na neki od gradova na Kosovu, se mogu koristiti prilikom ulaska ili izlaska12 sa Kosova,
kao i na severu Kosova gde su u irokoj upotrebi. Ova dokumenta bi trebalo biti postepeno
zamenjena kosovskim dokumentima, meutim, zbog emotivnih, ali i administrativnih prepreka,
ovaj proces se odugovlai. Situacija je slina i sa vozakim dozvolama koje izdaju srpske
institucije za svoje graane koji imaju prebivalite na Kosovu i sa kojima nije mogue
uestvovati u saobraaju van etiri severne optine sa veinski srpskim stanovnitvom. Najzad,
meu ovom grupom dokumenata su i pasoi koje srpski MUP izdaje za graane Srbije sa
prebivalitem na Kosovu (ove pasoe izdaje specijalno odeljenje MUP-a, Koordinaciona uprava i
pasoi izdati od strane ove institucije su izuzeti iz bezviznog reima odobrenog Srbiji 2009.) koji
u skladu sa lanom 3kosovskogZakona o dravljanstvu13 koji definie pravo na dvostruko
dravljanstvo graana ne treba biti dovoen u pitanje. Naalost, maja 2017. pojavile su se

12 I to na prelazima Brnjak i Jarinje, dok na drugim prelazima uglavnom nije mogue prei ali postoje
primeri i ljudi koji su preli ove prelaze sa srpskim linim kartama koje se vode na neki od gradova na

Najzad, poslednja grupa dokumenata, dokumenti koje izdaju kosovske vlasti su vaei
na itavoj teritoriji Kosova i Srbije (izuzev kosovskih pasoa koji nisu priznati kao putne isprave
od strane Srbije, ali i nekih drugih nekih zemalja) i koji su pod obaveziom izdavanja viza.
14 Problemi o kojima se govori u ovom dokumentu nisu samo problem Srba iz severnih optina, ve Srba i
graana drugih neveinskih zajednica koje ive u 10 optina sa veinski srpskim stanovnitvom irom
Kosova.
15 U optini Zubin Potok, odbornica lokalne skuptine se nalazi u apsurdnoj situaciji da je izabrani javni
slubenik na Kosovu, ali da nije Kosovska dravljanka jer ne moe da aplicira za dravljanstvo. S druge
strane, mogla se nai na listi za lokalne izbore jer je 2013. kosovskim Srbim dozvoljeno bilo da glasaju i da
se kandiduju sa srpskim linim kartama.
16 Graanke Kosova iz etiri severne optine svoje prezime ne bi mogle da promene ni procedurom za
promenu linog imena koje to dozvoljavaju bez obzira na brani status jer nisu u mogunosti da uz zahtev
za promenu linog imena predaju i svu potrebnu dokumentaciju (kao to je potvrda o plaenom porezu

Deca iji jedan ili oba roditelja nemaju kosovsku linu kartu iz gorenavedenih
razloga mogu dobiti samo izvod iz knjige roenjih, ali ne i dravljanstvo.
Oevi dece roene u bolnicama na Kosovu ili Srbiji moraju da pokrenu
proceduru priznavanja svog deteta.
Graani koji imaju vie od 18 godina moraju da apliciraju za dravljanstvo i da
imaju bar jednog roditelja sa kosovskom ili UNMIK linom kartom kao i da
predaju dokaz da ive na Kosovu due od 5 godina.
Kako je Kosovo novemba 2013. i jula 2014. bilo saglasno sa zahtevom srpske zajednice
da se na lokalnim i potom parlamentarnim izborima moe glasati i sa linim kartama koje je
MUP Srbije izdao za svoje graane sa prebivalitem na Kosovu, jasno je da je mogue da Kosovo
odredi i vremenski period u kom e prihvatiti i druga dokumenta izdata od strane ovih
institucija, kako bi se graanima pruila ansa da se zaista integriu i prevaziu sve potekoe
sa kojima se susreu u kontaktu sa kosovskom administracijom.

