EXECUTIVE SUMMERY
The verification of national HCFC consumption for the years 2013 2014 was undertaken by the national
expert during the period July August 2015 in cooperation with Albanian National Ozone Unit. All
information and documents required for the verification were received from different sources such as:
Direct contacts with all importers of ODS during 2013 and 2014;
Direct contacts with importers of equipment, end users, service shops, RAC associations;
Ministry of Environment ODS import quotas and import licenses issued;
General Department of Customs actual ODS imports for 2013 and 2014;
National policies and procedures on ODS imports and exports;
Government enforcement structure for ODS imports and exports;
Other documents related to licenses, trade names, labeling, to be presented to customs by importers
and exporters of ODS.
In order to conduct the verification, the consultant met representatives from Ministry of Environment,
General Department of Customs, National Licensing Center, National Institute of statistics, importers of
ODS during 2013 - 2014, RAC associations.
The verification reviews national legislation, policies and procedures on ODS imports/exports, such as:
A draft verification report was prepared with main findings and was shared with UNIDO for comments and
suggestions. After taking into consideration all comments received the final verification Report has been
submitted to UNIDO.
BACKGROUND
HCFC Phaseout Management Plan (HPMP) for the Republic of Albania was approved at its 64 Meeting of
the Executive Committee of the Multilateral Fund for the Implementation of the Montreal Protocol held in
Montreal, Canada from 25 to 29 July 2011.
According to the Decision XIX/6 for Article 5 countries, the accelerated Phase-out schedule for HCFC-s
against the baseline level (the average of the HCFC-s consumption in the years 2009 2010) is:

Phase out by 2040, while allowing an annual average of 2.5% for servicing during the period 2030
2040.
The Government of the Republic of Albania committed to reduce the consumption of HCFC-s by 35% from
the calculated baseline by the year 2020 as in the Table below:

The First stage of the HCFC Management Plan covers the freeze of HCFC-s consumption in 2013 (baseline
level is average annual consumption in 2009 2010), 10% reduction of HCFC-s consumption by 2015 and
subsequent 5% reduction each year till 2020.
The second tranche of the HCFC phase-out management plan (HPMP) was approved by the Executive
Committee at its 70th meeting in July 2013. The project is being implemented jointly by United Nations
Industrial Development Organization (UNIDO) and United Nations Environment Programme (UNEP) in the
amount of US$ 92,000 for UNIDO and US$ 20,000 for UNEP. The aim of the project is to implement
activities that will help the country to meet compliance targets under the Montreal Protocol.
The second tranche of the HCFC phase-out management plan (HPMP) was approved to meet a 35%
reduction of the HCFC consumption baseline by 1 January 2020. The Government of Albania has already
developed policies and regulations to support the HCFC phase-out, which include a licensing and quota
system to control the import/export of HCFCs.

There is no production of ODS in the Republic of Albania, which means that the consumption of HCFC-s is
equal to Imports minus Export.
Objectives
The main objective of the HPMP is to enable the Government of Albania to phase-out the HCFC-s
consumption as approved at the 64th Meeting of the Executive Committee. The monitoring and the audit
services of the HPMP is focused on these issues:
According to the DCM No. 290, dated 04.28.2010.For some changes and addition to the DCM No.
453, dated 23.06.2005 importing of Ozone Depleting Substances, included in Annex C, group 1, is
allowed only on the bases of annual quotas approved for Albania.
The quota system is defined for each year. Ministry of Environment is the only responsible body for
import permits for ODS and alternatives.
For the year 2013, the quota of importing HCFCs has been 108 MT. This quota has been divided by
the Ministry of Environment between these companies:

Annual consumption for 2013, verified through examination of different sources of information was
found to be 103,116 kg HCFC-22. The imports of HCFC-22 for 2013 are below the maximum
allowable total consumption for Albania as per current Agreement.

