AUTHORIZED TRANSLATION MINISTER OF TRANSPORTATION ‘THE REPUBLIC OF INDONESIA REGULATION OF THE MINISTER OF TRANSPORTATION OF THE REPUBLIC OF INDONESIA NUMBER PM 70 YEAR 2013 oN EDUCATION AND TRAINING, CERTIFICATION AND WATCHKEEPING FOR SEAFARERS WITH THE BLESSINGS OF THE ONE ALMIGHTY GoD THE MINISTER OF TRANSPORTATION, Considering a. whereas there are changes in International Convention on Standard of Training, Certification and Watchkeeping for Seafarers (STCW) 1978 and its Amendments, provisions such as stipulated in Regulation of The Minister of Transportation Number KM. 43 of the year 2008 on Education and Training, Assessment of Competency, and Seafarers Certification needs to be further regulated; b. whereas pursuant to the consideration as stated under point a, it will be necessary to stipulate Regulation of The Minister of Transportation on Education and Training, Certification and Watchkeeping for Seafarers; In view of: 1. baw Number 20 of the year 2003 on The National Education and Training System (State Gazette of the Year 2003 Number 78, Supplement to the State Gazette Number 4301); Law Number 17 of the Year 2008 on The Maritime (State Gazette of the Year 2008 Number 64, Supplement to the State Gazette Number 4849); Law Number 12 of the Year 2012 on Higher Education (State Gazette of the Year 2012 Number 158, Supplement to the State Gazette Number 5336); Regulation of the Government Number 7 of the Year 2000 on Seamanship (State Gazette of the Year 2000 Number 13, Supplement to the State Gazette Number 3929); Regulation of the President of the Republic of Indonesia Number 47 of the Year 2009 on Construction and Organization of State Ministry as amended by Regulation of President of the Republic of Indonesia Number 91 of the Year 2011; Requlation of the President of the Republic of Indonesia Number 24 of the Year 2010 on Position, Duties, and Function of State Ministry and Organizational Structure, Duties, and Functions of Echelon I of State Ministry as amended by Regulation of President of the Republic of Indonesia Number 38 of the Year 2013; Regulation of the President of the Republic of Indonesia Number 8 of the Year 2012 on Structure of Indonesia National Qualifications. Decree of The President of the Republic of Indonesia Number 60 of the Year 1986 on Ratification of International Convention on Standards of Training, Cert cation and Watchkeeping for Seafarers 1978; Regulation of The Minister of Transportation Number KM 60 the Year 2010 on Organization and Management of the Ministry of Transportation; HAS DECIDED To stipulate: REGULATION OF THE MINISTER OF TRANSPORTATION ON EDUCATION AND TRAINING, CERTIFICATION AND WATCHKEEPING FOR SEAFARERS. CHAPTER I GENERAL PROVISIONS Article 1 Definitions and Clarifications For the purpose of the Regulation, unless expressly provided otherwise + 1. Seafari g means terms related to manning, education, certification, authority, rights and obligations seafarers. on and Training and Education of Seafarers means educ: training to achieve required competency and proficiency according to various degrees and types of competency for merchant marine vessels manning. 3. Competency Training and Education for Seafarers means various types of education and training programs to achieve the specified capacity in order to obtain Certificate of Seafarers Competency. Proficiency Training and Education for Seafarers means various types of education and training program to provide proficiency and skills to carry out jobs and/or specific functions on board Seafarer Training and Education Institutions means institutes of education and training managed by either the Government or the Non-government, which provide competency and/or proficiency training for seafarers under the applicable laws and regulations. Competency means the capacity and characteristics within a specific person in terms of knowledge, skills, and attitudes to understand and master in order to perform a professional work. Certificate of Competency means a certificate issued and endorsed for Masters, Officers and GMDSS Radio Operators in accordance with the provisions of chapters II, III, or IV of STCW convention 1978 and its amendment and entitling the lawful holder thereof to serve in the capacity and perform the functions involved at the level of responsibility specified therein. Certificate of Endorsement means a certificate issued to mandate authority to the lawful holder of the Certificate of Competency to perform the functions involved at the level of responsibility specified therein. Certificate of Proficiency means a certificate, other than a certificate of competency and endorsement issued 4 10. ll. 12. 13. 1a. to a Seafarer, stating that the relevant requirements of training, competencies or seagoing service in the Convention have been met. Ship means vessel of specific types end shapes propelled by wind force, mechanical force, or other types of energy, towed or tugged, and not limited to non- displacement craft, submersible vessel, and static floating equipment or floating structure. Seafarer means the person with qualified competency and skills as a ship crew. Ship Crew means the person working or assigned on board by the ship owner or ship operator to perform tasks on board at the level of responsibility specified in the Logbook. Approved means approval of education and training programs, simulators, laboratories, workshops, service on training vessel, seagoing service, training record book, and hospital and other relevant approval issued by the Director General. Standards of Training, Certification and Watchkeeping Code means a Code on Training, Certification and Watchkeeping for Seafarers as adopted by International Conventions on STCW 1978 and its amendment. Company means the owner of the ship or any other organization or person such as the manager, or the bareboat charterer, who has assumed the responsibility 5 16. 17. 