Defendant THE GRAND JURY OF THE COUNTY OF ONONDAGA by this indictment accuses ANTHONY SACCONE of the crime of OPERATING A MOTOR VEHICLE WHILE HAVING .08 OF ONE PER CENTUM OR MORE BY WEIGHT OF ALCOHOL IN HIS BLOOD in violation of Section 1192 (2) of the Vehicle and Traffic Law of the State of New York committed as follows The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, drove a motor vehicle while intoxicated, per se; 10 wit: the defendant operated a 2015 GMC Acadia while having an approximate .18 blood alcohol content. SECOND COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of OPERATING A MOTOR VEHICLE WHILE IN AN INTOXICATED CONDITION in violation of Section 1192 (3) of the Vehicle and Tragic Law of the State of New York, committed as follows: The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, drove a motor vehicle while in an intoxicated condition, to wit: the defendant operated a 2015 GMC Acadia while having his ability to do so impaired by alcohol. THIRD COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of OPERATING A MOTOR VEHICLE WHILE HIS ABILITY TO OPERATE SUCH MOTOR VEHICLE WAS IMPAIRED BY THE COMBINED INFLUENCE OF ALCOHOL AND A DRUG in violation of Section 1192 (4-a) of the Vehicle and Traffic Law of the State of New York, committed as follows: The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, drove a motor vehicle while his ability to drive was impaired by the combined influence of alcohol and a drug, to wit: the defendant operated a 2015 GMC Acadia while having his ability to do so impaired by the combination of alcohol and cocaine. FOURTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of RECKLESS DRIVING in violation of Section 1212 of the Vehicle and Traffic Law of the State of New York, committed as follows: The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, recklessly drove a motor vehicle in a manner that unreasonably endangered users of the public roadway, 10 wit: the defendant operated a 2015 GMC Acadia in a reckless manner by speeding, failing 10 obeya traffic marking, and failing to obey a traffic signal, crashing into another vehicle being operated on a public highway, FIFTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of MURDER IN THE SECOND DEGREE in violation of Section 125.25 (2) of the Penal Law of the State of New York, committed as follows. The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death 10 another person, and thereby caused the death of another person, 10 wit; the defendant began drinking at approximately 7-00 p.m. on the evening of Thursday, February 22nd, 2018. Throughout the late evening of February 22", 2018, and early morning hours of February 23", 2018, the defendant ingested alcoholic beverages and cocaine, At approximately 3:25 a.m. on February 23", 2018, while in an intoxicated condition and under the influence of alcohol and cocaine, the defendant drove a 2015 GMC Acadia towards his residence. While on Onondaga Boulevard, the defendant began to accelerate the vehicle with the accelerator pressed to the floor, reaching a speed of approximately 77 miles per hour approximately 200 yards before reaching the traffic light at the intersection of Onondaga Boulevard and Onondaga Road. The defendant crossed a double solid yellow line in violation of Vehicle and Traffic Law § 1128 (a) and (d), reached a speed of 86 miles per hour on a roadway with a posted speed limit of 35 miles per hour in violation of Vehicle and Traffic Law § 1180 (d) while still depressing the accelerator, and went through the red traffic light in violation of Vehicle and Traffic Law § 1111 (d) (1), crashing directly into a 2014 Chevrolet Impala, killing 20 year-old Samra Osmanovic. The defendant then fled the scene of the crash to evade detection, hiding in his mother's house. ‘SIXTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of MURDER IN THE SECOND DEGREE in violation of Section 125.25 (2) of the Penal Law of the State of New York, committed as follows The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, under circumstances evineing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, and thereby caused the death of another person, to wit: as alleged in the FIFTH COUNT, but causing the death of 19 year-old Baylie Rose. SEVENTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of MURDER IN THE SECOND DEGREE in violation of Section 125.25 (2) of the Penal Law of the State of New York, committed as follows: The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, and thereby caused the death of another person, to wit: as alleged in the FIFTH COUNT, but causing the death of 18 year-old Michael Walker. EIGHTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of AGGRAVATED VEHICULAR HOMICIDE in violation of Section 125.14 (4) of the Penal Law of the State of New York, committed as follows. The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, in this county, engaged in reckless driving and committed the crime of vehicular manslaughter in the second degree and caused the death of more than one person, 10 wit: the defendant operated a 2015 GMC Acadia under the combined influence of alcohol and drugs and engaging in reckless driving by speeding in excess of the posted speed limit, crossing a double-solid line and driving through a red traffic light, causing the death of 20 year-old Samira Osmanovie, 19 year-old Baylie Rose, and 18 year-old Michael Walker.NINTH COUNT AND THE AFORESAID GRAND JURY by this Indictment further accuses ANTHONY SACCONE of the crime of LEAVING SCENE OF AN INCIDENT WITHOUT REPORTING violation of Section 600 (2) (a) of the Vehicle and Traffic Law of the State of New York, committed as follows: The said ANTHONY SACCONE, on or about the 23rd day of February, 2018, at the Town of Onondaga, inthis county, knew or had cause to know that personal injury had been caused to another person, due to an incident involving a motor vehicle operated by him, and did not, before leaving the scene where the injury occurred, stop, and with no police officer in the vicinity, failed to report the incident as soon as he was pigsically able, to wit: after causing a vehicular crash and knowing that he had caused physical injury, the defendant fled the scene of the incident without reporting it to the police.
