We would like to call this hearing of the Committees on Agriculture and Food, Ways and Means, Trade and Commerce and Public Accountability—Committee on Accountability of Public Officers and Investigations to order. The Chair declares the presence of a quorum. This is the committee hearing on the privilege speech of the Honorable Senate President on rice smuggling. For the information of our Senate President and our guests, in the previous hearing, there was a motion to have several rice traders and representatives of cooperatives appear in today’s hearing. Of these 21, for the record, 11 have written this Committee, Mr. President, saying they will not be able to attend Of the 21, another four have sent their lawyers, and one of the 21 appeared. And so, five have not responded, have not written, have not sent lawyers, Mr. President. In any event, Mr. President, of the 21, only one has appeared. This is Mrs. Jane Artuz. Where is Mrs. Jane Artuz? Why are you over there? In view of this, Mr. President, this Committee is constrained on the basis of the non-compliance with a subpoena issued by the Committee, Mr. President, we are constrained to enforce the powers of the Senate and of its Committees. But Section 16, if I may place on record, of our Rules Governing Inquiries in Aid of Legistation—Section 18, “The Committee by a vote of—may punish for contempt any witness before it who disobeys any order of the Committee or refuses to be sworn. “so forth and so on. So, Section 18, the power to punish for contempt individuals or persons who refused—who disobeys any order of this Committee. The order to appear, Mr. President, is a lawful order of this Committee. And, therefore, the Chairman will move that we cite those who have failed to attend today’s hearing in contempt of the Senate and that an arrest order be issued. THE SENATE PRESIDENT. Given the fact that these people seem to be reluctant to appear here, and it gives me the suspicion that they do not exist as organization. And if they exist, they are nothing but paper organization and, therefore, dummies of certain interested and influential parties. I move that we direct the National Bureau of Investigation to conduct a thorough inquiry into the background of all of these named identities, and report the matter to this—its findings to this Committee so that we can take proper action against them, including their principats. I think it’s time that we enforce the laws in this country and arrest all these people and send them to jail, if we could THE CHAIRMAN (SEN. PANGILINAN). THE CHAIRMAN (SEN. PANGILINAN). The ComSec is hereby directed to make the necessary representations and the official communication with the National Bureau of Investigation. I think we have a representative of the agency—of the bureau, Atty. Arugay is here. Would you care to comment? MR. ARUGAY. Good morning, sirs, Your Honors We will wait for the official communications, Your Honors, before we start the investigation. THE CHAIRMAN (SEN. PANGILINAN). Thank you, Atty. Arugay. THE SENATE PRESIDENT. And also for the record, the motion to cite the individuals who failed to appear today in contempt shall be decided, Mr. President, in a meeting perhaps later in the afternoon. THE SENATE PRESIDENT. And look, I received a letter here from Mr. Guha, a foreigner. He left the country while we are conducting this investigation with the, probably, advice of his lawyer, and now he claims that he is sick and that he does not want to submit himself to jurisdiction of this Committee THE CHAIRMAN (SEN, PANGILINAN). We will have to tackle this matter during our— THE SENATE PRESIDENT. May we also direct the Committee Secretary to make the necessary representations with the OSAA, the Sergeant-At-Arms, considering that these would be 21 individuals—or 20, excluding Ms. Jane Artuz, who is here, 20 individuals who may be subjected to, precisely, being detained under the custody of the Sergeant-At-Arms, That this ComSec make the necessary representations with our Office of the Sergeant-At-Arms, and coordinate with the BJMP, the PNP, and the DILG should the same become necessary. CATADMAN I-1 November 7, 2012 10:13.a.m. 8 1 would like to submit to you formally a list of big importers of packed and bulk palm oil, Palm Olei , as reported to this representation, and including their importation and the pricing of those importation, which shows that there is a rampant smuggling of this commodity and, perhaps, other commodities in this country. And I think it’s time that we unravel the whole problem of smuggling in this country, which the Bureau of Customs seems to be powerless to control. Hopefully, if it’s the agricultural products, apart from rice, that we will have the Secretary attend, Usec Rudinas. ‘And in the next hearing, when that hearing is called, we would like to know what is the status of the negotiations between the DA and the BoC on the IFM, the Inward Foreign Manifest. I am told, on record, that this is now being made available, however, due to some computer considerations, the same has not been effectively implemented. Is that correct, Usec Rudinas, Commissioner?