1s. 20. ai. for operation of the ship from the shipowner and Legal Entity that has responsibility on the operation of the ship. Master means the person having the highest command on the ship and owns specific authority and responsibility under applicable laws and regulations. officer means a member of the crew, other than the master, designated as such by national law or regulations as an officer onboard. Deck Officer means an officer qualified for works at the deck department. thief mate means the deck officer next in rank to the master and upon whom the command of the ship will fall in the event of the incapacity of the master. Watchkeeping Officer means the deck officer who has designated function onboard as Second Officer, Third Officer, or Fourth Officer. Cadet means the student qualified for onboard training. Engineer Officer means an officer qualified for works at the engine department. Chief Engineer means the senior engineer officer responsible for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installations of the ship. Second Engineer Officer means the engineer officer next in rank to the Chief Engineer Officer and upon whom the 6 2s. 26. 27. 28. 29. 30. responsibility for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installations of the ship will fall in the event of the incapacity of the chief engineer officer. Watchkeeping Engineer means the engineer who has designated function as Third Engineer Officer cr Fourth Engineer Officer, or Fifth Engineer Officer. Radio operator means a person holding an appropriate certificate issued or recognized by the Administration under the provisions of the Radio Regulations. GMp35 (Global Maritime Distress and Safety System) Radio Operator means a person who is qualified to perform as radio operators on ships operating in the global maritime distress and safety system (GMDSS) and who has qualifications in accordance with the provisions of chapter 1V of the STCH International Convention 1978 and its Amendment. Radio duties include, as appropriate, watchkeeping and technical maintenance and repairs conducted in accordance with the Radio Regulations, the Convention OF SOLAS (the Safety Of Life At Sea) 1974 and its amendment. Electro-Technical Officer means an officer qualified in cordance with the provisions of the STCW Convention 1978 and its amendment of Chapter ITI/6. Rating means a member of the ship’s crew other than the master or an officer. 31. 32. 33. 34. 36 37. Rating Performing Task of @ Navigational Watch and Helm Watch means a rating that is qualified in accordance with the provisions of the STCW Convention 1978 and its amendment of Chapter 11/4. Able Seafarer Deck means a rating qualified in accordance with the provisions of the STCW Convention 1978 and its amendment of Chapter 11/5. Rating Forming Part of an Engine Watch means a rating who performs engine watchkeeping and who is qualified in accordance to the provisions of the STCW Convention 1978 and its amendment of Chapter ITI/4 of. Able Seafarer Engine means a rating qualified in accordance with the provisions of the STCW Convention 1978 and its amendment of Chapter I1I/S. Electro-technical rating means a rating qualified in accordance with the provisions of the STCW Convention 1978 and its amendment of Chapter III/7. unrestricted Voyage means voyages in all oceans around the world. Near Coastal Voyages means voyages in the areas limited by lines drawn from the latitude of 10° North in Western Coast of Malaysia, along the Coast of Malaysia, Singapore, Thailand, Cambodia, and South Vietnam in Tiwan Cape, and by lines drawn between Tiwan Cape and Baturampon Cape in Philippines, along the Southern Coast of Philippines to San Augustin Cape, to the latitude of 0° 8 38. 39. 40. 4. 43. 44 and longitude of 140° Bast, latitude 0° and longitude of 153° east, latitude 12° South and longitude of 153° East through certain parts of Northern Coast of Australia. Local Voyage means voyages within the vicinity radius of 500 (five hundred) nautical miles from a departure port without entering the coastal area of other countries. Restricted Voyage means voyages within the vicinity radius of 100 {one hundred) nautical miles from a departure port without entering the coastal area of other countries. Propulsion power means the total maximum continuous rated output power, in kilowatts (kW), of all the ship's main propulsion machinery, which appears on the ship's certificate of registry or other official document. Oil tanker means a ship constructed and used for the carriage of petroleum and petroleum products in bulk. Chemical tanker means a ship constructed er adapted and used for the carriage in bulk of any liquid product listed in Chapter 17 of the International Bulk Chemical Code/TBC Code. Liquefied Gas Tanker means a ship constructed or adapted and used for the carriage of any liquefied gas or other product listed in Chapter 19 of the International Gas carrier Code. Passenger Ship means a ship that carries and transports 12 {twelve} or more passengers. 45. Ro-ro Passenger Ship means a passenger ship with ro-ro cargo spaces or special category spaces. 46. Month means a calendar month or 30 days made up of periods of less than one month. 47. On Board Training means a part of education in seafarer training program, which involves seamanship training on board a merchant marine vessel whereas the vessel size, main propulsion, and voyage area have been predetermined in accordance to the certificate to be obtained. 48. Sea Going Service means service on board a ship relevant to the issue or revalidation of a certificate or other qualification. 49. Ship Security Officer means the person on board the ship, accountable to the master, designated by the Company as responsible for the security of the ship including implementation and maintenance of the ship security plan and liaison with the Company Security Officer and Port Facility Security Officers. 50. Security Duties are all security tasks and duties on board ships as defined by the Convention for the Safety of Life at Sea, 1974 (SOLAS), and its amendment of Chapter XI-2 and the International Ship and Port Facility Security (ISPS) Code 51. Documentary Evidence means documentation, other than a certificate of competency or certificate of proficiency, 10 ar Sy used to establish that the relevant requirements of the Convention have been met 52. Directorate General means the Directorate General of Sea Transportation. 53. Director Generel means the Director General of Sea Transportation. 54. Head of the Agency means the Head of the Agency of Human Resources Development in Transportation. 