20 Kako ni jedan kosovski zakon ne navodi da su dokumenta koje Srbija izdaje svojim graanima sa
prebivalitem na Kosovu nevaea ili nelegalna, slubenici kosovske policije koji zateknu vozae sa
ovakvim dozvolama ne mogu da im piu kaznu za posedovanje nelegalnog dokumenta. Umesto toga im
piu kaznu uz obrazloenje da uopte nisu posedovali vozaku dozvolu.

Poslednji lokalni i opti izbori organizovani na Kosovu takoe pokreu jo jednu lavinu
problema za kosovske Srbe, posebno one koji ne mogu da ostvare pravo na dravljanstvo. Na
izborima 2013. i 2014. glasalo se po integrisanim kosovskim i srpskim birakim spiskovima. To
je bilo uinjeno kako bi i kosovski Srbi koji nisu imali kosovska dokumenta mogli da se i
kandiduju i ostvare svoje glasako pravo na Kosovu. U ovom trenutku, nejasno je da li e se ova
praksa nastaviti i na sledeim izborima i koliko ljudi e istati bez prava glasa ukoliko ipak ne
doe do produetka ove prakse.
Zakljuak:
Vlada Kosova istie da je interacija graana iz etiri severne optine sa veinski srpskim
stanovnitvom jedan od glavnih prioriteta kako unutranje, tako spoljane politike Kosova.
Meutim, u administrativnom smislu, kosovski sistem ostaje potpuno nespreman da obezbedi
dostojanstvenu i efikasnu integraciju graana u kosovsko drutvo. Dok su izvetaji ministarke
za dijalog puni optubi na raun srpske vlade i njenog disruptivnog uticaja na sprovoenje
dogovorenog, kosovska vlada ne uspeva da obezbedi graanima koje eli da integrie pristup
najosnovnijim uslugama. Pristup uslugama kosovskih institucija je unutranji problem Kosova
koji je lako reiv i upravo neuspeh da se ovaj problem otkloni, ali i potpuni nedostatak svesti da
ovakav problem uopte postoji ukazuje na to koliko kosovska vlada zapravo nije zainteresovana
da osigura efikasnu integraciju srpske zajednice.

Veriore dhe Qendra pr paqe dhe toleranc nga Graanica. Fillimisht, PAH sht prbr prej 14
organizatave t shoqris civile nga katr komunat me popullsi shumic serbe t Kosovs
veriore dhe 25 antar t tyre. PAH sht themeluar me qllim q:
T analizoi dhe hulumtoi politikat praktike n nivelin lokal dhe qendror t pushtetit.
Pas prfundimit t projektit, PAH sht riorganizuar dhe nga tetori 2016. prbhet prej
11 organizatave dhe 6 hulumtuesve individual. Momentalisht, PAH financohet nga
fondet e SlovakAID-it dhe Zyrs t Bashksis Evropiane n Kosov.

