In reference to your notice, we would like to mention that

1) We deny all the allegations made by you vide your above-referred notice, which are false and as
such, not admitted herein.
2) Please take note that we do not have any malafide intentions, as we are using the logos of
various companies only to convey that we have been providing training materials to participants
to face Olympiad /competitive exams conducted by these esteemed institutions. Further, a
disclaimed clause has been specified in our website, which reads as:

"*All logos are trademarks of the respective organizations. Olympiad

Helper is an independent organization and is not an official partner of
any of the mentioned organization.”

3) As regards the statutory rights that you have been talking about under Section: 28 of the Trade
Marks Act, 1999, please take note that the various trademark registrations that you have cited,
do not have any relevance at all. Under the circumstances, the question of infringement or
passing off does not arise at all.
4) In any event, we are not interested in disputing the same. However, please take note that we
have never infringed or passed off any of your client’s trademark.
5) Nowhere in the website we have projected these marks as our trademark and have projected it
as only your trademark, thereby creating more intrinsic value to your esteemed client’s
trademarks, which was with honest intention.
6) Further, the provisions of the various sections of the Trademarks Act, 1999 cited by you are
attracted when a person deals/offers in spurious goods/services and by doing so, you have
termed us as an ‘Infringer’ which is not only unfair but absolutely false and hereby vehemently
denied.
7) Under the above-mentioned circumstances, we have removed the trademarks/icons of your
clients’, to put the matter to rest. Please see the Annexure A or visit http://olympiadHelper.com
