Where to file the petition for adoption:

A petition shall be filed at the Family Court of the province or city


where the prospective adoptive parents reside.

Qualification for aliens to adopt:


1. his country has diplomatic relations with the Republic of the
Philippines,
2. that he has been living in the Philippines for at least three (3)
continuous years prior to the filing of the application for adoption
and maintains such residence until the adoption decree is
entered,
3. that he has been certified by his/her diplomatic or consular office
or any appropriate government agency that he/she has the legal
capacity to adopt in his country
4. that his government allows the adoptee to enter his/her country
as his/her adopted son/daughter:

Provided, Further, That the requirements number 2 and 3 may be


waived for the following:

- one who is married to a Filipino citizen and seeks to adopt


jointly with his/her spouse a relative within the fourth (4th)
degree of consanguinity or affinity of the Filipino spouse

The following documents shall be annexed to the Petition:


1. birth or baptismal certificate and school records showing the name,
age and residence of the adoptee;
2. Affidavit of Consent of the following persons:
a) The adoptee, if he/she is 10 years old or older
b) The legitimate and adopted children of the adopter and the
adoptee who are 10 years old or older;

3. the child study report on the adoptee and his biological parents; (by
the DSWD)
4. If the petitioner is an alien, the certification from his diplomatic or
consular office certifying the requirement in Section 7(c) and (d) of
RA 8552
5. Home study Report on the adopters; (by the DSWD)
