ALVARAN M\nicipal Councilor Municipal Counc JERRY R./AALAGOT ExOfficio * (ABC) (Vacant) Ex-Officio Member (SKF) Approved by: HON. an FESTIN Municipal Mayor oserewovet uM 19.2017 Republic of the Philippines Province of Occidental Mindoro MUNICIPALITY OF SAN JOSE OF THE SANGGUNIANG BAYAN ORDINANCE No. 851 Series of 2017 AN ORDINANCE ESTABLISHING MARINE PROTECTED AREAS (MPAs) IN SAN JOSE, OCCIDENTAL MINDORO PROVIDING FOR THE MANAGEMENT, CONSERVATION, DEVELOPMENT AND PROTECTIONS THEREOF, APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES WHEREAS, Republic Act No. 8550, also known as the “Philippines Fisheries Code of 1998", as amended by Republic Act No. 10654 provides for the development, management and conservation of the fisheries and aquatic resources and integrates all laws pertinent thereto; WHEREAS, Section 16 of the said Act provides that the municipal government shall have jurisdiction and shall be responsible for the management, conservation, development, protection, utilization and disposition of all fish and fishery and aquatic resources within their respective municipal waters; WHEREAS, said provision further provides that the municipal government, in consultation with the FARMC and in accordance with the National Fishery Policy, may enact appropriate ordinances for the said purpose and shall also enforce all fishery laws and regulations as well as valid fishery ordinances enacted by the municipal council; WHEREAS, it is also explicitly stated in Rule 16.3 of the IRR of RA 8550 that the municipal government is empowered to enact, in consultation with the Bureau of the Fisheries and Aquatic Resources (BFAR), special fisheries ordinance such as, but not limited to, declaring special demarcated fisheries areas, closed season and environmentally critical areas and sanctuaries; WHEREAS, Section 458 (a) (vi) of the Local Government Code of 1991 authorizes the LGU to ‘Protect the environment and impose appropriate penalties for acts which endanger the environment, such as dynamite fishing and other forms of destructive fishing, xxx". NOW, THEREFORE, be it ordained by the Sangguniang Bayan in session duly assembled that SECTION 1, TITLE. This ordinance shall be known as the "Marine Protected Areas Ordinance of 2017 of the Municipality of San Jose, Occidental Mindoro”. CHAPTER I DECLARATION OF POLICY AND DEFINITION OF TERMS SECTION 2. DECLARATION OF POLICY. This ordinance shall; 1. Ensure that the resources in the protected area are managed in ways that are sustainable, thereby providing measures to rehabilitate and protect the coral reef areas, marine plants, animals and other marine living organisms; and increase fish stocks within the municipal waters of San Jose, Occidental Mindoro. 2. Regulate and control human access to the fisheries, other fishing activities and aquatic resources of the municipality in order to maintain ecological balance and to ensure sustained ecosystem goods and services. Enhance the role of the stakeholders, especially the fisher folks, as guardian of the natural resources on behalf of present and future generations. Promote and develop an ecologically sensible program to advance environmental awareness and a viable vehicle which will improve the economic condition of the locality. Allow the people's full and active participation in the conservation, cultivation, enhancement, development and management of the coastal and fishery resources, such as, but not limited, to Community Based Coastal Resources Management, and shall promote awareness of sustainable fisheries through appropriate education and training. SECTION 3. Definition of Terms — For the purpose of this ordinance, the following definition of terms shall apply: ‘A. Bantay Dagat- a volunteer group of community members residing inside or within the vicinity of the coastal area, recognized and deputized by the Municipal Government of San Jose, whose task is to monitor, prevent or police the area against all sorts of illegal activities committed by any natural or juridical person. B. Buffer Zone - the zone surrounding the protected areas’ Core Zone but adjoining it which is to be managed to provide a social fence to prevent encroachment and fishing activities. . Buoy ~ metal, bamboo, wooden or fiberglass objects either floated anchored on the boundary or at the edge of the MPA Core Zone and Buffer Zone that will serve as guide for fishermen, navigators and communities not to enter or cross the Marine Sanctuary. D. Coral - the hard calcareous substance made up of the skeleton of marine coelenterate polyps which include reefs, shelves and atolls or any of the marine coelenterates, animals living in colonies where their skeletons form a strong mass. E. Coral Reef — geological features built by natural calcification and other deposits from corals and calcareous algae. F. Core Zone - otherwise known as "No Take Zone’, is the area within the MPA where all kinds or methods of fishing as well as other human activities are strictly prohibited. G. Destructive Activities ~ shall mean those activities that bring & cause damage or destruction to marine life-habitat and established facilities with in the park, H. Extractive Activities — taking out, catching or collecting of any living & rnon- living things with in the park, I. Eco-Tourism Carrying Capacity — It is identified based on an evaluation of tolerable population of an ecosystem. It is also including an amount of tensions applied to the ecosystem depending on the number of persons and Visiting activities which causes the ecologic value of ecosystem become unacceptable. The maximum number of visitors may visit a tourist destination at the same time, without causing destruction of the physical, economic, socio-cultural environment and an unacceptable decrease in the quality of visitors’ satisfaction. K. Estuary - the tidal mouth of a large river, where the tide meets the stream. Anestuary is a partially enclosed coastal body of brackish water with one or more rivers or streams flowing into it, and with a free connection to the open sea. Estuaries form a transition zone between river environments and maritime environments. They are subject both to marine influences—such as tides, waves, and the influx of saline water—and to riverine influences—such as flows of fresh water and sediment. The inflows of both sea water and fresh water provide high levels of nutrients both in the water column and in sediment, making estuaries among the most productive natural habitats in the world. L. Fisherfolks- person/s directly or personally and physically engaged in taking and or culturing and processing fishery & aquatic resources. M. Mangroves - a community of inter-tidal plants including all species of trees, shrubs, vines and herbs found on coast, swamps or border of swamps. N. Mariculture Park — is an area in the sea covering 500 hectares or more. It has a storm resistant mooring system and boundary markers. It is, subdivided into individual farm plots for fish cage operation, seaweeds farming and other aquaculture activities. 