58. Minister means the Minister of Transportation. CHAPTER II CERTIFICATION AND ENDORSEMENT Part One General Provisions Article 2 (1) Certificate of Competency, Certificate of Endorsement, and Certificate of Proficiency shall be issued by Director General. (2) The Director General shall provide forms of Certificate for Seafarers. (3) Certificate issued for trainings and qualification of masters and officers on tanker shall only be issued by Director General. (4) Institutions that have approval to carry out Training for Seafarers shall have the authority to issue Certificate of Proficiency for seafarers, other than the Certificate of Proficiency for Tankers for masters and officers. AL (5) a (2) cy) Certificates shall be issued in Indonesian language and shall include translation into English. Article 3 Certificate of Competency for GMDSS radio operators shall be issued by the Director General to indicate that the holder has the additional knowledge required by the radio regulations. Director General shall issue Certificate of Endorsement as separate documents for each Certificate of Competency to indicate the authority in which the holder of a certificate is authorized to serve. Director General shall issue Certificate of Recognition for certificates of competency and certificates of proficiency for tankers, issued in accordance with Regulation V/1-1 and V/1-2 of STCW 1978 and its amendment, for foreign seafarers intending to work on board Indonesian-flagged ship in accordance to Memorandum of Undertaking with other countries. Any certificate required by the Convention must be kept available in its original form on board during the holder is serving on ship. Director General shall ensure that the certificates are issued only to candidates who comply with the requirements of the applicable regulations. Director General undertakes to maintain a register or registers of all certificates that are issued, and in 12 om a oo {10} Sie eS case of Certificate of Endorsement including the data of expiry date, revalidation, cancellation, or reports of loss or destroyed. Director General undertakes to make available information of the status of all Certification for Seafarers to other countries and companies which request verification of the authenticity and validity of certificates. Director General shall stipulate separate regulation on Certificate of Special Proficiency for masters and officers performing towing on vessels under tow with the length of the tow, measuring from the stern of the towing vessel to the after end of the tow exceeding 100 {one hundred) meters; the certificate shell be issued upon completion of training conducted by the Agency of Human Resources Development in Transportation. Director General shall stipulate separate regulation on Certificate of Special Proficiency for masters and officers performing on High Speed Craft/HSc; the certificate shall be issued upon completion of training conducted by the Agency of Human Resources Development in Transportation. As of 1 January 2017, the information on the status of certificate shall be made available in the English language, through electronic means. Part Two Regulation on Near Coastal Voyage 13 ay 42) (3) @y Article 4 Director General regulates the borders of near coastal voyage for the purpose of certification for seafarers serving on board Indonesian-flagged ships. The certificates of seafarers issued by the Director General for its defined near-coastal voyages limits may be accepted by other parties for service in their defined near-coastal voyages limits, provided the parties concerned enter into an undertaking specifying the details of relevant conditions thereof. Provisions such as described in paragraph 1 and 2 will be further regulated in the Regulation of The Director General. Part Three Procedures of Control for Seafarers Certification Article 5 In the pursuit of ship seaworthiness, all ship crew shall be in possession of certificates in accordance with the requirement regulation under control of authorized personnel. Control exercised by a duly authorized control officer referred to in paragraph (1) shall be limited to: Verification that all seafarers serving on board are required to hold a legal and valid certificate. 14 (3) Verification that the certificates of the seafarers serving on board are in conformity with the applicable safe manning requirements if there are clear grounds for believing that the standards of the ability of the seafarers of the ship to maintain watchkeeping and security are not being maintained so that the ship is involved in a collision, grounding, or operated in an erratic and unsafe manner, and use the assessment result as a reasonable ground to order crew replacement. In performing control procedures referred to in paragraph (1), deficiencies which may be deemed to pose a danger to persons, property, or the environment include the following: a. Failure of seafarers to hold a certificate, and/or to provide required documentary. Failure to comply with the applicable safe manning requirements of the Director General. Failure of navigational or engineering watch arrangements to conform to the requirements specified for the ship by the Director General. Absence in a watch of a person qualified to operate equipment essential to safe navigation, safety radio communication or the prevention of marine pollution; and 15 ry a (2) a) e. Inability to provide, for the first watch at the commencement of a voyage and for subsequent relieving watches, persons who are sufficiently rested and fit for duty. Failure to correct any of the deficiencies referred to in paragraph (3) shall be the only grounds on which the ship may be detained. Part Four National Provisions Article 6 Director General shall establish processes and procedures for the impartial investigation of any reported incompetency, ignorance act, that may endanger to security that may pose a direct threat to safety of life or property and sea pollution, and inconsiderate actions, not limited to unauthorized leave of absence, by the holders of certificates. Based on the investigation referred to in paragraph (1), Director General shall establish processes and procedures for the withdrawal, suspension, cancellation, and the deletion (write-off) of such certificates from database for such cause, including the procedures for the prevention of fraud or other unlawful practices involving issuance of the certificates. Penalties or disciplinary measures for the reported incompetency as referred to in paragraph (1) and for 16 co a (2) a fraud and unlawful issuance of certificates as based referred to