Facts

Mr. Zakir is a huge art enthusiast. One day, his agent Mr. John calls him to inform that he has
found the original artifact- “Ash of Warriors” from China. This artifact is a vase which has
intricate carvings and miniscule details of the story of one great Warrior- Qu Cho Ming from
the 14th century B.C. in China. Mr. Firenze is the person who has the possession of the same.
As Mr. Firenze wants to settle in UK so he agreed to sell that artifact as soon as possible. Mr.
Zakir who is an Indian resident and on the other side Mr. Firenze who is an Italian resident
wants to settle this deal in China. Mr. Zakir wants to settle the deals in Indian rupees that to
in instalment whereas Mr. Firenze wants all the money deals to be in British Pound and all
the money should be transferred in bank in UK. Mr. Zakir also proposed that only after
checking the authenticity on the next given date of the artifacts he will proceed with the
payment mode.

Position of parties

For buyer

Mr. Zakir is a huge art enthusiast. He loves collecting very famous and old antiques and
sculptures of historical importance. He wants to collect all the antique pieces and Ash of
Warriors is one of the unique artifact. He always invests most of his profits from his shares in
buying and collecting such artifacts.

For seller

Mr. Firenze is having possession of those artifacts as his father was a archaeologist and he
got this artifacts from Indonesia. Mr. Firenze wants to get settle in UK with his family so he
is selling those artifacts to get some money which could help them for their settlement in UK.
As Mr. Firenze wants to sell it as soon as possible. As this artifact is invaluable artifacts of
all time so he is expecting a good amount from the buyer.

Approach

Both the parties and their counsel have decided China as their place of selling and buying
those artifacts. As the buyer proposing a sum 80 lakhs(in INR) for the Ash of Warrior and
the other side seller is asking for a sum of 95 lakhs (in Pound).

Conditions which were put by the buyer side is:-

1. Payment to be made in Indian Currency.


2. Payment to be made in instalments.
3. Needs 7 month time for the payment of whole amount.
4. Only 30% will be given as advance that too after verifying the artifact.
5. Verification charges will be bear by seller.
6. Delivery should be without damage of artefact.
Conditions which were put by the seller:-

1. Payment to be made in British Pound.


2. One time payment that too by bank transfer.
3. Maximum 3 months will be given for the payment of full amount.
4. 50% advance payment should be made.
5. Seller will not bear any verification charges.
