FUNCTIONS OF THE LEGAL DEPARTMENT IN NOSDRA

LEGAL UNIT: The legal unit of the agency handles all legal matters in

the agency and its parastatals the unit serves as the advisory arm of the

various departments and units of the agency.

The head of the unit is designated Director (legal) and is regard to

advice the agency on all legal matters arising from the activities of the

agency.

Functions

(1) Proffer legal opinion and advice on all matters.

The Proffer legal opinion and advice on all matters relating to

the running of the agency and investigate claims or disputes

arising from agreements entered into between the ministry and

other parties.

(2) Represent the ministry. Represent the ministry in ligation

matters at the various federal high courts throughout the

federation and appeals in the court of appeal and the supreme

court.
(3) Represent the agency: Represent the agency in negotiation

settlements out of court and in arbitration tribunals.

(4) Represent the ministry agency at the public hearing at the national

assembly.

(5) Participle in the negotiations, preparation and execution of agreements

and memoranda of understanding and other legal documents with states

and other agencies.

(6) Prepare bilateral agreements with various countries and participate in

government to government loan negotiations with government of other

countries.

(7) Keep a depository of all agreement signed by the ministry of finance and

custody seal of the corporate seal of finance.

(8) Also to ensure that at legal issues concerning the agency is settled out of

court. For example Barr lgbabilce V Nosdra where the court adviced the

parties should settle out of court and get back to court to strike off their

matter.

(9) To prepare contractual documents bond, and other legal instrument that

may be needed for the smooth running of the agency’s activities.

In conclusion every ministry or units in the agency has its functions

which is seriously guided and headed by a director. For example our dear

Agency which is NOSDRA has it duty which is to identify high risk

areas as well as priority areas for protection and clean up.