Annual Consumption of HCFC-22 for 2014, verified through examination of different sources of
information was found to be 29,902 kg, far below the maximum allowable total consumption for
Albania as per the current Agreement.
Albania has ratified the Vienna Convention and the Montreal Protocol in October 1999 with the Law No.
8463, dated 03.10.1999.
Albanian Parliament has ratified all the amendments to the Montreal Protocol as follows :
The London Amendment to the Montreal Protocol with the Law No. 9484, dated 02.03.2006;
The Copenhagen Amendment to the Montreal Protocol with the Law No. 9480, dated 16.02.2006;
The Montreal Amendment to the Montreal Protocol with the Law No. 9485, dated 06.03.2006;
The Beijing Amendment to the Montreal Protocol with the Law No. 9485, dated 06.03.2006;
The approval of the Council of Ministers' Decree No.453 dated 23.06.2005 on "Taking the measures for
the removal of the Ozone Depleting Substances has been very important.
Production of Ozone depleting substances, products that contain substances listed in Annex A, B,
and E of the Montreal Protocol;
Import and dumping in the market, the export and transit of products containing Ozone depleting
substances and equipment that use substances listed in Annexes A, B, and E of the Montreal
Protocol;
Use of Ozone depleting substances and products that containing these substances, which are used
in agriculture.
Decision No. 290, dated 04.25.2010 "For some changes and additions to the decision No. 453 dated
23.06.2005 of the Council of Ministers" has decided that in Albania are prohibited:
Production of Ozone Depleting Substances, products and mixtures that contain substances listed in
Annex A, B, C and E of the Montreal Protocol;
Import, marketing, export and transit of products containing mixtures of Ozone Depleting
Substances and equipment that use the substances listed in Annexes A, B ,C and E of the Montreal
Protocol;
Release into the air of Ozone Depleting Substances listed in Annex A, B, C and E of the Montreal
Protocol;
Import of Ozone Depleting Substances, their products, equipment that contains such substances,
from a country that is not a party to the Montreal Protocol;

Using Ozone Depleting Substances and products that contain these substances, which are used in
agriculture as fumigants;
Export of Ozone Depleting Substances and products that contain them and used equipment, to a
country that is not a party to the Montreal Protocol;
Import of Ozone Depleting Substances recycled or reclaimed;
Import of Ozone Depleting Substances included in Annex C, group I is allowed only on the basis
of annual quotas set out in their diagram, approved for Albania.
Licenses and permits issue in the Republic of Albania are stipulated in the appendix of the Law Nr.10081,
date 23.02.2009, On the Licenses, Authorization and Permits in the Republic of Albania, amended .
Furthermore, in the Annex 1 and 2, of the DCM Nr. 385, date 26.05.2009, For the licenses and permits
processed by or through National Licensing Center and other common legal amendments, amended, issued
pursuant to the Law Nr. 10081, are stipulated the licenses and permits handled by or through the National
Licensing Center, and the ones handled without the involvement of the NLC.
One of the licenses stipulated in Annex 1, of the DCM Nr. 538, is also the license import of waste for
recycling, processing purposes and/or use or import of ozone-depleting substances", with the code III.3.
This license is conceived as license of group 3, it is handled through the NLC and Ministry of Environment,
which verifies the fulfillment of licensing criteria. The legal time period available to the Ministry of
Environment for the final decision-making is 20 days.
The application procedure commences with the legal representative or another authorized person of the entity
that shall obtain the respective license, going at the service windows of the NCL. He/She submits the
application altogether with all the required documentation. The application is then automatically sent by the
electronic system to the registrar of the NLC, who after preliminary reviewing it, decides for the
approval/refusal of the case.
In case of preliminary approval by the registrar, the case is automatically forwarded to the Ministry of
Environment. The Ministry of Environment reviews the cases according to their order of submission. After
the review of the fulfillment of criteria for issue of the license, through an analyze and evaluation of all
information needed in cooperation with the National Agency of Environment and NOU, Ministry of
Environment decides for the approval or the refusal of the application according to the Quota approved for
Albanian for the recent year. In the event of the non-publication of the answer within the stipulated time
periods, or if the refusal does not contain the reason of the refusal, it is considered as silent consent of the
other institution.
The procedure followed by the Ministry of Environment for coordinating the process of assessing the
application which was forwarded by the NLC, with its subordinate institutions and other relevant institutions,
is stipulated in the DCM No.453 dated 23.06.2005, amended.
Albania has a registration system for companies which apply for permit of import of waste for recycling,
processing purposes and/or use or imports of ODS. To register the companies have to provide the following