Gjer sa ndjenja subjektive e siguris s qytetarve sht proces i cili patjetr duhet t rrjedh
natyrisht dhe sht i kushtzuar me ndryshimet esenciale t modeleve shoqrore, me
prforcimin e institucioneve t pushtetit ekzekutiv dhe gjyqsor dhe me shkalln e tolerancs t
mbar shoqris, krkesat administrative paraqesin problem q mund t zgjidhet leht.
Kushtetuta Kosovn e definon si shoqri multietnike dhe njri nga prioritetet i politiks
s brendshme, por edhe asaj t jashtme t Qeveris s Kosovs sht edhe integrimi i qytetarve
shumic serb t Kosovs veriore n shoqrin e gjer kosovare. Qeveria, qllimin pr ti
integruar bashksit jo shumic n shoqri e shpreh prmes spektrit t tr t ligjeve moderne
dhe liberale t cilt i mbrojn t drejtat e bashksive jo shumic, por edhe prmes procesit t
negociatave me Beogradin, qllimi i s cilit sht shuarja e institucioneve serbe dhe vendosja e
institucioneve t reja kosovare n kt pjes t Kosovs, negociatat n Bruksel kan hyr n
vitin e shtat dhe kan rezultuar me ndryshime t rndsishme n teren. Mirpo, secila prej
ndryshimeve po krijohet ngadal dhe ka ndikim t kufizuar n jetn kualitative t qytetarve.
Pr kt arsye i tr edhe zgjon dyshimin ke qytetart. Nga ana tjetr, gjer sa qytetart e katr
komunave veriore me popullsi shumic serbe ballafaqohen me kaosin institucional t
shprbrjes s pjesshme t institucioneve serbe dhe me themelimit t pjesshm t
institucioneve kosovare (as njra as tjetra plotsisht funksionale), dy palt (Beogradi dhe
Prishtina) reciprokisht akuzohen pr bllokimin pr at q jan dakorduar.
Marrveshjet politike nga Brukseli t begatshm jan me kompromise t rnda politike,
mirpo, ekzistojn problemet e qytetarve t rndomt t cilt qeveria e Kosovs mund ti
zgjidh pavarsisht, shpejt dhe pa rrezikimin e rejtingut vetanik. Prkundrazi, Bashksia nga
katr komunat veriore po ballafaqohet me shkeljen e t drejtave m themelore, sepse qeveria e
Kosovs po ua vshtirson nxjerrjen e dokumenteve identifikuese, q pr pasoj ka t bj edhe
me t gjitha dokumente tjera.
Qasja n dokumentet identifikuese nuk sht vetm e drejt qytetare por edhe
parakusht pr kyje t ndonj bashksie n ciln do oft sistem administrativo-juridik. Me
vshtirsimin e qasjes n krkesat dhe procedurat e pakuptueshme administrative, qeveria
kosovare u drgon mesazh Serbve kosovar se jan t padshiruar n shoqrin kosovare.
Prve ksaj, n frym t diskutimeve gjithnj e m t pranishme pr kushtet pr liberalizimin e
vizave pr qytetart e Kosovs, duhet t theksohet edhe ajo se pikrisht qasja dokumenteve
identifikuese sht njri nga kushtet teknike t paraqitura Kosovs n dokumentin i cili definon
hapat t cilt qeveria e Kosovs duhet ti ndrmerr n kt drejtim. Njri prej ktyre kushteve
sht edhe:

Hapja e urs kryesore n Ibr pr komunikacion ose tiketa ngjitse prmbi pjesve
relevante t targave, pak do tu shrbejn qytetarve, afaristve apo studentve nga veriu i
Kosovs t cilt nuk mund t udhtojn m tutje nga ur dhe t marrin pjes n jetn
ekonomike, shoqrore dhe politike t pjess tjetr t Kosovs sepse nuk posedojn
letrnjoftimin apo patent shoferin kosovar.

edhe me patent shofert t cilat i lshojn institucionet serbe pr qytetart e vet q kan
vendqndrimin n Kosov, me t cilat nuk sht e mundur marrja pjes n komunikacion jasht
katr komunave veriore me popullsi shumic serbe. M n fund, ndr kt grup t dokumenteve
jan edhe pasaportat t cilat MPB serbe i lshon pr qytetart serb me vendbanim n Kosov
(kto pasaporta i lshon Drejtoria speciale e MPB, Drejtoria Koordinuese dhe pasaportat e
lshuara nga ana e ktyre institucioneve jan t prjashtuara nga regjimi pa viza t lejuar
Serbis n vitin 2009.) i cili n harmoni me nenin 3 t Ligjit kosovar pr nnshtetsi33, q
definon t drejtn n nnshtetsi t dyfisht, nuk duhet t vihet n pyetje. Mjerisht, n muajin
maj2017. jan paraqitur informatat se pronaret e pasaportave t Drejtoris koordinuese jan
kthyer nga kufiri me Maqedonin nga ana e policis kufitare t Kosovs si dhe paralajmrimet
se kto pasaporte m nuk do t konsiderohet legale. Sjellja e till e pushtetit kosovar jo vetm
q paraqet shkeljen e marrveshjes me Serbin pr njohjen reciproke t dokumenteve
personale dhe shkeljen e Ligjit pr nnshtetsin, por seriozisht do t cenoi lirin e lvizjes t
qytetarve t cilt ende nuk posedojn dokumentet kosovare.

