LAMPIRAN 3: BORANG JAMINAN BANK (TAPAK PENCAWANG) To: ‘Tenaga Nasional Berhad Jabatan Perkhidmatan Harta 129, Jalan Bangsar, 59200 Kuala Lumpur BANK GUARANTEL In consideration of Tenaga Nasional Berhad of 129, Jalan Bangsar, 59200 Kuala Lumpur (hereinafter referred to as ‘the Company’) agreed to provide electricity supply to hereinafter referred to as “the Consumer’) for the consumers. (hereinafter referred to as “the Bank’) hereby guarantees the payment to the Company by the consumer of such sums of money not exceeding the aggregate sum of MR 20,000.00 (Malaysian Ringgit Twenty Thousand Only) which may at any time or times be claimed by the Company against the Consumer for damages in the event the Consumer falling to transfer to the Company the substation site after the Company has incurred expenditure in providing and installing all the necessary materials in the substation building for the supply of such electricity. NOW THE BANK HEREBY AGREED AND DECLARED AS FOLLOW:- 1, This guarantee shall be valid for one (1) year from to and will be renewed by the Bank upon request by the Consumer from year to year until such time as a transfer for the substation site referred to above Is registered in the name of the Company. 2, This guarantee is a continuing within the limits aforesaid as to time and amount. 3. Notice in writing of any claims by the Company against the Consumer will be given by the ‘Company to the Bank and within seven (7) days from the date of receipt of such notice payment shall forthwith be made by the bank to the Company of all sums due under this guarantee. 4, With reference to the right and liabilty of the parties and stipulated time periods hereinstated this guarantee shall not be effected or prejudiced by the Company granting time or any other indulgence to the Consumer or by any change whatsoever in the constitution of the Consumer or by the Consumer's liquidation or winding up.5. _Notewithstanding any other provisions herein before contained, if on the expiry of sixty days. (60) after the date of the expiry ofthis guarantee, the bank has not received any claim from the Company, this guarantee shall lapse and cease to have any effect whatsoever and the bank shall be deemed to be discharged and released from all and any liability under this guarantee. 6 With effect from the date this guarantee is expressed to become effective it shall replace the former guarantee B/G No. dated Issued by the bank in the Company's favour for the same sum of MR 20,000.00 BUT such replacement shall not released the bank, in all and any manner, from its liability to pay the claims made by the Company PROVIDED such claims is forwarded by the Company to the bank within the guarantee period unti the expiration of the abovewritten sixty days (60) under Clause 5°, Dated the day of 19.
