Artculo 53.
1. Los derechos y libertades reconocidos en el Captulo segundo
del presente Ttulo vinculan a todos los poderes pblicos. Slo por
ley, que en todo caso deber respetar su contenido esencial, podr
regularse el ejercicio de tales derechos y libertades, que se
tutelarn de acuerdo con lo previsto en el artculo 161.1 a).
2. Cualquier ciudadano podr recabar la tutela de las libertades y
derechos reconocidos en el artculo 14 y la Seccin primera del
Captulo 2 ante los Tribunales ordinarios por un procedimiento
basado en los principios de preferencia y sumariedad y, en su caso,
a travs del recurso de amparo ante el Tribunal Constitucional.
Este ltimo recurso ser aplicable a la objecin de conciencia
reconocida en el artculo 30.
3. El reconocimiento, el respeto y la proteccin de los principios
reconocidos en el Captulo 3 informar la legislacin positiva, la
prctica judicial y la actuacin de los poderes pblicos. Slo
podrn ser alegados ante la Jurisdiccin ordinaria de acuerdo con
lo que dispongan las leyes que los desarrollen.

Los derechos reconocidos en esta Ley ejercitados dentro
de los lmites que la misma seala sern tutelados mediante
amparo judicial ante los Tribunales ordinarios y amparo
constitucional ante el Tribunal Constitucional en los
trminos establecidos en suLey Orgnica.

II. Contenido
Universal Declaration of Human Rights, 1948
Art. 18
Everyone has the right to freedom of thought,
conscience and religion; this right includes
freedom to change his religion or belief, and
freedom, either alone or in community with
others and in public or private, to manifest his
religion or belief in teaching, practice, worship
and observance.

Art. 9
Freedom of thought, conscience and religion
1. Everyone has the right to freedom of thought,
conscience and religion; this right includes freedom to
change his religion or belief and freedom, either alone or
in community with others and in public or private, to
manifest his religion or belief, in worship, teaching, practice
and observance.
2. Freedom to manifest ones religion or beliefs shall be
subject only to such limitations as are prescribed by law
and are necessary in a democratic society in the interests
of public safety, for the protection of public order, health
or morals, or for the protection of the rights and
freedoms of others.

Art. 18
1. Everyone shall have the right to freedom of thought, conscience
and religion. This right shall include freedom to have or to adopt a
religion or belief of his choice, and freedom, either individually or in
community with others and in public or private, to manifest his
religion or belief in worship, observance, practice and teaching.
2. No one shall be subject to coercion which would impair his
freedom to have or to adopt a religion or belief of his choice.
3. Freedom to manifest one's religion or beliefs may be subject only
to such limitations as are prescribed by law and are necessary to
protect public safety, order, health, or morals or the fundamental
rights and freedoms of others.
4. The States Parties to the present Covenant undertake to have
respect for the liberty of parents and, when applicable, legal
guardians to ensure the religious and moral education of their
children in conformity with their own convictions.
Declaration on the Elimination of All Forms of Intolerance and of
Discrimination Based on Religion or Belief Proclaimed by General
Assembly resolution 36/55 of 25 November 1981
Article 6
In accordance with article 1 of the present Declaration, and subject
to the provisions of article 1, paragraph 3, the right to freedom of
thought, conscience, religion or belief shall include, inter alia , the
following freedoms:
( a )To worship or assemble in connection with a religion or belief,
and to establish and maintain places for these purposes;
( b )To establish and maintain appropriate charitable or humanitarian
institutions;
( c )To make, acquire and use to an adequate extent the necessary
articles and materials related to the rites or customs of a religion or
belief;
( d ) To write, issue and disseminate relevant publications in these
areas;
( d )To write, issue and disseminate relevant publications in these
areas;
( e ) To teach a religion or belief in places suitable for these
purposes;
( f ) To solicit and receive voluntary financial and other
contributions from individuals and institutions;
( g )To train, appoint, elect or designate by succession appropriate
leaders called for by the requirements and standards of any
religion or belief;
( h ) To observe days of rest and to celebrate holidays and
ceremonies in accordance with the precepts of one's religion or
belief;
( i ) To establish and maintain communications with individuals
and communities in matters of religion and belief at the national
and international levels.

