Redelivery “in like good order”

It is a comparatively common feature that the owners agree to payment of a certain lump sum amount in lieu of the time charterers redelivering the vessel without cleaning the
vessel’s holds. Unfortunately, it is equally common that the owners realise, albeit too late, that the amount they have agreed to is much too small to cover the costs of cleaning the
vessel’s holds after redelivery.

The amount of debris, cargo remains etc. to be removed may be extensive. Indeed it may even be prohibited for the crew to clean after the particular commodity, or it may have to
be removed from the port area immediately, etc. etc., and with the growing environmental awareness, owners may be compelled to discharge the cargo remains etc. into local port
reception facilities, if such facilities exist and are adequate. If not, the vessel may have to deviate for the purpose of getting rid of the cargo remains.

There can be many pitfalls wherefore the best solution remain to leave the duty to redeliver the vessel “in like good order” to the charterers.