in paragraph (2) will be taken based on applicable regulations Director General shall prescribe and enforce penalties or disciplinary measures in cases in which a company or a manning agent has engaged a seafarer in possession of a certificate that does not comply with this Regulation. Article 7 In order to obtain Certificate of Competency for Seafarers, a candidate shall take Competency Assessment for Seafarers provided that the Director General has approved the training program in which the candidate is enrolled. Director General shall stipulate a regulation on certificates of competency for seafarers who perform functions on 8 motor vessel less than GT 35 (thirty five Gross Tonnage) and on motorized sailing ship that performs Local Voyages. Part Five Education and Training and Assessment Article @ The training of seafarers with its code of conduct is regulated by the Head of Agency and is administered in accordance with the National Education Standard and provisions of Section A-I/6 of the STCW code. 7 ay By (6) The trainings of seafarers administered by the Seafarer Training Institutions are required to obtain approval from Director General based on audit performed by a team of auditors. Approval as referred to in paragraph (2) shall be issued when a Seafarer Training Institutions has satisfactorily fulfilled the requirements o: Facilities and infrastructure standards; Educational and trainer qualification standard: Operational management standards; Financial standards; Trainee competency standards; Content standards; Process standards; Training assessment standards Standards as referred to in paragraph (3) letter a, letter b, letter c, letter d, letter e, letter f, letter g, and letter h shall be regulated by the Agency of Human Resources Development in Transportation. Auditor team members as referred to in paragraph (2) shall be appointed by the Director General and shall consist of Officer and Staff of Directorate General and Agency of Human Resources Development in Transportation. The training for seafarers as referred to in paragraph (1) includes: 18. mo (3) a) (20) a. Competency Training for Seafarers conducted by formal and non-formal institutions. Proficiency Training for Seafarers conducted by non- formal institutions. The training for seafarers as referred to in paragraph (6) may be conducted by the Government, Local government, State-owned Companies, Local Government-Owned Companies, or local community provided that the way of conduct is in accordance with the regulation. Training for Seafarers with the syllabus conformed to International Convention of STCH 1978 and its amendment through non formal institutions will be conducted by the Agency of Human Resources Development of Ministry of Transportation in accordance with the applicable regulations. Training for Seafarers, without the syllabus conforming to International Convention of STCW 1978 and its amendment, through non formal institutions for seafarers working aboard the ship of 35 GY (thirty five Gross ‘ronnage) or more will be conducted by the Agency of Human Resources Development of Ministry of Transportation and State-Owned Companies in accordance with the applicable regulation. The training for seafarers as referred to in paragraph (5) shall meet the Indonesian Seamanship Quality Standard System and be in accordance with National Education 19 (ay (12) (a) Q) Standard and STCW 1978 International Convention 1978 and its amendment. Periodic evaluation of not less than one time per year will be conducted in the effort to keep up with the Indonesian Seafarer Quality Standard System. Head of Agency will stipulate curriculum and syllabus for Training of Seafarers, in accordance with national regulations and STCW International Convention 1978 and its amendment. Article 9 Revocation of approval for a training program will be delivered in the event of a deficiency found during @ special audit proving that a training institution does not conform to the Indonesian Seafarer Quality Standard system. Revocation of Approval as referred to in paragraph (1) shall be issued in accordance with the following chronological procedure: Three written warnings in the interval of not more than 30 (thirty) working days; Revocation is issued only after the third warning supported with the audit result proven that there is no significant improvement; The training institution whose approval being revoked must transfer the training participants to 20 ae a 2) a) 14) (3) > another endorsed training institution approved by the Director General; and d. The training institution whose approval being revoked shell not be permitted to take new training participants. Article 10 In the interest of Indonesian seafarer quality control, Notional Committee on Indonesian Seafarer Quality Control shall be established. National Committee on Indonesian Seafarer Quality Control shall be stipulated by and responsible to the Director General. National Committee on Indonesian Seafarer Quality Control shall submit the report not less than 1 (one) report per year. National Committee on Indonesian Seafarer Quality Control is obliged to take further actions on each report from the community in regard of Indonesian seafarer quality. Director General will conduct and monitor Seafarer Competency Assessment. Director General will stipulate on systems and procedures of Seafarer Competency Assessment. Director General shall establish Board of Seafarer Competency Assessors, which will be chaired by a Director from maritime department. 