Dear Sir,
This is in reference to Non-Conformance received vide letter stated above for achieving less
asphalt pavement thickness determined from the core taken on the DBM Laying bed from Ch.
249/240 to 249/780 in LHS.
Please note that the Manual of Specifications & Standards for Four Laning of Highway through
Public Private Partnership IRC SP 84 - 2009 and MoRTH Specifications (Fourth Revision) are
applicable Specifications and Standards for the Works to be executed under this Concession
Agreement.
Your kind attention is also drawn to Clause 5.1.4 of IRC SP-84 that in case of pavement design
the materials, mixes and construction practice shall meet the requirements prescribed in the
MORT8H / IRC Specifications.
The Dense Bituminous Macadam being provided is a part of flexible pavement for which
material shall confirm to the requirement prescribed in MoRTH Specification & IRC Standard as
per Para 5.7(1) of the manual (schedule D of the Concession agreement). The Flexible
pavement shall be designed in accordance with IRC: 37 - 2001. As per Annex-V11 (Ref Clause
7.4.2) of IRC 37 ~ 2001, the selection of grade of binder & mix design for bituminous course to
be done as per IRC-111-2009
Therefore the IRC: 111-2008 Code & Slandard for Specification for Dense Graded Bituminous
Mixes prevails over the MORTH Specification. As per clause 6.1.1 of IRC: 111-2009, “The
levels of the dense bituminous mixes shall not vary from those calculated with
reference to longitudinal and cross profile of the roads as per the Contract beyond
+6mm provided that the negative tolerance shall not be permitted in conjunction with
the positive tolerance for the base course if the thickness of the former is thereby
reduced by more than 6mm.”
{tis clear from the above specification that if the pavement thickness is deficient from the target
x by 6mm or less then it should be treated as within the specification limit..

thickness (=53mm) is not deficient by more than 6mm from the target thickness of 55mm for the
particular stretch.
We further like to draw your attention that this issue was identified and raised by PD, NHAl
during his monthly visit on dated 25” of March’4.In concurrence to PD's observation, further
core was taken in presence of your RE on dated 28” of March in proximity to the location of
thickness deficiency of cores . The coring thickness is found meeting with the required
‘Specification. (Test report enclosed). is irrational to issue NCR after a lapse of one month in
consideration to harass the concessionaire.
In view of the above, your issuance of Non-Concurrence is irrelevant and against the spirit of
CA. Hence the NCR is to be revoked from your end at the earliest.
