JUDICIAL PRECEDENTS

The Judicial precedents are playing very vital role in the judicial
system of every country. A judicial precedent means
the rulings/judgments delivered by the Courts. Through these
judgments the Judges interpret the law in real sense. These
judgments are binding upon the lower courts and once a principle is
settled for the specific legal proposition then the Courts are bound to
follow the principle. The advocates are required to find out these kinds
of judgments which support their version and present before the
Honble Court so that the Courts are enable to decide the
matter smoothly. The lower court are bound to follow the judicial
precedents but High Courts and the ultimate court of the
land/Supreme Court can review the earlier settled principle for specific
legal proposition. It is pertinent to mention here that when the
principle laid down by the ultimate Court of the Land/Supreme Court
that no other court has jurisdiction to alter or review the principle.