21 (8) The training of seafarers is monitored both by the Director General and the Head of the Agency. (9) Long-distance learning Method using Information Technology will be further regulated by Director General and/or Head of Agency. (10) Chairman of Board of Seafarer Competency Assessors must be in possession of at least the Certificate of Deck and Engine Officer Class I (ANI/ATT I). Part Six Report Article 11 Director General shall provide to the Secretary General of the International Maritime Organization {IM} all information describing regulations and procedures taken to give the STCW convention and its amendment in full end complete effect. Part Seven Quality Standards Article 12 (1) Minister/Director General shall establish Tndonesian Seafarers Quality Standard System. (2) For each institution or entity which administers all seafarers training, competency assessment, certification, including procedures for the issue of medical certificate for seafarers, there shall be a quality standards system stipulated by Minister/Director General. (3) Director General shall ensure that all training, competency assessment, certification, including 22 procedures for the issue of medical certificates, endorsement and revalidation activities carried out under its authority are continuously monitored through a quality standards system, including those concerning the qualifications and experience of instructors and assessors. (4). For Indonesian seafarers quality assurance, training institutions that conduct Training for Seafarers will be under counsel of Head of Agency of Human Resources Development of Transportation. Part Eight Seafarers Medical Standards Article 13 (1) Director General shall establish medical seafarers standards and procedures for the issue of a seafarers medical certificate in accordance with the provisions of this regulation of Section A-I/9 of the STCW Code (2) Medical facilities are eligible to obtain approval from Director General for assessing the medical fitness for seafarers provided that the medical facilities employ medical doctors recognized by the Director General. (3) Medical facilities referred to in paragraph (2) shall have residential doctors in, at the least, ophthalmology, otolaryngology, internist, clinical _—pathologist, radiologist, dentist, psychiatrist, and maritime medicine. 23 Ore (4) Seafarer who is able to employ on ship is the seafarer holds valid seamanship certificate and medical certificate. (5) Every candidate for the certification shall: a. Be not less than 16 years of age; b. Provide satisfactory proof of his/her identity; and ©. Meet the seafarer medical standards (6} Medical certificates shall remain valid for a maximum period of 2 (two) years unless the seafarer is under the age of 18 (eighteen], in which case the maximum period of validity shall be one year. (7) Should the period of validity of a medical certificate expire in the course of a voyage, the medical certificate shall continue in force until the next port of call where a hospital approved by the Director General is available, provided that the period shall not exceed 3 (three) months. Part Nine Recognition of Certificates Article 14 Director General shall issue recognition of certificates issued by authority of other countries as referred to in Article 3 paragraph (6) of this regulation for masters, officers, or radio operators, after ensuring that a. The evaluation has been made, which may include inspection of facilities and procedures, that the 24 requirements of the Convention regarding standards of competence, education and training and certification and quality standards are fully complied with: and b. In case of there is any significant change in the arrangements, administered by authority of other countries, for training and certification provided in compliance with the Convention, Director General shall be given prompt notification. Part Ten Revalidation of Certificates Article 15 il) Every master, officer, radio operator, and GMDSS radio operator holding a certificate issued or recognized under any chapter of the 1978 STCW Convention and its amendment, other than chapter VI, who is serving at sea or intends to return to sea after a period ashore, in order to continue to qualify for seagoing service as master, officer, radio operator, or GMDS$ radio operator; be required, at intervals not exceeding 5 (five) years, t a. Meet the seafarer medical standards; and b. Complete special training based on the Certificates of Competency as required. (2) Every Master, officer, radio operator, or GMDSS radio operator shall, for continuing seagoing service on board ships for which special training requirements have been aaa 25, an B) (ay is) (6) internationally agreed upon, successfully complete relevant training administered by approved training institutions Master and officer shall, for continuing seagoing service on board tankers after more than 5 (five) year period ashore, successfully complete relevant training for tankers, respective to the cargo type, in accordance with chapter V of the STCH Code. Director General shall evaluate the standards of competence which it required of candidates for certificates issued before January 1, 2017 with those specified for the appropriate certificate in the sT¢w Code, and shall determine the need for additional competence and requiring the holders of such certificates to undergo appropriate refresher and updating training and/or assessment. For the purpose of updating the knowledge of masters, officers, radio operators and GMDSS radio operators of recent changes in national and international regulations concerning the safety of life at sea, security and the protection of the marine environment, must be administered by approved seafarer training institutions. The formulation of a structure of refresher and updating courses shall be stipulated in separate regulation. Part Eleven Use of simulators 26 ay (2) 3) ro a (2) Article 16 Seafarers training, in which the objective competence is achieved by the use of simulators and laboratories, must be administered by institutions with approved simulators and/or Laboratories. Director General shall issue spproval on targets, performance standards and efficiency of each simulator and/or laboratory. Head of Agency shall regulate on the use of simulators and/or laboratories for seafarers training. Director General shall regulate specific assessments to obtain seafarers certificate that involves assessments using simulators, laboratories, and Computer-Based Training (CBT). Part Twelve Conduct of Trials Article 17 Director General shall hold authority in conduction of trials on Indonesian-flagged ships and shall ensure such trials are conducted in a manner that provides at least the same degree of safety, security and pollution prevention. Trials as referred to in paragraph (1) means an experiment or series of experiments, conducted over a limited period, which may involve the use of automated or integrated systems in order to evaluate alternative 27 44) ay methods of performing specific duties or satisfying particular arrangements prescribed by the Convention, which would provide at least the same degree of safety, security and pollution prevention. The trials on Indonesian-flaqged