AFFIDAVIT-COMPLAINT

I,xxx, of legal age, Filipino, married to the respondent, and a

resident of xxx after having been duly sworn in accordance with law,
hereby depose and state:

1. That I am and the same person who is the complainant in the

instant case;

2. That I know the person of xxx, the respondent in this case,

being my husband, xxx, where he may be served with
summons;

3. That on October to November 2008, respondent studied at

xxx where she and respondent met;

4. That on August 21, 2009, we became boyfriend and

girlfriend;

5. That on June 29, 2010, I broke up with the respondent

because he had an affair with another woman due to our long
distance relationship;

6. That on January 2, 2011, respondent called to fix things up

with me regarding our relationship. I accepted him once
more;

7. That we got married on xxx at xxx. A copy of the marriage

certificate is hereto attached as Annexed A;

8. That from then on, respondent would return home late and
drunk, and whenever I asked him about his whereabouts, he
would compare me to his past lovers;

9. That it came to a point that I actually developed a phobia

towards them;

10. That I would not take a meal especially if my husband was

not around. That I would not also take a bath when my
husband is not around, since they are accusing me of wasting
the water for my beautification;

11. That I became pregnant and gave birth on xxx, to my

daughter, xxx, with the respondent. The copy of the birth
certificate is hereto attached as Annexed B;

12. That sometimes, respondent would tell me that he

regretted marrying me;

13. That on one instance, I held a knife against respondent for

protection, since he was mauling me and choking me;
 14. That on around July 2016, he returned home late and
drunk. When confronted, he mauled me and choked and
even attempted to hurt our daughter but I managed to carry
my daughter away from him to the house of one of our
neighbours;

15. That his act of physically hurting me tantamounts to

physical abuse which is defined under R.A 9262 or Violence
Against Women and their Children as:

SECTION 5. Acts of Violence Against Women and Their Children.- The

crime of violence against women and their children is committed through
any of the following acts:
(a) Causing physical harm to the woman or her child;
(b) Threatening to cause the woman or her child physical harm;
(c) Attempting to cause the woman or her child physical harm;
(d) Placing the woman or her child in fear of imminent physical harm;