The format of the Import Permit of ODS and other documents are attached to this Verification Report,
Appendix 1 and Appendix 2.
Three training workshops were organized under the HPMP Tranche 2 in different cities in Albania. These
training workshops were attended by 87 technicians from service sector of refrigeration and 69 of them
received certificate of participation. The technicians that participated in the training were apprentice
technicians and multi-craft trades people. Most of them run their businesses in different cities of the country.
The workshops were well attended from all participants and related staff during workshop's days. The
participants were invited from major refrigeration and air-conditioning installations, service workshops and
the training institute. Most of the participants were senior technical persons involved in operation,
maintenance and servicing of various types of refrigeration and air-conditioning appliances and equipments.

Practical sessions
Practice training during the second day aimed to help technicians achieve maximum performance to
improve the A/C and refrigeration system efficiency. To achieve this, technicians are taught with good
practices in refrigeration sector. They were concentrated mainly in recovery, recycling and reclaim of
refrigerants practice.
Technicians are divided into small groups for the practical training. Each of the technicians has done the
practice with one of the trainers using the following equipment:
After theoretical and practical testing, the participants have received the certification of participation in the
Training of Technicians on Good Practice in Refrigeration.
NOPIU (National Ozone and Project Implementation Unit) in cooperation with Albanian RAC
Associations and United Nation Environment Programme (UNEP) organized a Training Workshop on
Good Practice in Refrigeration Sector from 27 28 February in Tirana, ABA Business Center. In this
workshop participated 25 technicians and only 22 of them received certificates.
During the first day, technicians got theoretical knowledge about introduction of Montreal Protocol and
HPMP at national level to phase out HFCF, alternative refrigerant to HCFC, good practice in refrigeration
sector, recovery recycling and reclaim of refrigerant and tools, equipment used in refrigeration.
The second day was practical training of technicians to have a better understanding of air conditioning and
refrigeration system. The practice helped the technicians to achieve great performance to improve the air
conditioning and refrigeration system efficiency. During the practical training technicians are taught with
good practices in refrigeration sector. They are focused mainly in recovery, recycling and reclaim of
refrigerants.

b) Training of Technicians on Good Practice in Refrigeration, 28 30 April, Hotel
Majestic, DURRES
From the 28th to 30th of April, is organized the Training of Technicians on Good Practices in Refrigeration,
in the Majestic Hotel premises, Durres. In this seminar participated 28 technicians from service sector of
refrigeration, mainly from Durres city and the areas close to it and 24 of them received certificate of
participation. Almost all the technicians work on site by performing direct services to refrigerators and air
conditioning appliances. They work on different companies or are self-employed.
During the first day of the seminar were addressed topics related with theoretical knowledge about
introduction of Montreal Protocol and HPMP at national level to phase out HFCF, alternative refrigerant to
HCFC, good practice in refrigeration sector, recovery recycling and reclaim of refrigerant and tools,
equipment used in refrigeration,.
During the second day, continued the theoretical presentation related with Good practices in refrigeration
sector. The participants interest was mainly concentrated in Recovery, Recycling and Reclaim of
refrigerants and Review of tools and equipments used in servicing of refrigeration appliances. The
participants discussed for a long time after each presentation. In the conclusion of the second day, the
participants in the seminar completed the theoretical test.
In the third day, it was organized the practice with groups made of three technicians. Each group performed
the practice using all the equipments from the start until the end of the process. The third day of the seminar
is considered the most interesting day by the participants as it was related directly with their everyday work.
The seminar was concluded by making the respective conclusions and also with the certificate issuing
ceremony.
From the 29th to 30th of October, it was organized the Training of Technicians on Good Practices in
Refrigeration, in the private University Pavaresia premises, Vlore (one of the best conference room in the
city). In this seminar took part 34 technicians from service sector of refrigeration, mainly from Vlora city
and Fier city. Only 23 of them received certificate of participation. Almost all the technicians work on site
by performing direct services to refrigerators and air conditioning appliances. They work on different
companies or are self-employed. In the seminar took part also some students from Industrial School
PAVARESIA, Vlore.
During the first day of the seminar were addressed topics related with theoretical knowledge about
introduction of Montreal Protocol and HPMP at national level to phase out HFCF, alternative refrigerant to
HCFC, good practice in refrigeration sector, recovery recycling and reclaim of refrigerant and tools,
equipment used in refrigeration

