To develop the mineral industry through increased investment, value addition, national
participation
and revenue generation to contribute significantly to substantiate socio-economic transformation
and poverty eradication.
The policy indicates how to apply for the various licenses; prospecting, exploration, location,
retention and mining lease, why one may be granted or denied the license, duration of each
license and the rights and obligations of a license holder. The policy also indicates the inspection
of operations under the mineral rights, explains the buying, selling and dealing in minerals
through the dealers licenses. The restrictions on exercise of mineral rights compensation for
disturbance of rights and option of compensation by landowners is also explained within this
policy.
Undergoing review, these are some of the recommendations I applaud the various committees
looking into it to put a close eye on.
Conclusion
The inadequacy of the prevailing mining regulatory framework creates challenges in regulating
the mining sector, thus hindering the realisation of the sectors intended objectives. The DGSM
has not been effective in administering the mining industry as issues of ASM, commercialized
building materials, environmental, health and safety standards, remain inadequately addressed.
Recommendation
The Directorate should ensure that the review process of the mineral regulatory framework is fast-
tracked so as to enhance the administration of the mineral sector for improved mineral exploitation
and development.
The mining sector in Uganda is regulated by four main bodies which generally lack coordination
thus affecting the entire mining sector, rendering the laws and policies un-sustainable.
The different mining regulatory bodies (Ministry of energy and Mineral development, NEMA,
Ministry of lands, water and environment, UNBS etc.) should form a platform of understanding
and cooperation/coordination amongst themselves for better and smooth operation.
ADVISORY SERVICES
One of the objectives of the mineral policy is to regularise and improve artisanal and small scale
mining. In order to do this, government, through ministry of energy and mineral development
was to use the following strategies: apply light handed regulation in small scale mining by
exercising leniency, provide information on available production and marketing facilities;
provide extension services to the small scale miners through their associations; and carry out
awareness campaigns targeting the artisanal and small scale miners.
However, field inspections revealed that the intervention had no impact on the way ASM conduct
their mining activities as they were found operating with no health and safety gear and no evidence
of follow up conducted by Department of Geological Survey and Mines availed to audit.
There were no interventions by DGSM to encourage ASM to have their associations granted
Location Licences to ease tracking of their operations.
As a result of largely informal artisanal and small scale mining activities, concerns on
environmental and land degradation due to indiscriminate excavation; and loss of revenue due to
non-declaration of minerals excavated have increased.
Conclusion
The ASM operations remain largely informal which adversely affects enforcement of the law
and monitoring of operations and ultimately encouraging illegal mining activities that are not
only a source of leakage of mineral revenue but also whose mining practices that are not
environmentally friendly.
Recommendation
The DGSM should liaise with the various stakeholders in the mining sector to further explore
ways of encouraging the formalization of ASM activities and enforcement of the regulatory
regime
Strengthening Institutional Capacity of the DGSM and other relevant institutions.

Quoting section 1.2.2, of the mineral policy 2001, the institutional framework of the mining
sector has the Ministry, the Directorate, the Department and others which include the District
Local Administration Authorities, The National Environment Management Authority and
Uganda Chamber of Mines and Petroleum.
Recommendation
There is the need to foster inter-sectoral coordination between DGSM and
other relevant institutions by establishing formal alliances for efficient and effective
management of minerals resources in Uganda.
The reviewed Policy will therefore put in place strategies to strengthen the institutional capacity
and coordination, taking into consideration the different roles of Government, its institutions and
agencies and other relevant entities for effective management of mineral resources.
