JKENYON OIL COMPANY, * BEFORE THE Petitioner * PLANNING BOARD OF BA CASE 99-40E&V * HOWARD COUNTY, MARYLAND see ase eee weet wee wre eerie ce eeetettew ee iw at ae met et wee RECOMMENDATION On August 11, 1999, the Planning Board of Howard County, Maryland, considered the petition of the Kenyon Oil Company for a special exception for a gasoline service station and the following list of variances, as requested in an amendment to the petition submitted on August 5, 1999: 30 foot parki 1k: From US 1 For traffic circulation area: -26 feet ~5 fet Recluce the 50 foot structure and use setback: For a canopy over fel pumps: 14.08 feet For a diesel fueling island: 12.8 feet For the outboard fueling island: 240 feet For the inboard fueling istand: 42.5 feet For diesel stacking spaces: -13 feet For diesel fueling space: 14 feet For siandard fueling space 29 feet For standard stacking spaces 5 feet Fora trash enclosure: 13 feet ‘The special exception and variances are requested for a 46,562 square foot property located in the southwest quadrant of the intersection of US 1 and MD 103. The property is described as Lots 14 and 15, Parcel 375, Block 5 of Tax Map 43 in the First Election District of Howard County, Maryland, “The Petitioner was represented by Richard Talkin, Esq. No persons testified in opposition to the petition, ‘The petition, the Technical Staff Report and the Recommendation of the Department of the Planning and Zoning, the Petitioner’s letter dated August 5, 1999, amending the list of requested variances and the comments of reviewing agencies were presented fo the Board for its consideration, ‘The Department of Planning and Zoning recommended approval of the special exception and the revised list of variances based on conclusions that the petition complied with the general criteria used in evaluating requests for special exceptions, the specific criteria for the evaluation of special exceptions for gasoline service stations and the criteria used to evaluate petitions for variances. Alllighting of the site shall comply with the requirements of Section 134 of the Zoning Regulations. 2. The special exception and variances shall be limited to the gasoline service station and. convenience store and associated structures and uses as shown on the special exception Appeals, and fo no other structures, improvements or uses 3. The Board of Appeals shall find that there is a probability of a reasonable public need for the gasoline service station, Mr. Talkin stated that this request is essentially the renewal of an existing special exception granted in 1997 which expired when a building permit was not obtained within two years. There were no questions asked by the Board and no one spoke in opposition to the petition, Mr. Reeve moved to recommend approval of the Petitioner’s amended request, subject to the three conditions listed in the Technical Staff Report. Mr. Kaufman seconded the motion which passed by avote of 510.0, For the foregoing reasons, the Planning Board of Howard County, Maryland, on this 26th day of August, 1999, recommends that the Petitioner’s request for a special exception for a gasoline service station and variances as described on Page | of this Recommendation be GRANTED.
