‘This cause came on for hearing today, on Defendant Igor Malenko's Motion to
Lift PFA Restrictions on Visitation (“Motion”). Defendant was seeking to have the Court
discharge the supervision restriction entered in the PA Order dated 6/6/2008 by District
Court Judge MaryGay Kennedy (pursuant to the recommendation of the guardian ad
litem, Elizabeth Stout, Esq.). See Order, 1. After notice and an abbreviated hearing
(Plaintiff was not provided with sufficient time or opportunity to put on her case on this
date), at which the GAL testified, this Court hereby Orders the following
(1) Defendant Igor Malenko will immediately drop the minor daughter, Mila
Malenko (DOB: 11/29/2006), from his health insurance policy and will forward
the weekly savings (of approximately $35.00) to the Plaintiff uutil Le lias paid
21% of the remaining funds due to Dr. Kabacoff (this figure is believed to be
$3,900, so 21% would be approximately $819).
(2) Plaintiff Lori Handrahan shall immediately pay Dr. Kabacoff the remaining funds
due Dr. Kabacoff so that the psychologist may complete her psychological
evaluations and issue a report as soon as possible,
(9) Pending further hearing, Defendant's visits with Mila shall continue to be
supervised at Connection for Kids, Defendant shall be permitted up to 3 1/2
hours of visitation per week. Plaintiff shall make Mila available for such visits,
and shall pay the fee for the supervised visits(4) Any payments made to Dr. Kabacoff or to Connections for Kids are without
prejudice to each party’s right to request that a reallocation of responsibility for
such payments is just and appropriate in the