0. Marine Park ~ is a marine protected area sometimes protected for recreational, eco-tourism, and other non-destructive uses, but more often set aside to preserve a specific habitat and ensure ecosystem sustainability. P. Marine Protected Area (MPA) — it is essentially @ general term used, defining a space in the ocean where human activities are more strictly regulated than the surrounding waters - similar to parks we have on land. Q. Multiple Use Zone - is a zone surrounding the Core Zone(s) and Buffer Zone(S) of the Marine Park where human activities with low environmental impact such as diving, snorkeling, swimming, mooring and small scale hook and line fishing are allowed but regulated. R. Municipal Waters - include not only streams, lakes, inland bodies of water and tidal waters within the municipality which are not included within the protected areas as defined under the Republic Act No. 7586 (The NIPAS Law), public forest, timber lands forest reserves or fishery reserves, but also marine waters included between two (2) lines drawn perpendicular to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and a third line parallel with the general coastline including offshore islands and fifteen (15) kilometers from such coastline, Where two (2) municipalities are so situated on the opposite shores that there is less than thirty (30) kilometres of marine waters between them, the third line shall be, equally distant from the opposite shore of the respective mince. | 3 of 14 ArTesTeD BY JOE! Water Use Zoning and Zoning-Related Activities - Areas of the municipal waters are divided by appropriate authorities (CLWUP Technical Working Group) into zones within which various uses are permitted such as institutional and research, municipal and commercial fishing, restricted zones, marine parks, etc. Thus, zoning is a technique of land- and water- use planning as a tool of urban and rural/environmental planning used by local governments. Zoning-related activities include management and operations under the zoning administration sector usually carried out by the Municipal Planning and Development Office and/or the Zoning Administration Office. - AGUILAR, CHAPTER IL ‘THE MARINE PARK Section 4. LOCATION, AREA AND TECHNICAL DESCRIPTION OF SAN JOSE MARINE PARK. There shall be an established Marine Park with its Marine Protected Areas in the Municipality of San Jose with a total area of 987.343 hectares, of | which, a total area of 52.782 hectares is for the core zone. The San Jose Marine Park is bounded by the following geographical coordinates: ‘A. Banyaga Coordinates Banyaga Marine Park is a 138.996-hectare protected area about a kilometer away going South-Southeast of Buri Island, South of the Ambulong Island, of which 19.035 hectares at the center is declared restricted or no take zone. Generally, this covers the bodies of water surrounding the Cajuicay Island (Luli at Eastern side of White Island or Cabatiag), Manadi Island (White Island) and the Dongon Island (Luli, at Western side of White Island), about a kilometer away from each of the islands fronting North. The Local government shall identify the core zones, buffer and other identified subzones with reference to the coordinates and areas section of this Ordinance. Water use zoning shall be conducted in other areas of the municipal waters in consonance with this Ordinance and other zoning-related policies. SECTION 6. PLACING OF MARKERS AND BUOYS. Markers and buoys shall be installed in the identified Core Zones and Buffer Zones to distinguish the MPA Core Zone from Buffer Zone and other subzones. SECTION 7. CONSTRUCTION OF MONITORING STATIONS. Monitoring stations shall be constructed in different strategic locations of coastal and island barangays and shall be manned by Bantay Dagat, community volunteers, and identified municipal government personnel assigned in protecting the Marine Parks. CHAPTER IIT MANAGEMENT OF SAN JOSE MARINE PARK SECTION 8. CREATION OF LOCAL MPA MANAGEMENT BODY. The principal management strategy of the protected zone is geared towards environmental education and awareness that the community will be losing their livelihood where they are dependent upon if they fail to be responsible stewards of their resources, SECTION 9. COMPOSITION OF THE MANAGEMENT BODY. The local MPA Management Body shall be created as Marine Protected Area (MPA) Management Board with Ambulong-Banyaga Marine Park Management Team Ilin, Marine Park Management ‘Team and White Island-Cabatiag Marine Park Management Team. Conduct of series of organizational meetings to formulate the management bodies’ internal rules and regulations, membership and delineation of functions and authorities; 2. Delineation of boundaries of the sanctuaries and installation of the marker buoys; 3. Enactment of ordinances to support the implementation of the Ambulong- Banyaga Marine Park Management Plan, Ilin Marine Park Management Plan and White Island-Cabatiag Management Plan; 4. Deputation of Fishery Wardens and formulation of Patrolling Schedules; 5. Installation of facilities (e.g. guardhouse) and procurement of enforcement equipment and supplies; 6. Installation of billboards and conduct of barangay school meeting and other IEC or educational awareness campaigns and initiative to regularly inform the community of the status of the MPA; 7. Conduct of trainings and MPA management monitoring and evaluation activities; and 8. Conduct of regular meeting and capacity building of the management bodies. SECTION 13. MANGROVE PROTECTION AND CONSERVATION. The Municipal Government, in coordination with MFARMC, the people and their organizations in the adjacent barangays where mangroves are located, shall promote the proper management of mangrove areas in the municipality.
