I, ROBERTO O. YANGCO, Filipino, of legal age and with residence

address at Aseanmart Cor. Carino and Legarda Sts., Baguio City,
Philippines, after being duly sworn, hereby depose and state that:

1. I am the Petitioner in the foregoing Petition;

2. I caused the preparation of and have read the foregoing Petition,

the contents of which and the facts stated therein are true and correct of my
own personal knowledge and/or based on genuine and authentic
documents or records pertinent to the instant case;

3. I certify that I have not commenced any other action or proceeding

involving the same issues in the Supreme Court, the Court of Appeals or the
different divisions thereof, or any other court, tribunal or quasi-judicial
agency or body; and that to the best of my knowledge, no such action is
pending before the Supreme Court, the Court of Appeals or the different
divisions thereof, or any other court, tribunal or quasi-judicial agency or
body;

4. Should it come to my knowledge that a similar action or proceeding

or the different divisions thereof, or any other court, tribunal or quasi-
judicial agency/body, I hereby undertake to notify the court or tribunal
taking cognizance of the above-captioned case of such fact within five (5)
days from knowledge thereof;

2, Rule 65 of the 1997 Rules of Civil Procedure of the Revised Rules of