Artculo 2.
1. La libertad religiosa y de culto
g a r a n t i z a d a p o r l a C o n s t i t u c i n
c o m p re n d e , c o n l a c o n s i g u i e n t e
inmunidad de coaccin, el derecho de
toda persona a:
a) Profesar las creencias religiosas que
libremente elija o no profesar ninguna; cambiar
de confesin o abandonar la que tena,
manifestar libremente sus propias creencias
religiosas o la ausencia de las mismas, o
abstenerse de declarar sobre ellas.
b) Practicar los actos de culto y recibir
asistencia religiosa de su propia confesin;
conmemorar sus festividades; celebrar sus
ritos matrimoniales; recibir sepultura digna,
sin discriminacin por motivos religiosos, y
no ser obligado a practicar actos de culto o
a recibir asistencia religiosa contraria a sus
convicciones personales.
c) Recibir e impartir enseanza e
informacin religiosa de toda ndole, ya
sea oralmente, por escrito o por cualquier
otro procedimiento; elegir para s, y para
los menores no emancipados e
incapacitados, bajo su dependencia, dentro
y fuera del mbito escolar, la educacin
religiosa y moral que est de acuerdo con
sus propias convicciones
d) Reunirse o manifestarse pblicamente
con fines religiosos y asociarse para
desarrollar comunitariamente sus
actividades religiosas de conformidad
con el ordenamiento jurdico general y
lo establecido en la presente Ley
Orgnica.
III. Lmites
LOLR 1980
Artculo 3.
1. El ejercicio de los derechos dimanantes de la
libertad religiosa y de culto tiene como nico
lmite la proteccin del derecho de los dems al
ejercicio de sus libertades pblicas y derechos
fundamentales, as como la salvaguardia de la
seguridad, de la salud y de la moralidad pblica,
elementos constitutivos del orden pblico
protegido por la Ley en el mbito de una
sociedad democrtica.

Art. 22
Son circunstancias agravantes,
(...)
4 Cometer el delito por motivos racistas,
antisemitas u otra clase de discriminacin referente a
la ideologa, o creencias de la vctima, la etnia, raza o
nacin a la que pertenezca, su sexo, orientacin o
identidad sexual, la enfermedad que padezca o su
discapacidad.
Artculo 170. [Amenazas]
1. Si las amenazas de un mal que constituyere
delito fuesen dirigidas a atemorizar a los
habitantes de una poblacin, grupo tnico,
cultural o religioso, o colectivo social o
profesional, o a cualquier otro grupo de
personas, y tuvieran la gravedad necesaria para
conseguirlo, se impondrn respectivamente las
penas superiores en grado a las previstas en el
artculo anterior.
Art. 197 [Del descubrimiento y revelacin de secretos]
1. El que, para descubrir los secretos o vulnerar la intimidad de
otro, sin su consentimiento, se apodere de sus papeles, cartas,
mensajes de correo electrnico o cualesquiera otros documentos
o efectos personales o intercepte sus telecomunicaciones o utilice
artificios tcnicos de escucha, transmisin, grabacin o
reproduccin del sonido o de la imagen, o de cualquier otra seal
de comunicacin, ser castigado con las penas de prisin de uno a
cuatro aos y multa de doce a veinticuatro meses.