ships shall be conducted in accordance with the guidelines adopted from International Maritime Organization. Director General shall report details of such trials to the International Maritime Organization as early as practicable but not less than 6 (six) months before the date of trials commencement. Part Thirteen Responsibilities of Companies Article 18 Companies shall hold responsible for the assignment of seafarers for the service in their ships. Each company shall ensure that: a. Bach seafarer assigned to any of its ships holds appropriate seamanship certificate in accordance size, type, and voyage area of the ship. b. Its ships are manned in compliance with the minimum safe manning requirements stipulated by Director General. c. Seafarers, on being assigned to any of its ships, are familiarized with their specific duties and with all ship arrangements, installations, equipment, 28 procedures and ship characteristics that are relevant to their routine or emergency duties; and are provided opportunities to receive training as required. d. The ship can effectively coordinate their activities in an emergency situation and in performing functions vital to safety, security and to the prevention and mitigation of pollution @. at all times on board its ships there shall be effective | communication during _—navigational procedures; and £. The ship of 175 GT (one hundred seventy five Gross Tonnage) or more are to provide accommodation for seagoing training. Part Fourteen Special Provisions on Endorsement Article 19 Managerial authority stated on the Certificates of Deck/Engine Officer Class V, Deck/Engine Officer Class IV, or Deck/Engine Officer Class III shall be stated no more on the new Certificate of Endorsement when the candidate obtain certificate of Competency of one level higher since the new authority herein is in the operational level. CHAPTER IIT COMPETENCE OF MASTER AND DECK PERSONNEL Part One Certificate of Deck Officer Class I 29 Article 20 (1) Certificate of Competency Deck Officer Class I shall be issued and entitled for every candidate who meets following minimum requirements: Be a holder of Certificate of Competency Deck Officer Class II; Have approved seagoing service of not less than 36 (thirty six) months, after being entitled for Certificate of Deck Officer Class II, as an officer performing bridge watchkeeping duties on a ship of GT 500 (five hundred gross tonnage} or more; or have approved seagoing service in that capacity not less than 24 (twenty four} months with at least 12 (twelve} months serving in the capacity of Chief Mate on ships of GT 3000 (three thousand Gross Tonnages) or more in Unrestricted Voyages; and c. Have completed approved training for Deck officer Class I, which is an in-depth training to meet the minimum standard of competence specified in Section A-II/2 of the STCW Code and additional competence stipulated by the Director General, and have passed the Seafarer Competency Assessment for Deck Officer Class I. (2) The authority for position on board is referred to in Certificate of Endorsement as Master on ships of all gross tonnages in Unrestricted Voyages. 30 a (2 Part Two Certificate of Deck Officer Class II Article 21 Certificate of Competency Deck Officer Class II shall be issued and entitled for every candidate who meets following minimum requirements: a Be a holder of Certificate of Competency Deck Officer Class T11 Have approved seagoing service of not less than 36 (thirty six) months, after being entitled for Certificate of Deck Officer Class III, as an officer performing bridge watchkeeping duties on a ship of GT $00 (five hundred gross tonnage) or more; or not less than 24 (twenty four] months as Watchkeeping Officer on a ship of GT $00 (five hundred Gross Tonnages} of more in Unrestricted Voyage, with at least 12 (twelve) months in managerial level; and Have completed approved training for Deck Officer Class [I to meet the minimum standard of competence specified in Section A-II/2 of the STCW Code, or have obtained Nautical Diploma IV Degree and have passed the Seafarer Competency Assessment for Deck Officer Class II. The authority for position on beard is referred to in Certificate of Endorsement as: Chief Mate on ships of all gross tonnages in 31 ay Unrestricted Voyages; Master on ships of all gross tonnages in Near Coastal Voyages(NVC); after 12 (twelve) months of approved seagoing services as Chief Mate on ships of GT 3000 (three thousand gross tonnages) or more in Unrestricted Voyages; and Master on ships of less than GT 3000 (three thousand Gross Tonnages} in Unrestricted Voyage provided that the candidate have experienced functioning as Chief Mate at least for 12 [twelve) months on a ship of GT 3000 (three thousand gross tonnages) or more in Unrestricted Voyages. Part Three Certificate of Deck Officer Class III Article 22 Certificate of Competency Deck Officer Class III shall be issued and entitled for every candidate who meets following minimum requirements: aie b. Be not less than 18 years of age. Have an approved seagoing service as a cadet of not less than 12 months, as a part of special training in accordance to the requirements of Section A-II/1 of SICH Code, which is documented in an approved training record book and shall involve not less than 6 (six)-month performance of bridge watchkeeping duties carried out under the direct supervision of 32 the master or competent officers in charge of navigational watch Have an approved seagoing service of not less than 30 (thirty) months for candidates who have Certificate of Deck Officer Class IV, or not less than 12 (twelve) months for candidates with Certificate of Deck Officer Class IV Management, or not less than 60 (sixty) months for candidates with ANKAPIN I who upon completion of training for Certificate of Deck Officer Class III shall have to finish the seagoing service as a Cadet; Have completed training for CMDSS radio operators in accordance with Chapter IV STCW 1978 Convention and its amendment; Have completed approved training of Diploma III and/or IV Nautical major or an approved training for certification as Deck Officer Class III and meet the minimum requirements specified in Section A-II/1 STCW Code; and f. Have completed the relevant trainings in basic safety training, survival craft and rescue boat other than fast rescue boat, advanced fire fighting, medical first aid on board, and security awareness. (2) The authority for position on board is referred to in Certificate of Endorsement as Deck Watchkeeping Officer on ships of all gross tonnages in Unrestricted Voyages. 