It’s a discrimination case, where Andy is suing Costless for firing him based on racism.

His case might not be strong but the publicity derived from such an allegation will harm the company
image significantly.

What is your company’s position on race?

Costless as a new business is strapped for cash and afford the chance that the jury will sympathize with
Andy. Costless wants to settle the case to silence the whole thing.

racial standards?

Even though these actions constitute the grounds for immediate dismissal I realized that these actions
are common among employees and often are overlooked. And considering Andy’s Obvious talent I don’t
think firing him was a wise decision.

Rehiring Andy and firing his supervisor + Based on Andy actual expenses last year ( last year expenses
18000 all paid + past six months expenses 9000 on credit = 27,000 ) the company would like it very much
if the settlement can be limited to that.

What is the company’s Needs & Interests?

It Needs that this does not go to trial, limit the settlement to No more than $46,000.

What is the company’s BATNA?

Rehiring Andy and firing his supervisor + No more than $46,000 which is reached from Andy’s salary
$24,000 per year and he was fired for a year and a half so he will be compensated for the lost wages of
1.5 years ( 24000 * 1.5 = 36000 ).
