RESOLUTION NO. 274

WHEREAS, the Sangguniang Panlungsod has previously enacted City Ordinance No.
018-08, otherwise known as the TARLAC CITY OMNIBUS MARKET CODE OF 2008,
intended to install a more professional, orderly, and systematic system for the operations,
management, and administration of public markets within the territorial jurisdiction of the city
and thereby protect the welfare and safety of the general public who transacts personal and
official business thereat, and serve as a mirror of well-managed Public Markets and a credible
show window of the City Government of its economic enterprises in this part of the Region;

WHEREAS, Sec. 16 of Republic Act 7160, otherwise known as the Local Government
Code of 1991, provides that: Every LGU shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its
efficient and effective governance, and those which are essential to the promotion of the general
welfare. Within their respective territorial jurisdictions, LGUs shall ensure and support, among
other things, x x x maintain peace and order, and preserve the comfort and convenience of their
inhabitants.;

WHEREAS, Section 458(a)(5)(ii) of Republic Act No. 7160, otherwise known as the
Local Government Code of 1991, further states that: The Sangguniang Panlungsod, as the
legislative body of the city, shall enact ordinances, approve resolutions, and appropriate funds for
the general welfare of the city and its inhabitants pursuant to Section 16 of the Code x x x and
shall x x x establish markets, x x x and authorize the operation thereof by the city government;
and regulate the construction and operation of private markets, talipapas or other similar
buildings and structures.;

WHEREAS, the Honorable City Mayor has favourably endorsed the amendment of the
Tarlac City Omnibus Market Code, particularly with respect to the cleaning of fish and the
indiscriminate throwing of fish scales and innards within the premises of the public market,
which clog the drainage thereat, not to mention the foul odor and other health and sanitation
concerns which arise from the decaying fish entrails;

WHEREAS, the cleaning, segregation and disposal of fish scales and entrails as
extremely difficult, by reason of their nature, hence, more appropriate and exigent measures
should be undertaken, in the interest of ensuring the accomplishment of the purpose and intent
for which the Tarlac City Omnibus Market Code was enacted;

NOW, THEREFORE, on motion of Councilor Arsenio B. Lugay II and Councilor Ana A.
Aguas, duly seconded;

RESOLVED, that in the interest of public service and welfare, the Sangguniang
Panlungsod of Tarlac hereby promulgates and enacts:

AN ORDINANCE AMENDING CHAPTER 5, SECTION 23 (RULES, REGULATIONS, AND


PROHIBITED ACTS), ITEM 15 OF CITY ORDINANCE NO 018-08, OTHERWISE KNOWN AS THE
TARLAC CITY OMNIBUS MARKET CODE OF 2008

Be it ordained by authority of the Sangguniang Panlungsod of Tarlac that:

Section 1. Amendment - Chapter 5, Section 23 (Rules, Regulations, and Prohibited Acts), Item
15 of City Ordinance No. 018-08 be, as it is hereby, amended, to be read as follows:
Section 23. Rules and Regulations, and Prohibited Acts.

15. Other Prohibited Acts.


a. Pushcarts (buggy type) or similar baggage carriers are strictly prohibited
inside the Tarlac City Public Markets.
b. Repacking/Processing (i.e. Sugar, Charcoal, Meat Processing) is strictly
prohibited inside the premises of the City Public Markets.
c. Cleaning (i.e. removal of scales and entrails, and deboning) of any kind of
fish is strictly prohibited inside the premises of the City Public Markets.
d. Sidewalk vending is strictly prohibited inside or within the premises of the
City Public Markets, and within the Metro Barangays.
e. The act of harboring street and sidewalk vendors in the City of Tarlac is
hereby declared illegal and strictly prohibited.
f. Private Markets, Satellite Markets/Talipapas and/or similar types of
businesses are hereby prohibited within the Metro Barangays.

Section 2. Applicability Clause - All other provisions of City Ordinance No. 018-08 as
amended, which are not hereby amended shall remain in full force and effect.
Section 3. Effectivity Clause - This ordinance shall take effect immediately after its
publication in a newspaper of general circulation within the province.

RESOLVED FURTHER, that copies of this resolution be forwarded to the Hon. Gelacio
R. Manalang, City Mayor, and to the Honorable Members of the Sangguniang Panlalawigan of
Tarlac thru the Hon. Pearl E. Pacada, Vice Governor and Presiding Officer, for their information
and appropriate action.
