Development of roads under LWE affected area, aimed at improving accessibility to remote tribal inhabitants is a challenging task. The LWE works are implemented by the Tespective State PWDs through civil Contractors. The works are executed in accordance to the terms of the Contract Agreement entered into for each of the work between State PWD and the Contractor. 2.___ Recovery of mobilization and equipment advance from the Contractor essentially effected in accordance to the provisions made in Clause 51.3 of SBD (Section 2: conditions of contract) and reads as: “The advance payment shall be repaid by deducting proportionate antounts from payments otherwise due to the Contractor, following the schedule of complete percentages of the Works on a payment basis... ..”. 3. _ The Schedule for completion of the work in the Intended Completion Date including Extension(s), if any primarily regulated in accordance to the provisions made in Clause 17.1 read with Clause 28.1 of SBD (Section 3: conditions of contract) and reads as: ‘CLI7.1 “The Contractor may commence execution of the Works on the Start Date sand shall carry out the Works in accordance with the programme submitted by the ‘Contractor, as updated with the approval of the Engineer, and complete tiem by the Intended Completion Date”. Cl 28.1: “The Enginzer shall extend the Intended Completion Date if a Compensation Event occurs or a Variation is issued which makes it impossible for ‘Completion to be achieved by the Intended Completion Date without the Contractor ‘aking steps to accelerate the remaining work and which would cause the Contractor to incur additional cost.” 4. Compensation Events which entails the Contractor for extension of Intended Completion Date are enumerated in Clause 44.1 read with Clause 44.2 of the of SBD (Section 3: Conditions of Contract) and reads as: C1 44.1: The following are Compensation Events unless they are caused by the Contractor: o 4 (©) The Employer modifies the schedule of other coniractors in & was! which affects ‘the work ofthe contractor under the contract. (6) The Engineer orders a delay or does not issue drawings, specifications or instructions required for execution of works on time (@ The Engineer instructs the Contractor to uncover o to carry out additional tests upon work which is then found to have no Defects. (©) The Engineer does not approve of a subcontract to be let, within 15 days: © Ground conditions are substantially more adverse than could reasonably have been assumed before issuance of Letter of Acceptance from the information issued 10 Bidders (including the Site Investigation Reports), from information available publicly and from a visual inspection of the site. (@) The Engineer gives an instruction for dealing with an unforeseen condition, caused by the Employer, o additional work required for safety or ofier reasons (b) Other contractors, public authorities, utilities or the Employer does not work within the dates and other constraints stated tn the Contract, and they cause delay ‘or exira cost the Contractor. @ The advance paynent is delayed, beyond 28 days after receipt of application and ‘bank guarantee. () The effect on the Contractor of any of the Employer's Risks. (&) The Engineer unreasonably delays issuing a Certificate of Completion () Other Compensation Events listed in the Contract Data or mentioned in the Contract 144.2; “ Ifa Compensation Event would cause additional cost or would prevent the work being completed before the Intended Completion Date, the Contract Price shall te increased anc/or the Intended Completion Date is extended. The Engineer shall decide whether and by hhow much the Contract Price shall be increased and whether and by how much the Intended Completion Date shall be extended.” 5. The Employer carries the risks provided in Clause 11.1 of SBD (Section 3: ‘of contract) and reads as: nditions Employer's Risks CL. IL: “The Empleyer is responsible for the excepted risks which are (a) in so far as they directly affect the execution of the Works in India, the risks of war, hostilities, invasion, act of foreign enemies, rebellion, revolution, insurrection or military or usurped power, civil war, riot commotion or disorder (uiless restricted to the Contractor's employees), and contamination from any nuclear fuel or nuclear waste or radioactive toxic explosive, or (b) a cause due solely to the design of the Works, other than the Contractor's az design.” —6. The incidents of disturbances, Bandhs, burning of plants & machinery, less ()3werking hours eau ‘man and machinery resulting in often time aver-ran and lesser output have since been witnessed. The narrow and restrictive interpretation of the relevant provisions in the Contract in regard to recovery of mobilisation advance and extension of Intended Completion Date in respect of ongoing LWE works would result in further delay of the works because of poor eash flow to the Contractors and therefore, against the larger publie interest. 7. It is therefore, requested that the recovery of mobilization advances may be made within the extended completion date approved by the Engineer keeping holistieal view of the afore-mentioned relevant Compensation Event(s) cousled with the ground reality. 8. Itis further requested that in case(s) of Contractor's repeated apathetic atttude/efforts in complying with the committed extended programme, as the case may be noticed duly substantiated documentally or any otherwise vital breach of the Contract, tie necessary action may be initiated as per prescribed procedure by giving a Show- Cause followed by the AS ND WH Io arp ety 71 27 men relevant provisions of Clause 59 read with Clause $1.2 and Clause 32 ofthe of SBD (Seetion 3: Conditions of Contract) inthe larger public interest, 9, All the correspondence whatsoever general or project specific rests with the Ministry in regard to recovery of mobilization advance and extension of Intended ‘Completion Date for ongoing LWE works is hereby stands superseded/disposed off. ate Chief Engineer (LWE) To “The Principal Secretaries!
