It is yet to be defined when to use the empirical values for m and K of colour region A and when those of colour region 8. This is further elaborated on page 3, last paragraph of the description for colour region A and on page 4, 2nd paragraph for colour region 8 and appears to correlate with the subject matter of claims 5-7 for colour region A respectively claims 9-11 for colour region B. The use of this unusual definition of parameter Y in the present context is considered to lead to a lack of clarity because the claim does not clearly identify the products encompassed by it as the parameters cannot be clearly and reliably determined by indications in the description or by objective procedures which are usual in the art. This makes it impossible to conpare the claim to the prior art. As a result, the application does not comply with the requirement of clarity under Article 84 EPC. This unclarity further leads to a lack of disclosure as it is ‘impossible for the skilled person to carry out the invention on the basis of the subject matter of claim 1 only. Moreover the light reflectance value ¥ of the coloured coating composition as defined in claim 1 appears to relate to the light reflectance value of the dried coating (description page 8, 5) and not the composition of claim 1 (Article 84 and/or 83 EPC).