34Problemet pr t cilat po flitet n kt dokument nuk jan vetm problemet t Serbve nga komunat
veriore, por edhe i Serbve dhe qytetar tjer t bashksive jo shumic t cilt jetojn n 10 komuna me
popullsi serbe shumic n tr Kosovn.
35N komunn Zubin Potok, deputetja e kuvendit lokal gjendet n situat absurde se sht npuns publik
i zgjedhur n Kosov, por q nuk sht nnshtetase Kosovare sepse nuk mund t aplikoi pr nnshtetsi.
N ann tjetr, ka mund t jet n listn pr zgjedhje lokale sepse n vitin 2013. serbve t Kosovs u
sht lejuar t votojn dhe t kandidohen me letrnjoftimet serbe.
36Qytetaret e Kosovs nga katr komunat veriore mbiemrin e tyre nuk do t mund ta ndryshojn as me
Meq Kosova n muajin nntor 2013. dhe korrik 2014. sht pajtuar me krkesn e
bashksis serbe q n zgjedhjet lokale, e pastaj edhe ato parlamentare mund t votohet edhe
me letrnjoftimet t cilat i ka lshuar MPB i Serbis pr qytetart e vet me vendbanim n
Kosov, sht e qart se sht mundur q Kosova t caktoi edhe periudhn kohore n t ciln do
t pranoi edhe dokumente tjera t lshuara nga ana e ktyre institucioneve, n mnyr q
qytetarve tu ofrohet rasti q vrtet t integrohen dhe ti tejkalojn t gjitha vshtirsit n t
cilat hasin gjat kontaktit me administratn Kosovare.

Platform for Analysis and Research
The Platform for Analysis and Research (PAR) is an informal group that came together in
April of 2015 as part of the project Strengthening the Capacity of Civil Society to Contribute
More Effectively to the Decision-Making Process that was financed by the Office of the
European Union in Kosovo and implemented by NGO AKTIV from Mitrovica e Veriut/Severna
Mitrovica and The Centre for Peace and Tolerance in Graanic/Graanica. Initially, PAR
counted fourteen (14) civil society organisations from four Serbian-majority municipalities in
north Kosovo and 25 of their members. PAR was formed with the goal(s):
To conduct research in all areas that are of importance to the quality of life of Serbian
and other minority communities in Kosovo
For every member present and promote the results of research carried out in
accordance with their personal potential and availability of funds
To analyse and research practical politics on the local and central levels of government
Prepare practical policy proposals and recommendations that will lead to positive
changes in legislation
Carry out advocacy for specific solutions in the area of practical policies that affect
members of non-majority communities, either independently or in cooperation with
certain groups of people.
The issuing of joint statements and positions towards issues that are of interest for the
Serbian community in Kosovo
Upon the projects completion, PAR underwent a re-organisation and counts eleven (11)
organisations and six (6) individual researchers as members. Currently, PAR is financed by
funds from SlovakAID and the Office of the European Union in Kosovo.
This document is designed as a policy memo addressed towards the members of the
Committee on Internal Affairs, Security and Supervision of the Kosovo Security Force, in order
to achieve broader participation of civil society organizations from four Serb-majority
municipalities of northern Kosovo (Mitrovica e Veriut/Severna Mitrovica, Zvean/Zvean,
Leposaviq/Leposaviand ZubinPotok) in the work of the Kosovo Assembly. The intention of the

document is to illustrate to the lawmakers the difficulties in accessing personal and travel
documents valid in Kosovo.
The document was drafted by the members of Platform for Analysis and Research with
special dedication of Marko Raki from Local Initiative North Kosovo - LINK. The document was
created as part of the project Increasing the Participation of Serbian CSOs in the Work and
Monitoring of Parliamentary Committees funded by European Union Office in Kosovo through
Kosovar Civil Society Foundation and implemented by NGO AKTIV from Mitrovica e
Veriut/Severna Mitrovica.