33 Article 23 (1) Certificate of Competency Deck Officer Class TIT Management shall be issued and entitled for every candidate who meets following minimum requirements: Be a holder of Certificate of Deck Officer Class Tir. Have completed training of Deck Officer Class IIL Management specifically for holders of Certificate of Deck Officer Class III as stipulated by the Director Generel in accordance with the minimum requirements specified in Section A 11/2 of STCW 1978 Convention and have passed the Seafarer Competency Assessment for Deck Officer Class 111 Management; and c. Have an approved seagoing service, after being entitled for Certificate of Deck Officer Class IIT, of not less than 12 (twelve) months on ships of 6? 500 (five hundred gross tonnages} or more in Unrestricted Voyages. (2) The authority for position on board is referred to in Certificate of Endorsement a a. Chief Mate on ships of less than GT 3000 (three thousand gross tonnages] in Unrestricted Voyages; or on ships of GT 3000 {three thousand gross tonnages) or more in Near Coastal Voyages; on both circumstances the candidate shall previously have at 34 (yy least 12 (twelve)-month experience as a Watchkeeping Officer on ships of 500 GT (five hundred gross tonnage) or more in Unrestricted Voyages: Master on ships of less than GT 500 (five hundred gross tonnages) in Unrestricted Voyages provided that the candidate previously has at least 12 (twelve-month experience as Chief Mate on ships of GT 3000 {three thousand gross tonnages} in Unrestricted Voyages; and Master on ships of GT 3000 (three thousand gross tonnages) or more in restricted voyages provided that the candidate have approved seagoing service for the period of not less than 12 months as Chief Mate on ships of GT 3000 (three thousand gross tonnages) in Restricted voyages. Part Four Certificate of Deck Officer Class IV Article 24 Certificate of Competency Deck Officer Class IV shall be issued and entitled for every candidate who meets following requirements: Be not less than 18 years of age; Have an approved seagoing service as a cadet of not less than 12 (twelve) months, as a part of special training in accordance to the requirements of Section A-II/3 of STCW Code, which is documented in 35 an approved training record book; and of which shall involve not less than 6 {six)-month performance of bridge watchkeeping duties carried out under the direct supervision of the master or competent officers in charge of the navigational waten; Have an approved seagoing service of not less than 30 {thirty} months for candidates who have Certificate of Deck Officer Class V, or not less than 12 (twelve) months for candidates with Certificate of Deck Officer Class V Management, or not less than 60 {sixty} months for candidates with ANKAPIN II who upon completion of training for Certificate of Deck Officer Class IV shall have to finish the seagoing service as referred to in paragraph b; Have completed special training for GMDSS radio operator as specified in Chapter Iv STCW Code and its amendment. Have completed approved training and meet parts of the minimum standard of competence specified in Section A-II/1 STCW Code for specified knowledge and skills, and meet the minimum standard of competence specified in Section A-II/3 STCW Code for certification of Deck Officer Class IV, or Maritime Vocational School majoring in Nautical, or Diploma III program majoring in Nautical, and have passed 36 the Seafarer Competency Assessment of Deck Officer Class IV; and f£. Have completed the relevant trainings and meet the standard of competence for basic safety training, survival craft and rescue boat other than fast rescue boat, advanced fire fighting, medical first aid on board, and security awareness. (2) The authority for position on board is referred to in Certificate of Endorsement a! a. Watchkeeping Officer on ships of less than GT 500 (five hundred gross tonnages) in Near Coastal Voyages; Watchkeeping Officer on ships less than GT 3000 (three thousand gross tonnages) in near Coastal Voyages after having an approved seagoing service for not less than 12 months as Watchkeeping Officer on ships of less than GT 500 (five hundred gross tonnages in Near Coastal Voyages; and Watchkeeping Officer on ships of GT 3000 (three thousand gross tonnages) or more in restricted voyages provided that the candidate have approved seagoing service for the period of not less than 12 months as Watchkeeping Officer on ships of less than GT 500 (five hundred gross tonnages) in Near Coastal Voyages. Article 25 37 (1) Certificate of Competency Deck Officer Class IV Management shall be issued and entitled for every candidate who meets following minimum requirements: a. Be @ holder of Certificate of Deck Officer Class Iv; b. Have completed training of Deck Officer Class IV Management as specified in section A-II/3.7 and Section A-II/2.8, meet the standard minimum of competence as stipulated by the Director General, and passed the Seafarer Competency Assessment for Deck Officer Class IV Management; and c. Have an approved seagoing service, after being entitled for Certificate of Deck Officer Class Iv, of not less than 12 (twelve) months (2) The authority for position on board is referred to in Certificate of Endorsement as: a. Master on ships of less than GT 500 (five hundred gross tonnages) in Near Coastal Voyages after having an approved seagoing services of 12 (twelve) months as Chief Mate on ships of less than GT 3000 (three thousand gross tonnages} in Near Coastal Voyages, or on ships of GT 3000 (three thousand gross tonnages) in Restricted Voyage: b. Chief Mate on ships of less than GT 3000 (three thousand gross tonnages} in Near Coastal Voyages after having an approved seagoing service of 12 months in the capacity of Watchkeeping Officer on 38 ships of less than GT 3000 (three thousand gross tonnages) in Near Coastal Voyages; and Chief Mate on ships of GT 3000 (three thousand gross tonnages) or more in restricted voyages after serving for not less than 12 (twelve) months as Watchkeeping Officer on ships of GT 3000 (three thousand gross tonnages) or more in restricted voyages. Part Five Certificate of Deck Officer Class