Topic: Priority Juvenile Docket

Passage(s) the Inspires this Research:

“In legal terms, it was a kind of backdoor escape route to avoid dealing with the impending
reality suddenly knocking at the country’s front doors” (Luiselli 41).

Response to Passage(s) and Connection to the Topic of Interest:

I believe these passages were the most unknown topic presented in the essay that was a very
important part to Luiselli’s essay. I had an slight understanding but not enough to go in depth. I
also wanted to know how it affected these children and how it sent the children back to their
home countries.

In Court, Immigrant CHildren Are Moved to Head of Line.

Source of Text (where is this text originally published)

The New York Times

Database or URL Where you Found Source:

https://www.nytimes.com/2014/08/15/nyregion/in-court-children-lead-line-of-migrants.html

Scholarly or Popular Source? Is this a scholarly or popular text? How do you know?
It is more of a popular source but this has been edited several times before publishing, being that
The New York Times is a large and well known source. This source though might not focus on
getting all the facts straight making it more of a popular source than scholarly.

Summary: Write a 1-2 paragraph summary of the text using YOUR own words. What is this text
about?

This source was describing what the priority juvenile docket is and how it affected Yovanis
family and himself. Yovany was a 16 year old that entered the immigration courtroom and
braced for mercilessness. The court asked if he had an immigration lawyer and that he needed to
get one as soon as possible because he was entering an accelerated court process. The Priority
juvenile docket was the Obama's administration strategy to deal with the wave of unaccompanied
minors coming into the US. What this docket was doing was pushing immigrant children to the
top of the courts hearing list, giving them little to no time to get settled here, find a lawyer, and
prepare their cases. Therefore sending the children back to their countries within a couple
months rather than years. SInce the immigration court tends to take a while due to blockages, the
children would not have been seen for a while. But these courts, also known as “rocket dockets”
and “surge dockets”, were rushing the due process, it gave the children littlecance to gain refugee
in the US. The name “rocket docket” really shows how the legal process was being rushed.

Analysis: Write a 1-2 paragraph analysis that answers the following questions:

What focus question does this source most respond to? How so?
In what ways does this particular source help you better understand Luiselli’s argument or book?
In what ways does this particular source help you develop your own claims and/or analysis of
your claims in the essay? Does it support your thesis or does it offer an alternative perspective to
your thesis? Explain.
If you feel this source will not be helpful in examining your claims or developing your analysis,
why not? Explain.

This source directly responds to both of my questions because it effectively explained what
exactly a priority juvenile docket was and how it affected the children. This was particularly
helpful because it gave me a clear sense of what the priority juvenile docket was and what the
impact was on the children. It will help me explain this in my essay because this is one of the
reasons unaccompanied minors are not being granted asylum or refugee. This will teach the
readers of my essay what the priority juvenile docket is and why it is important to note the
Obama administration started this. This source will be very helpful when developing my claim
that will focus on the priority juvenile docket.

Other questions or Topics This Source Connects To: (optional) What other topics or questions
does this research help you think about or lead you to?
This poses a new question: Has the priority juvenile docket stopped? Or is it still happening?

With the Immigration Courts Rocket Docket Many Unrepresented Families QUickly Ordered
Deported

Source of Text (where is this text originally published)

Trac Immigration

Database or URL Where you Found Source:

http://trac.syr.edu/immigration/reports/441/

Scholarly or Popular Source? Is this a scholarly or popular text? How do you know?
Scholarly source because from an Immigration publishing and their url ends with .edu so it tends
to be scholarly. It also includes a lot of statistics and graphs with their citations.

Summary: Write a 1-2 paragraph summary of the text using YOUR own words. What is this text
about?
This source also touches on the same thing the first source discussed. It thoroughly explains what
the priority juvenile docket is, which is a strategy the Obama administration put forth when the
wave of unaccompanied minors occured in 2014. This served to expedite their removal, the new
cases of unaccompanied minors were closed very quickly, without attorneys to represented.
According to TRAC, in 27,015 out of the 38,601 closed cases --or 70 percent-- the family was
unrepresented. That is way more than half of the unaccompanied minors. It also shows that
families without representation did not even fill the correct papers to seek asylum, TRAC
indicates that only 1 in 15 families managed to fill a correct forms. For those 70 percent
unrepresented families they were quickly “disposed of”. In court, 43 percent of unrepresented
families were ordered deportation immediately after their first hearing. These statistics show how
the court system was rushing their cases and excited to deport them back to their countries.

Explain.
If you feel this source will not be helpful in examining your claims or developing your analysis,
why not? Explain.

This source, again, answered both of my focus questions because it gave me a deeper
understanding of how the priority juvenile docket is working against families. It also gave me a
wider spectrum, it was not only all unaccompanied minors, but especially unaccompanied minors
who were not represented in the courts. I understand now why this was such a huge impact on
these children and it really gave me a new perspective. I understand how confused and scared
these families and children were. They had no representation and they could not sucessfully file
the correct forms because it was too difficult for them to understand. I think this source will
make my claims stronger because I have developed a passion for this topic. It will be helpful
because I will know what i'm talkin about and how closely connected I am to the topic.

Refugee and Asylum

Source of Text (where is this text originally published)

U.S Citizenship and Immigration Services.
Database or URL Where you Found Source:
https://www.uscis.gov/humanitarian/refugees-asylum

Scholarly or Popular Source? Is this a scholarly or popular text? How do you know?
This is definitely a scholarly source because it is a government website and it has obviously have
to have correct facts. It is also very thorough and is made to direct citizen and inform.

Summary: Write a 1-2 paragraph summary of the text using YOUR own words. What is this text
about?

Refugee and Asylum is granted to people or unaccompanied minors who fear facing persecution
based on their race, nationality, membership in political or social group, as well as religion.
Refugee is a form of protection that is granted to unaccompanied minors who meet the
definition. Which the definition is literally 3 ages long. So if they don't meet the requirements
they cannot apply for refugee. Asylum is a form of protection to people who already meet the
refuge definition, are already in the US and are seeking admission at port of entry.

Explain.
If you feel this source will not be helpful in examining your claims or developing your analysis,
why not? Explain.

Though this source might not answer the focus questions, I believe this will help me understand
what the priority juvenile docket is speeding through. The definition showed how specific
refugee and asylum is. The families that are not represented and given little time will truly not be
able to figure out how to apply for refugee status because it very complex. The courts are
targeting immigrants and making it more difficult to grant asylum in the US. It is obvious they
want the wave of unaccompanied minors to end. This will help my essay by informing me about
my other body paragraph, I intend to write about how specific the visas are and how impossible
they are to be granted to unaccompanied minors.
