Aims and Objectives

The Aims and objectives of this research are to identify:

1. the elements of the tort of negligence

2. the nature of liability for negligence in law of tort

3. the major defences of in public nuisance

4. how does nuisance affect the persons in St.Elizabeth


Methodology

In order to obtain accurate and precise information that is needed to fulfill the aims
and objectives of this IA, secondary information will be used. Secondary research
information is to be used by the researcher includes cases documents of laws
concerning negligence and others. Secondary information will also be obtained
using books. This kind of information will assist the researcher in making thorough
information which can be applied to the topic of negligence.
Findings

Negligent torts are not deliberate actions, but instead present when an individual or entity fails
to act as a reasonable person to someone whom he or she owes a duty to. The negligent action
found in this particular tort leads to a personal injury or monetary damages. Negligent torts are
the most prevalent types of tort, and are the most important.

The elements which constitute a negligent tort are the following: a person must owe a duty of
care or service to the victim in question; the individual who owes the duty must breech or violate
the promise or obligation; as a result of this breech the claimant suffered damage or injury; and
the injury caused must have been reasonably foreseeable as a result of the person's negligent
actions. A duty is some legal obligation that one party has to another party. A breach of that duty
exists when one person’s conduct fails to conform to the required standard. and the damages that
incurred. Finally, the plaintiff must have incurred some type of damages.