V Article 26 Certificate of Competency Deck Officer Class V shall be issued and entitled for every candidate who meets following minimum requirements: a. Be not less than 18 years of age. Graduated and hold a valid certificate of Junior High or its equivalent. Be a holder of Certificate of Able Seafarer Deck. Have an approved seagoing service of not less than 24 (twenty four} months serving in the capacity of Able Seafarer Deck on ships of GT 500 (five hundred gross tonnages) or more, or of not less than 12 (twelve) months as a Cadet. Have completed an approved training for Deck Officer Class V and meet the minimum standard of competence stipulated by the Director General or have completed 39 @) a) a Nautical major in Maritime Vocational High School and have passed Seafarer Competency Assessment for Deck Officer Class V; and Have completed relevant trainings and meet the standard of competence for basic safety training, survival craft and rescue boat other than fast rescue boat, advanced fire fighting, medical first aid on board, and security awareness. Certificate of Able Seafarer Deck is not required for candidate who have completed Nautical major in Maritime Vocational High School. The authority for position on board is referred to in Certificate of Endorsement as: a. Watchkeeping Officer on ships of less than GT S00 (ive hundred gross tonnages) in Local Voyages; and b. Watchkeeping Officer on ships of less than GT 3000 (three thousand gross tonnages) in Local Voyages after having an approved seagoing service for not less than 12 months as Watchkeeping Officer on ships of less than GT 500 (five hundred gross tonnages) in Local Voyages. Article 27 Certificate of Competency Deck Officer Class V Management shall be issued and entitled for every candidate sho meets following minimum requirements: a. Be a holder of Certificate of Deck Officer Class V; 40 @) Have completed training of Deck Officer Class Vv Management, meet the standard minimum of competence as stipulated by the Director General, and have passed the Seafarer Competency Assessment for Deck Officer Class V Management; Have completed special training for GMDSS radio operator as specified in Chapter IV STCW Code and its amendment; and Have approved seagoing service, after obtaining Certificate Deck Officer Class V, of not less than 12 (twelve) months. The authority for position on board is referred to in Certificate of Endorsement as: a Master on ships of less than GI 500 {five hundred gross tonnages) in Local Voyages after having an approved seagoing services of 12 (twelve) months as Chief Mate on: ships of less than GT 500 (five hundred gross tonnages) in Local Voyages or ships of less than GP 3000 (Three thousand gross tonnages) in restricted voyages. Chief Mate on ships of less than GT 500 (five hundred gross tonnages) in Local Voyages after having an approved seagoing service of not less than 12 {twelve} months in the capacity of Watchkeeping Officer on ships of less than GT 3000 (three thousand gross tonnages) in Local Voyages. 41 Part Six Exceptions Article 28 (1) Director General may give exemption of minimum requirement of competency certification for masters, chief mates, and watchkeeping officers on ships of less than GT 35 (thirty five gross tonnages}, bearing in mind the safety of all ships that may be operating in the same waters and the prevention of marine pollution. (2) Exemptions of minimum requirement of — competency certification as referred to in paragraph (1) shall come in the form of curriculum and syllabus that may not adhere to STCW Code. Article 29 Director General shall stipulate on Requirements and procedures of assessment to obtain Seafarer Certificate of Competency to meet the requirements of STCW Code and its amendment Part Seven Certification of Ratings Forming Part of a Navigational Watch Article 30 (1) Every rating forming part of a navigational watch on a ship of GT 500 (five hundred gross tonnages) or more shall be duly certificated to perform such duties. (2) Certification is not required for rating under training or cadet for watchkeeping duties. (3) Every candidate for the helmsman certification shall meet 42. (a a (2) the following minimum requirements: a. Be not less than 16 years of age; b. Have completed specific training ashore which involves not less than 2 (two) months of practical experience of performing navigational watch, which is documented in rating logbook to meet the minimum standard of competence required by Section A-II/4 STCW Code, or the candidate who is a registered holder of Certificate of Deck Watchkeeping and who has approved seagoing service of more than 3 (three) months. The practical experience of navigational watchkeeping functions shall involve the performance of duties carried out under the direct supervision of the master and the watchkeeping officer, and must be documented in the rating logbook which shall document the notes of watchkeeping officer and be signed by the Master. Part Eight Certification of Able Seafarer Deck Article 31 Every rating serving as Able Seafarer Deck on a ship of GT 500 (five hundred gross tonnages} or more shall be duly certificated. Certification for Able Seafarer Deck shall be issued for the candidate who has met the following minimum requirements: 43, 3) a a. Be not less than 18 years of age. b. Be a holder of Certificate of rating for navigational and helms watch (quarter master) or a holder of Certificate of Deck Watchkeeping with an approved seagoing service on deck department of not less than 12 (twelve) months; and c. Have completed specific training for Able Seafarer Deck and meet the minimum standard of competence required by Section A-II/5 of STCW Code. Director General shall further regulate on certification and competency standard of Able Seafarer Deck in Regulation of Director General. CHAPTER IV COMPETENCE OF ENGINE PERSONNEL Part One Certificate of Engine Officer Class I Article 32 Certificate of Competency Engine Officer Class I shall be issued and entitled for every candidate who meets following minimum requirements: a. Be a holder of Certificate of Competency Engine Officer Class II; b. Have approved seagoing service of not less than 36 (thirty six) months, after being entitled for Certificate of Engine Officer Class II, as an engineer in charge of engineering watch in an manned or periodically unmanned engine room on a ship