6. Igualmente, cuando los hechos descritos en los apartados
anteriores afecten a datos de carcter personal que revelen la
ideologa, religin, creencias, salud, origen racial o vida sexual, o la
vctima fuere un menor de edad o un incapaz, se impondrn las
penas previstas en su mitad superior.
Art. 314 [Discriminacin laboral]
Los que produzcan una grave discriminacin en el empleo, pblico o
privado, contra alguna persona por razn de su ideologa, o
creencias, su pertenencia a una etnia, raza o nacin, su sexo,
orientacin sexual, situacin familiar, enfermedad o minusvala, por
ostentar la representacin legal o sindical de los trabajadores, por
el parentesco con otros trabajadores de la empresa o por el uso de
alguna de las lenguas oficiales dentro del Estado espaol, y no
restablezcan la situacin de igualdad ante la Ley tras requerimiento
o sancin administrativa, reparando los daos econmicos que se
hayan derivado, sern castigados con la pena de prisin de seis
meses a dos aos o multa de 12 a 24 meses.
Artculo 510 [Odio]
1. Sern castigados con una pena de prisin de uno a cuatro
aos y multa de seis a doce meses:
a) Quienes pblicamente fomenten, promuevan o inciten
directa o indirectamente al odio, hostilidad, discriminacin o
violencia contra un grupo, una parte del mismo o contra una
persona determinada por razn de su pertenencia a aqul,
por motivos racistas, antisemitas u otros referentes a la
ideologa, religin o creencias, situacin familiar, la
pertenencia de sus miembros a una etnia, raza o nacin, su
origen nacional, su sexo, orientacin o identidad sexual, por
razones de gnero, enfermedad o discapacidad.

Artculo 511. [Denegacin de prestacin de un servicio pblico]
1. Incurrir en la pena de prisin de seis meses a dos aos y multa
de doce a veinticuatro meses e inhabilitacin especial para empleo
o cargo pblico por tiempo de uno a tres aos el particular
encargado de un servicio pblico que deniegue a una persona una
prestacin a la que tenga derecho por razn de su ideologa,
religin o creencias, su pertenencia a una etnia o raza, su origen
nacional, su sexo, orientacin sexual, situacin familiar, enfermedad
o minusvala.
2. Las mismas penas sern aplicables cuando los hechos se cometan
contra una asociacin, fundacin, sociedad o corporacin o contra
sus miembros por razn de su ideologa, religin o creencias, la
pertenencia de sus miembros o de alguno de ellos a una etnia o
raza, su origen nacional, su sexo, orientacin sexual, situacin
familiar, enfermedad o minusvala.
3. Los funcionarios pblicos que cometan alguno de los hechos
previstos en este artculo, incurrirn en las mismas penas en su
mitad superior y en la de inhabilitacin especial para empleo o
cargo pblico por tiempo de dos a cuatro aos.
Artculo 512. [Denegacin de prestacin profesional
o empresarial]
Los que en el ejercicio de sus actividades
profesionales o empresariales denegaren a una
persona una prestacin a la que tenga derecho por
razn de su ideologa, religin o creencias, su
pertenencia a una etnia, raza o nacin, su sexo,
orientacin sexual, situacin familiar, enfermedad o
minusvala, incurrirn en la pena de inhabilitacin
especial para el ejercicio de profesin, oficio,
industria o comercio, por un perodo de uno a
cuatro aos.
Artculo 515. [Asociaciones ilcitas]
Son punibles las asociaciones ilcitas, teniendo tal
consideracin:

