India: COPYRIGHT RULES, 1958

Scheme of Tariffs: As soon as may be, but in no case later than three months from the
date on which a copyright society has become entitled to commence its copyright business,
it shall frame a scheme of tariff to be called the Tariff Scheme setting out the nature and
quantum of fees or royalities which it proposes to collect in respect of such copyright or
other rights administered by it.
So the tariff scheme is decided by the copyright society

Korea: Copyright Act governs the copyrights related issues in RoK.


The Korean Copyright Commission set up under the Article 112 of Copyright Act [1] fulfils
its roles ranging from deliberating copyright-related issues, mediating copyright disputes,
researching policies and legislations on copyright, providing copyright education and
public awareness programs, to serving as a copyright registration agency.
Copyright Act sets forth provisions with respect to copyright management services
covering the copyright trust services [CTS] as well as the copyright agency (or brokerage)
services [CAS].

CTS are more strictly regulated and must obtain a license from Ministry of Culture, Sports
and Tourism while brokerage services just need to intimate the Ministry.
The fee and the amount of royalties obtained from users are determined after the CTS has
made an application (under article 105 of the Act)[2] for approval to the Ministry which
undergoes deliberation at the KCC under the Copyright Act. The KCC has the right to make
corrections under the provisions of the Act. The final approval has to be made public by
the Ministry.
Copyright agent or broker can determine the rate and amount of the fees at his/her
discretion without the approval of the Minister of Culture, Sports and Tourism [1]
There are 13 copyright management service providers in Korea.