Freedom of movement in Kosovo is a human right that has been under discussion since
the end of the conflict. The issue of freedom of movement has been in the focus for decades, and
progress is noticeable but slow. Freedom of movement initially was part of technical
negotiations, and then it became a matter of negotiations at a higher political level in Brussels.

Subjective sense of the citizens security is a process that must flow naturally and is
conditioned by the substantial changes in social patterns, by strengthening of the institutions of
executive and judicial authorities and the degree of tolerance of the entire society. On the other
hand, administrative requirements are a problem that is easy to solve.
As defined by the Constitution, Kosovo represents a multi-ethnic society, and one of the
priorities of the domestic and foreign policies of the Government of Kosovo is integration of the
majority Serbian citizens of Northern Kosovo into the broader Kosovo society. The Government
intends to integrate minority communities in society through a whole set of contemporary and
liberal laws that protect the rights of non-majority communities, but also through the process of
negotiations with Belgrade in order to disband Serbian institutions and to establish Kosovo
institutions in this part of Kosovo. After seven years of negotiations in Brussels, significant
changes are evident as a result of this process. However, each change occurs slowly with limited
impacts on quality of citizens lives, and that is why the whole process arises suspicion among
people. On the other side, while the citizens of four northern Serb-majority municipalities face
institutional chaos of partially disbanded Serbian and partially formed Kosovo institutions, two
sides (Belgrade, Pristina) accuse each other of blocking the agreement.
Political agreements from Brussels include difficult political compromises, but there are
problems of ordinary citizens that Government of Kosovo can solve independently, quickly and
without endangering their own status. Community of four northern municipalities is facing a
violation of the most fundamental civil rights because Kosovo government hinders extraction of
identification documents, and consequently of all other documents.
Access to identity documents is not only a civil right but also a prerequisite for the
inclusion of communities in any administrative and legal system. Impeding access to documents
with complicated administrative procedures and requirements, the government sends a
message to Kosovo Serbs that they are not desirable in Kosovo society. In addition, with more
frequent discussions on the conditions for visa liberalization for the citizens of Kosovo, it should
be noted that the access to identification documents represents one of the technical
requirements for Kosovo, explicitly stated in the document that defines steps that Kosovo
government should take. One of those conditions is:
Provide full and effective access to travel and identity documents for all citizens
of Kosovo, including women, children, persons with disabilities and members of
minority communities and other vulnerable groups49.

Impediments that hinder the process of obtaining valid documents are numerous and
stem from the fact that Kosovo does not recognize marriage certificates issued by Serbian
institutions in Kosovo since 1989. However, many citizens of Kosovo who formed a marital
union after 1989.did not have Civil Registry Offices, except those in Serbian institutions until
2014., or in the case of northern Kosovo until December 2016, when Civil Registry Offices were
formed in municipalities of ZubinPotok, Zvean/Zveanand Leposavi/ Leposaviq50. However,
these new departments of administration have a limited scope of work and do not offer the
citizens all required services.
The opening of main bridge over the Ibar River for traffic will not be of much
importance to citizens, businessmen or students in northern Kosovo who are unable to travel
further than the bridge and participate in economic, social and political life of the rest of Kosovo
because they do not have Kosovo Identity Card or a driving license.
On the issue
Identity and travel documents are a prerequisite for the free movement of citizens all
over the world. On the territory of Kosovo currently there are three types of such documents:
Identity and travel documents issued by Serbian institutions for its citizens in
Kosovo, issued in some of the cities in Kosovo
Identity and travel documents issued by Serbian institutions, issued in some of
the cities in Serbia
Identity and travel documents issued by the Kosovo institutions
The first group of documents in Kosovo are treated as illegal, but as a result of the
agreement in 2011., identity cards issued by the Serbian institutions can be used when entering
or leaving Kosovo51, and in the north of Kosovo, where they are widely used. These documents
should be gradually replaced with Kosovo documents, however, due to the emotional, as well as
administrative obstacles, the process is stalling. The situation is similar with driving licenses
issued by Serbian institutions for its citizens who have permanent residence in Kosovo; with
these driving licenses it is not possible to participate in traffic outside the four northern
municipalities. This group of documents include passports issued by Serbian MUP (Ministry of
Internal Affairs) for Serbian citizens with residence in Kosovo (these passports are issued by

