formado por aquellas unidades léxicas que aparecen con mucha frecuencia en las
ciplinas técnicas. Constituye el lenguaje basico de las lenguas de especialidad,
medio de distribuci6n y divulgacién de la terminologfa juridica. El denominado léxi
juridico especializado esta formado por aquellos términos especiales propios de una
disciplina especifica y familiares tinicamente para el pequefio grupo de expertos en ese
campo. Son las palabras clave en textos altamente especializados. Algunas son pala-
bras acufiadas por los juristas en el curso de su trabajo.
Desde el punto de vista de a traduccién, nos interesa una clasificaci6n que te
en cuenta el contraste entre ordenamientos jurfdicos asimétricos. Siguiendo a Hickey
(1996) podemos establecer esta clasificacién:
1. Términos que sélo pertenecen al lenguaje juridico, y por tanto su significado séla
aparece en obras terminolégicas especializadas. (Articles of Incorporation)
2. Palabras con significados especializados, utilizadas también en la lengua comtn.
Se trata de una categoria peligrosa para los estudiantes, que pueden creer que
entienden su significado sélo porque las reconocen a partir de su experiencia com
la lengua comtin. (Construe, Action)
3. Falsos amigos (0 falsos cognatos) que, por la similitud entre las rafces de las voces
en lengua origen y lengua término dificultan la comprensién del significado del
texto, ya que presentan diferencias semdnticas notables. (Directors, Provisions)
4. Términos que no tienen equivalentes en el ordenamiento juridico del texto meta.

El lenguaje jurfdico inglés presenta unos aspectos textuales muy particulares y que
podemos concretar en el empleo de locuciones preposicionales complejas y conectores
especiales, la subordinacién miltiple y el empleo de frases mas largas de lo habitual, la
escasez y especificidad de la anéfora, la abundante repeticién Iéxica, escasa sustitucién.

Es frecuente la aparicidn de locuciones preposicionales complejas con Ja siguiente
estructura P+N+P (preposicién + nombre + preposicién). El uso de estas cléusulas
preposicionales, poco habituales en otros contextos (by virtue of en lugar de by), se
justifica a criterio de los juristas en Ja idea de que las preposiciones simples conllevan un
cierto grado de ambigiiedad y se prestan a distintas interpretaciones. Ejemplos tipicos en

SUBORDINACION MULTI (EMBEDDED CLAUSES
En los textos legales las frases suelen ser largas y complejas y, por tanto, los conecto-
res de frase (y, pero) son mucho menos abundantes que en los textos de cardcter general,
mientras que se observa una mayor frecuencia de conectores de clausulas (si, aunque...).
También es caracteristico del lenguaje juridico la existencia de frases con subordinadas
mitiltiples que en cualquier otro contexto aparecerfan como frases separadas. Esta abundan-
cia de subordinacién da como resultado frases extremadamente largas que pueden llegar a
ocupar paginas enteras.
Interesa sefialar que esta afirmacién no es valida para ciertos textos legales como por
ejemplo los contratos en los que predominan las frases cortas. La razén mis clara de esta
extensién y complejidad de las frases es la necesidad de precisar al maximo el significado
mediante la incorporacién de multiples elementos de calificacién. Pero lo caracteristico del
Jenguaje legal no es s6lo la abundancia de cléusulas modificadoras sino la forma en que se
‘mserian en la estructura sintactica.
Si necesitamos introducir muchas calificaciones en una misma frase, intentaremos
emcontrar el mayor nimero posible de puntos de insercidn. Pero esto siempre resulta
‘Micil ya que si por un lado la abundancia de modificacidn hace la frase mds precisa, por
wo también la puede hacer mAs ambigua, si no se colocan en el lugar adecuado.
