AN ACT PROHIBITING THE IMPOSITION OF DEATH

Be it enacted by fke Senate and House of Representatives of the


Philippines in Congress assembled:

SECTION.^. The imposition of the penalty of death is


hereby prohibited. Accordingly;ly, fiepublic Act NO. Eight

the Death Penalty Law, aQd all other laws, executive orders
and decrees, insofar as they impose the death penalty are
hereby repealed or amended accordingly.

SEC. 2. In lieu of the death p e d t y , the foIlowbg shall


be imposed

(a) the penalty of reclusioa perpetua, when the law


violated makes w e of the nomenclature of the penalties of the
Revised Penal Code; or

(b) the penalty of We imprisonment, when the law


violated does mt make of the nomenclature of the penalties
of the Revised Penal Code,

SEC. 3. Persons convicted of offenses punished with


reclusion perpetua, or whose sentences will be reduced to
recI&n perpetua, by reason of this Act, shsll not be eligible
for parole under Act No. 4103, otherwise known &e the
Indeterminate Sentence Law, as amended.

SEC. 4. The Board of Pardons and Parole shall cause


the pubbtion at lea&, once. a week for three consecutive weeks
in a newspaper of general citculation of the names pf persons
convicted of offenses punished with reduaon perpetua or life
imprisonment by reason of%& slot who a e being considered
or recammended for commutation or pardon: B o d & howew,
Thiat n&g herein shall limit the power of the President to
grant executive clemency under Section 19, Article VI1 of the
Constituhon.

SEC. 6. This Act shall take effect immediately after its


publication in $wo national newepapers of general circulation.
