garage sale application and is non-refundable. Further, I/we have read and understand the requirements
for a sale of personal property on residentially occupied parcels of land and do hereby agree to comply with
the requirements as stated. I/we further understand that any violation of the aforementioned requirements will
be sufficient cause for revoking this permit and possible legal action.

APPLICATION FOR PERMIT TO CONDUCT A GARAGE SALE OF PERSONAL PROPERTY

Garage Sale: "Garage Sales" shall mean the sale of personal property in, at or upon any residentially occupied parcel of land. Garage Sales shall include,
but not be limited to, any yard sale, home sale, patio sale or any other similarly conducted sale.

In order to acquire and maintain a permit to conduct a garage sale, patio sale, or other similarly conducted sale, the following shall be met:

A. Garage Sales Prohibited. It shall be unlawful for any person to sell or participate in the sale of personal property to the general public by means of a
"garage" sale, "patio" sale or other similarly conducted sale, except as permitted in this ordinance.

B. Application and Permit. Any person or persons or sponsoring organization intending to conduct a "garage" sale, "patio" sale or similar sale of personal
property to the general public shall, concurrently with payment of a five dollar ($5.24) fee, file an application with the Development Department Planning
Division for a permit not less than three (3), nor more than fifteen (15) days prior to the date of such sale. The applicant shall state the date, place and
hours of the proposed sale and the name of the person who will be conducting such sale. The permit shall be issued by the Development Department
Planning Division for a period not to exceed three (3) days upon payment of the fee, provided that the permit may be revoked by the Development
Department Planning Division after notice and an opportunity to be heard is offered the applicant in the event any false information or representation is
contained in the application or there is a violation of any provision of this ordinance.

C. Number and Time of Sales. Not more than four non-consecutive garage sales may be conducted by any person nor upon a lot or parcel of land,
excluding any lot or parcel of land occupied by an apartment complex, per calendar year and shall be limited to not more than three (3) consecutive
days. Said sale may only be conducted between the hours of 8:00 a.m. and 8:00 p.m. of the given day.

D. Display. Personal property offered for sale shall not be displayed or stored in adjoining public streets or rights-of-way. All articles shall be removed from
the front or side yard before the close of the last day on which the garage sale may be lawfully conducted.

E. Signs. No signs advertising garage sales may be posted, erected or maintained on other than the premises on which such sale is to be held. Not more
than three unlighted signs advertising a garage sale may be posted, erected or maintained on the premises on which such sale is to be held; and no
sign may be place or maintained on the public right-of-way. No sign shall exceed four square feet in area and shall not be maintained for a period of
more than five days immediately preceding the lawful commencement of such garage sale. Each sign shall be removed at or before the close of the
last day on which the garage sale may lawfully be conducted.

F. Exemptions. The provision of this ordinance shall not apply to any sales conducted pursuant to process or order of any court of competent jurisdiction.
