I'm Lieutenant James Walker# 435 of Internal Affairs and I will be taking your statement directly
into the computer. I'm interviewing you today in reference to the complaint that you filed on
02-15-11.

Q . Tell me about the incident that occurred 02-14-11 .

I met with Detective Richard Pacell at 2118 Fitzwater Street on 2-14-11 at approximately
2 : 20PM for the purpose of terminating his services. I gave him the Notice of Termination
because I had a concerns for my personal wellbeing. I asked my secretary ( Carla Wilson) to
go with me. I told Detective Pacell about the things that I wasn't happy with. After he read the
first few line of the letter he asked me if " Is that it"? I told him I think you need to read the rest
of the letter because l'm asking for some of my money back. Detective Pacell became irate
and argumentative. He told me that he wasn't going to give me any money back. I stated to
him that," I guess I'll have to see you in court." Then he left and I received a cell phone call at
approximately 2:32PMfrom Detective Pacell it lasted for about six minutes. I put his call on
speakerphone so that Carla could hear it. He was still arguing with me about the work. He
stated," I want my tools." I stated," I want my money and my keys.''. This went on for a few
minutes. I hung up the phone and left the location. I received another call at 5:42 PM
from Detective Pacell still irate about being fired and me asking for my money back.
I told him that I wasn't going to give him his tools. I said to him, lets meet you can get your
tools I can get my money and my keys and we can take care of this all at one time. I asked
.him when would yoll like to meet he said next week. I told him that I did not want to go to court
because it's a very time consuming process. I told Detective Pacell that I prefer to w ork it out.
On 02-14-11 I went to my house at 211 BFitzwater Street at 7: 30 PM. to secure it because
Detective Pacell kept saying he wanted his tool back and he refused to return my keys . He
gave me the impression no matter what he was going to get his tools back. I secured the
property 2-14-11 by placing wood in the slider doors and across the windows. The next
morning at approximately 9 :11 AM I received a cell call from my new contractor
William Nicholson that he discovered the patio door was closed but unlocked. He also told me
that it appeared that somebody broke it through the window. That was the only window without
bars on it. He stated that he received a phone from Detective Richard Pacell stating that he
was coming to get his tool. Mr. Nicholson told me that he told him that there were no tools
there. Mr_ Nicholson told me that Detective Pacell stated that Danny must have come and got
the tools. I went to the location and saw for myself that the tools were gone. That When I called
the police. ·
