The incident happened when the victim, Agnes Guirindola (Agnes) was flagged down by a man

wearing a PNP reflectorized vest, who was later found one of the accused, Venancio Roxas
(Roxas). Agnes let Roxas enter his car for the latter to point out the sign which Agnes allegedly
violated. Upon reaching a certain place, Roxas stopped the engine of the car and pointed a gun
on Agnes. After a while, Roberto Gungon (Gungon), one of the accused, boarded the car and was
the one preventing Agnes from escaping.

The accused forced Agnes to drink a tablet which made her fell asleep, that when she
woke up; she noticed that her jewelries and other valuables are already missing. Agnes asked the
accused to relieve herself, which the latter consented. When Agnes was about to return to the car,
Roxas shoot her which led her to lost consciousness.

When Agnes regained her consciousness, she went to a nearby house to ask for help but
the people in that house were afraid of her. After a while, Agnes heard a vehicle arrived and was
later brought to a hospital for medication.

The trial court convicted Roxas for Kidnapping and serious illegal detention with
frustrated murder and sentences him to suffer the maximum penalty of Death. Roxas, thus,
appealed to the higher courts.