5 Las que promuevan la discriminacin, el odio o la
violencia contra personas, grupos o asociaciones por
razn de su ideologa, o creencias, la pertenencia de
sus miembros o de alguno de ellos a una etnia, raza o
nacin, su sexo, orientacin sexual, situacin familiar,
enfermedad o minusvala, o inciten a ello.
Artculo 522. [Impedir o forzar la prctica de actos
religiosos]
Incurrirn en la pena de multa de cuatro a diez
meses:
1 Los que por medio de violencia, intimidacin,
fuerza o cualquier otro apremio ilegtimo impidan a
un miembro o miembros de una confesin religiosa
practicar los actos propios de las creencias que
profesen, o asistir a los mismos.
2 Los que por iguales medios fuercen a otro u
otros a practicar o concurrir a actos de culto o
ritos, o a realizar actos reveladores de profesar o
no profesar una religin, o a mudar la que profesen.
Artculo 523. [Impedir o perturbar actos de
confesiones religiosas]
El que con violencia, amenaza, tumulto o vas de
hecho, impidiere, interrumpiere o perturbare los
actos, funciones, ceremonias o manifestaciones de
las confesiones religiosas inscritas en el
correspondiente registro pblico del Ministerio de
Justicia e Interior, ser castigado con la pena de
prisin de seis meses a seis aos, si el hecho se ha
cometido en lugar destinado al culto, y con la de
multa de cuatro a diez meses si se realiza en
cualquier otro lugar.
Artculo 524. [Actos de profanacin en lugar
destinado al culto]
El que en templo, lugar destinado al culto o en
ceremonias religiosas ejecutare actos de
profanacin en ofensa de los sentimientos
religiosos legalmente tutelados ser castigado
con la pena de prisin de seis meses a un ao o
multa de 12 a 24 meses.
Artculo 525. [Escarnio]
1. Incurrirn en la pena de multa de ocho a doce
meses los que, para ofender los sentimientos de
los miembros de una confesin religiosa, hagan
pblicamente, de palabra, por escrito o mediante
cualquier tipo de documento, escarnio de sus
dogmas, creencias, ritos o ceremonias, o vejen,
tambin pblicamente, a quienes los profesan o
practican.
2. En las mismas penas incurrirn los que hagan
pblicamente escarnio, de palabra o por escrito,
de quienes no profesan religin o creencia
alguna.
Artculo 526. [Violacin de sepulturas, profanacin
de cadveres]
El que, faltando al respeto debido a la memoria de
los muertos, violare los sepulcros o sepulturas,
profanare un cadver o sus cenizas o, con nimo de
ultraje, destruyere, alterare o daare las urnas
funerarias, panteones, lpidas o nichos ser
castigado con la pena de prisin de tres a cinco
meses o multa de seis a 10 meses.
Artculo 607 [Genocidio]
1. Los que, con propsito de destruir total o
parcialmente un grupo nacional, tnico, racial,
religioso o determinado por la discapacidad de
sus integrantes, perpetraren alguno de los
actos siguientes, sern castigados:

Artculo 607 bis. [Lesa humanidad]
1. Son reos de delitos de lesa humanidad quienes
cometan los hechos previstos en el apartado siguiente
como parte de un ataque generalizado o sistemtico
contra la poblacin civil o contra una parte de ella.
En todo caso, se considerar delito de lesa humanidad
la comisin de tales hechos:
1. Por razn de pertenencia de la vctima a un grupo
o colectivo perseguido por motivos polticos, raciales,
nacionales, tnicos, culturales, religiosos, de gnero,
discapacidad u otros motivos universalmente
reconocidos como inaceptables con arreglo al
derecho internacional.

V. Proteccin internacional:
Tribunal Europeo
de Derechos Humanos
El 4 de octubre de 1979, Espaa ratific el
Convenio Europeo de Proteccin de los
Derechos y libertades fundamentales, cuyo art. 9
reconoce la libertad religiosa y de creencias.
Article 34
Individual applications
The Court may receive applications from any person, non
governmental organisation or group of individuals claiming to
be the victim of a violation by one of the High Contracting
Parties of the rights set forth in the Convention or the
Protocols thereto. The High Contracting Parties undertake
not to hinder in any way the effective exercise of this right.
Article 35
Admissibility criteria
1. The Court may only deal with the matter after all domestic
remedies have been exhausted, according to the generally
recognised rules of international law, and within a period of
six months from the date on which the final decision was
taken.
2. The Court shall not deal with any application submitted
under Article 34 that
(a) is anonymous; or
(b) is substantially the same as a matter that has already been
examined by the Court or has already been submitted to
another procedure of international investigation or settlement
and contains no relevant new information.

Admissibility criteria
(...)
3. The Court shall declare inadmissible any individual
application submitted under Article 34 if it considers that:
(a) the application is incompatible with the provisions of the
Convention or the Protocols thereto, manifestly ill-founded,
or an abuse of the right of individual application; or
(b) the applicant has not suffered a significant disadvantage,
unless respect for human rights as defined in the
Convention and the Protocols thereto requires an
examination of the application on the merits and provided
that no case may be rejected on this ground which has not
been duly considered by a domestic tribunal.
4. The Court shall reject any application which it considers
inadmissible under this Article. It may do so at any stage of
the proceedings.
