Facts: On February 13, 2018, at approximately 1:30 P.M., Chicago police officers patrolling
Lower Wacker Drive in response to recent drug sales and a shooting that had occurred in the area
approached defendant to conduct a field interview. A police officer got out of his police vehicle,
told the defendant that he was a police officer and approached the defendant. The defendant then
fled as the police officer chased the defendant and radioed a description of the defendant to other
officers.
Paul Bauer, a 31 year veteran Chicago Police officer and Commander of the 18th Police
District, was in the Loop for a morning training session at the Thompson Center. Commander
Bauer was in full uniform with an outer civilian-style coat. The Commander was in his police
vehicle when he heard the radio communication regarding defendant fleeing, Shortly thereafter,
Commander Bauer saw the defendant running nearby. Commander Bauer got out of his car and
chased the defendant. Commander Bauer continued to chase the defendant as the defendant ran
across Clark Street toward the Thompson Center. Commander Bauer caught up to defendant at
the top of a stairwell outside the Thompson Center.
Commander Bauer tried to detain the defendant at the top of the stairs as defendant
struggled. The defendant then stumbled down the stairs and Commander Bauer either fell or
followed the defendant down the stairs. Based on the physical evidence, Commander Bauer and
the defendant continued to struggle on the lower landing. The defendant drew a gun and fired
seven shots at Commander Bauer, Commander Bauer suffered 6 separate gunshot wounds to his
head, neck, torso, back and wrist. Commander Bauer died as a result of these injuries,
Commander Bauer"s weapon was holstered and secured when his body was found. Commander
Bauer's police radio and handcuffs were on the ground next to his body.Seconds after the shooting, police officers arrested the defendant in the stairwell. Police
recovered a loaded 9 mm handgun with an extended clip from defendant's coat pocket. Police
also recovered cocaine, heroin, marijuana and a sharp object from defendant, Defendant was
wearing a ballistic vest at the time of his arrest.
Numerous law enforcement and civilian witnesses saw Commander Bauer chase the
defendant, heard the shots, saw the defendant coming up the stairs after the shooting, and
observed Commander Bauer laying on the lower landing after being shot. Three civilian
witnesses identified the defendant in a lineup as the individual who struggled with Commander
Bauer at the top of the stairs and was arrested and brought up from the stairwell after the
shooting, In addition, surveillance video captured Commander Bauer chasing the defendant, the
struggle between the defendant and Commander Bauer, and officers arresting defendant after the
shooting. The defendant's right hand and coat tested positive for the presence of gunshot residue.
Criminal History:
1, 14CR-16453- The defendant pled guilty on 1/12/15 to a Class 4 PCS and was
sentenced to 2 years IDOC. He was discharged from parole in August 2016.
2. 111215427- The defendant was found guilty of Misdemeanor Battery on 10/6/11
and was sentenced to | year probation and community service.
3. O7CR-24851- The defendant pled guilty to a Class 3 Possession of a Firearm with
a Defaced Serial Number on 10/8/09 and was sentenced to 3 years IDOC.
4, 98CR-5719- The defendant was found guilty after a trial of Armed Robbery on
4/7/99 and was sentenced to 16 years IDOC. According to the evidence at trial,
the defendant and a co-defendant approached two victims and robbed them at
gunpoint. Both defendants fled in a vehicle and led the police on a high speed
chase exceeding 100 miles per hour on the expressway. During the chase,
defendant threw the proceeds of the robbery, as well as a gun, out of the car
window. The defendants smashed their car into several toll booths before a road
block forced the defendants to exit the expressway where they abandoned their
vehicle and fled on foot. Police ultimately arrested the defendants after a foot
chase.
5. 96CR-32796- The defendant pled guilty to a Class 4 PCS on 3/11/97 and was
sentenced to | year probation. The defendant then violated that probation and was
subsequently sentenced to 3 years IDOC.
