Mr. Bryant searched &@QggaB football locker with negative results, Mr. Bryant and I met up with llpas he was exiting the Media Center to goto lunch. We escorted him into an office and Mr. Bryant asked amp if he had anything in his bag that he shouldn't and he advised that he did not. Mr. Bryant began to search the bag and discovered a small black handgun, Diamondback 380, serial number ZA2506. It ‘contained one magazine but there wasn't any ammunition in the magazine cor in the chamber. Mr. Bryant did not discover any ammunition in the bageeither. I then searched his person with negative results (aiagp verbally advised that he did not know that the gun was in his bag. He claimed to have left the bag at school over the weekend. He also stated that he removed his black and white sneakers from the bag and took only the sneakers home. This morning when he returned to school he placed the sneakers inside the same pocket where the handgun was found. He has been in possession of that bag up until the time we ‘met with him. However, he spontaneous uttered that he brought BB ‘gun to school recently. Mr. Bryant checked the video surveillance and observed exiting vehicle prior to school starting. He is observed wearing a black backpack just like the one we found him in possession of. He claimed that it belongs to a friend who left it at his house over the weekend and he was returning it to him, Mr. Bryant spoke to the friend (GMB. who stated that he never left his bag a house. @ipag then changed his story to say that he did in fact take his bag, home over the weekend. He placed his clothes and sneakers in the bag and went to his mother’s boyfriends, parents’ house with his school bag. He retuned home on Sunday with the clothes and sneakers still inside the bag. He claimed he never observed a hand gun in his bag. After speaking with the staff member who wishes to remain anonymous, that person provided me with three students who witnessed Qa with the handgun at school, however only one student was willing to provide ‘statement. The other two students were in fear of retaliation. Pera (School Resource Officer at Seabreeze High School) advised via radio that a black male juvenile was at the ‘MeDonal’s (3001 N Atlantic Av] witha firearm. It was Iter learned that Officer T. Pera was contacted by I W/-2) anc (W-2) who advised of the following. W-1 and W-2 were at McDonald's when W-2 heard a firearm being cocked", W-2 stated that she went over to NINN (\W-4) and asked him what was going on. W-2 stated that W-4 said to her that the Defendant wanted to play with a gun. W-1 advised that she was behind the Planet Fitness when she had seen W-4 and the Defendant along with another subject. W-1 stated that she noticed the Defendant pulling out a red fishing type hat and that there was some sort of object inside the hat. W-1 stated that she was then advised by one of her friends (unknown) that the object Jn the hat was a gun. W- stated that the subject with the fishing style hat (later identified asthe Defendant) was infact the subject who brought the firearm to the McDonald's. W-1 and W-2 then walked to the Seabreeze High School and reported the incident to School Resource Officer T. Pera. W-1 and W-2 gave the description of the defendant along with the description of the subjects that the defendant was hanging out with to Officer T. Pera, Officer T. Pera then advised via police radio of the incident providing {descriptions of the Defendant and the other subjects involved. Officer T. Pera provided the description of the subjects as being 3 dark skinned black males, with dark sweat pants, and that the subject with the firearm was wearing a red type hat. A group of subjects matching the description were located just north of the McDonald's walking northbound on the sidewalk in front of 902. ‘atlantic Av, Ormond Beach, FL. It should be noted that this location is well within 1000 feet of Seabreeze High School (2700 N Oleander Av, Daytona Beach). Officer M. Catalano, Officer M. Talluto and myself contacted the group of individuals (one of which, later identified as the defendant, was observed wearing a red fishing style hat) and were told to sit on the sidewalk. Officer M. Catalano observed the defendant carrying a black satchel/bag drepped over his shoulder. The black bag appeared to have minimal items inside (no books, etc) however did have what looked lke a heavy object inside weighing the bag down. Officer M. Catalano directed the defendant to place the bag on the ground, which the defendant complied with. Officer M. Catalano then picked the bag up and immediately recognized (by touching the outside of the bag} that the object inside the bag was in facta firearm. The defendant along with the other three individuals were then placed in handcuffs, The bag was searched in which a Taurus Sram (seria! number 11725533} firearm was located along with a magazine containing 9mm Hornady ammunition {the magazine was not inside the firearm). A small circular in shape metal tobacco grinder was also located inside the black bag with trace amounts of suspected cannabis. Sgt. Savitski contacted Se. . Mills with the Ormond Beach Police Department who requested that we handle the call and the arrest under mutual aid as the call originated inisde the Daytona Beach City limits. The suspected cannabis was tested via Sirchie test kit which yielded a presumptive reaction to the presence of cannabis. The subject was placed under arrest for carrying @ concealed firearm and possession of drug paraphernalia. After the firearm was located, Officer M. Catalano asked all 4 individuals f there were any ather firearms. Bolyard asked me to standby while he searched the vehicle, Bolyard took me with him to go pick up SGA in his room out in the portables.