3.2 Training of customs officers on implementing the HCFC licensing system and on
identification of HCFS refrigerants and blend.
The Customs training workshop on monitoring and control of Ozone Depleting Substances is organized on
2 3 October, in Hotel Victoria, Tirana. This workshop is organized with the assistance of the international
resource person, Prof. Janusz Kozakiewicz and Mr. Mikheil Tushishvili, Programme Officer, UNEP DTIE.
The objective of Customs training workshop on monitoring and control of Ozone Depleting Substances was
to provide the customs and enforcement officers of Albania with the necessary practical skills and knowledge
to identify HCFCs and HCFCs containing equipment and to enable customs officers to get acquainted with
the ODSs regulations and other legislation regarding ozone issues and create awareness amongst customs
officers on their role in enforcing Montreal Protocol at the national level.
Share with the customs and enforcement officers information on the global aspect of trade in ODS
as well as on the most frequently used ODS smuggling methods and present actual cases of illegal
trade in ODS, specifically HCFCs
Demonstrate to the customs and enforcement officers the practical application of refrigerant
identifiers in identification of ODS and describe procedures for safe handling of ODS
Allow the customs and enforcement officers to learn how illegal HCFC shipments may be spotted
based on analysis of customs documents and through the use of refrigerant identifiers
The Participants were 20 officers from the General Directorate of Customs (customs officers from various
points of entry and customs sections - computer and data processing unit, document processing unit,
administration unit, enforcement officer etc.). The representatives of the Refrigeration Association which
exist in Albania were also present (one was also acting as National Consultant).

1. To improve the coordination between the institutions such as the Ministry of Environment, Customs
General Directorate, NOPIU, National Environmental Agency, Environmental Inspectorate
regarding import and export of ozone depleting substances.
2. The Ministry of Environment must inform the Customs General Directorate by official
communication about the annual import quota of ODS. Then Import Permits will be issued to
different subjects.
3. The contemporary identifiers which include a wider range of gases should be used in all customs
branches.
4. Annual training programs for the main customs branches staff need to be drafted related to the usage
of the new identifiers to reflect the changes in the refrigerants gases list as well as possible changes
in the respective legislation.
5. The Ministry of Environment must perform the review of the legal acts and regulations regarding
the procedures and documentation that the importing subject must present to the Customs Authorities
in order to perform the customs procedures.
6. The signing of a Collaboration Memorandum between the Ministry of Environment, the Customs
General Directorate and the NOPIU is recommended.
7. A legal procedure needs to be put in place for the final destination of refrigerant gases in the cases
of seizures by the Customs Authority.
8. To explore the possibility to equip the Customs General Directorate laboratory with identifier
equipments.

9. To review the Customs General Directorate module related to the risk profile.
10. To explore the possibility of ODS import through 3 or 4 customs branches which will be specialized
for these respective customs procedures.
Recovery and recycling scheme works well but it was done individually by companies which work in this
sector. There is not a national R & R center for HCFCs till now. Companies and service shops that are
awarded with R & R equipment are obliged to report every year to the National Ozone the amount of
recovered and recycled refrigerants. There are 55 funded recycling machines and 17 funded recovery
machines in operation. Four R & R sets are delivered to vocational schools:

Annual consumption of HCFCs in 2013 and 2014 is below the maximum allowable total consumption of
Annex C, Group I substances established by the Agreement between the Government of the Republic of
and the Executive Committee of the MLF. Albania is in compliance with the current Agreement.
Albania is an official candidate country for accessing the European Union. It would need to adjust the ODS
legislation to the European Regulation on ODS.
Training programme is very well organized. It is recommended to continue the training of technicians and
environment inspectors.
The recovery and recycling scheme is functioning well. It is recommended strengthening the cooperation
between the service shops for the R & R scheme.
