MOOT PROBLEM

Razia(Sunni Muslim) is a cousin sister of Sultana met with Akram (Sunni Muslim & Cousin
brother of Sultana) in a party where they fall in love at first sight and decided to marry with each
other. On dated July 2, 2016 they got married in Delhi by following the valid procedure of Nikah
as per Akrams religious practice.

After marriage the couple relocated to Navi Mumbai and started living in an apartment in Akash
Palace owned by Zakir (Akrams brother), a permanent citizen of USA,. Akram was bearing all
the maintenance charges of the flat. After some time they got a flat in lottery in Vistar Vihar
Extension Phase 3 and they started living in that flat with Sultana. One day Akram met with his
college friend Zamal and they planned to start a partnership firm for well earning and they set up
a registered partnership enterprise Akram & Zamal Associates.

After relocation in new flat, Razia wanted to have a child and stay at home while Akram thought
it was too early to have child and this was converted into many heated arguments. Sultana was
unsuccessful in intervening between them. On July 10, 2017, Akram and Razia had a heated
argument over the same issue. During the argument Akram divorced Razia with three
pronouncements of talaq. Sultana was a witness to this and continues to live in the said
apartment. Akram moved out of the house and started living at a rented guest house from his
partnership firm.

Razia approached civil court to get a declaration that the divorce is a nullity which was defended
by Akram. Civil court refused declaring the nullity of divorce as triple talaq was final
dissolution of marriage as per the Muslim law.

Razia filed a appeal/writ petition challenging the order of the Civil Judge, District Court of Navi
Mumbai and the constitutional validity of triple divorce. Now the matter has been posted for
final disposal.