special department of MUP, Coordination Directorate, and its passports are excluded from visa-
free regime given to Serbian citizens in 2009); In accordance with Article 3 of Law on
Citizenship of Kosovo52, which defines the right to dual citizenship of Kosovo citizens, the
validity of Coordination Directorate passports should not be brought into question as
Coordination Directorate is a not a parallel Serbian institution in Kosovo but a central-level
institution providing services to its citizens residing in Kosovo. Unfortunately, in May 2017,
there appeared some information that people with passports issued by Coordination
Directorate, have been returned from border with Macedonia by Kosovo border police. This
incident was followed by the announcement that these passports will no longer be considered
legal. Such a move of the Kosovo authorities is not only a violation of the agreement with Serbia
on mutual recognition of identity documents and violation of the Law on Citizenship, but it will
seriously jeopardize the freedom of movement of citizens who do not possess Kosovo
documents.
The second group of documents reflects the necessity of citizens to seek solutions to
their difficulties. Many people choose to take identity and travel documents issued by some city
in Serbia, despite the fact that they reside in Kosovo. Citizens are deciding to take this action due
to the higher value of these documents, with respect to the other two groups of documents. So
people get driving licenses and identity cards which are valid on the entire territory of Kosovo,
and visa-free passports, as well.
Finally, the last group of documents, the documents issued by the Kosovo authorities are
valid throughout the territory of Kosovo and Serbia (except for Kosovo passports which are not
recognized as a travel document by Serbia, and some other countries and who are bound by the
issuance of visas).

On the same debate, the Deputy Minister of Interior said that ministry is well aware of
all the problems of the citizens in northern Kosovo and pointed out that the administrative
instruction, which would solve the problem of marriages recognition and of valid driving
licenses, is awaiting approval. The Administrative Instruction 02/2017 on the procedure for
driving license of the Republic of Kosovo56 was approved on March, 2017. However, this
instruction defines procedures for replacing UNMIK driving licenses, and driving licenses of FRY
issued until 10 June, 1999. This administrative instruction does not represent any progress
compared to the previous instruction of 201557 or, to instruction from 201158; it does not
facilitate the access of citizens with valid Serbian drivers licences to valid Kosovo driving
licenses59.

On November 2013 and July 2014, Kosovo approved the request of the Serbian
community that identity cards issued by the MUP of Serbia for its citizens residing in Kosovo,
can be used for voting at the local, and then parliamentary elections in Kosovo. It is clear that
Kosovo can determine time period in which it will accept other documents issued by these
institutions, in order to provide citizens a chance to integrate and overcome all the difficulties
they face in contact with the Kosovo administration.
Most recent local and general elections that were organized in Kosovo triggered another
avalanche of problems for Kosovo Serbs, especially for those who cannot exercise their right to
citizenship. In the elections of 2013 and 2014 integrated Kosovo and Serbian voter lists were in
use. This was done in order to offer a chance for Kosovo Serbs who did not have Kosovo
documents to run for elections and exercise their voting rights in Kosovo. It remains unclear
whether this practice will continue and how many people will lose their voting rights if it does
not continue.

Conclusion
Government of Kosovo points out that one of the main priorities of both, domestic and
foreign politics of Kosovo is integration of citizens from four northern municipalities with Serb-
majority population. However, administratively speaking, the Kosovo system remains
completely unprepared to provide efficient integration of citizens into Kosovo society. While the
reports of the Minister for Dialogue are full of accusations against the Government of Serbia and
its disruptive impact on the implementation of agreed, at the same time, the Government of
Kosovo is failing to provide basic services for citizens whose integration is one of main
priorities. Access to services of Kosovo institutions is an internal problem of Kosovo which is
easily manageable, and failure to eliminate this problem as well as the complete lack of
awareness that this problem exists, are indicators of how Kosovo government shows no interest
in ensuring the effective integration of the Serbian community.
