Subject: Cancelation of deed of agreement of Structural & Architectural works of 06 storied industrial Building.

Dear Sir,
This is to inform you that, there is a mutual agreement between MH BUILDERS LTD. & CROSSWEAR
INDUSTRIES LTD. for constructing a 6 storied lndustrial building at Kathgara, Zirabo, Ashulia, Dhaka, Which was
commencing from 12s February 2017. Since beginning of Construction work ofthe project we (MH BUILDERS LTD)
successfully complete RCC construction of Level-1, Level-2& Level-3 till 10h Feb-2018. Though as per agreement
we should have complete all Sth floor slab casting within Jan.20l8 but we are far behind from our targeted schedule.

Due to some intemal problem and flnancial crisis of the company, we are not able to do the construction of the
project as per the plan. We know that, for this delay in the construction there will be huge loss for Crosswear
lndustries Ltd. We apologize for this and at the same time as we are nol able to do the construction we willingly want
to cancel both structural & architectural work agreement with CROSSWEAR INDUSTRIES LTD. ln this stage we
believe that, you will accept this cancelation letter.

After cancelation of the agreement between Crosswear lndustries Ltd & MH Builders Ltd, the management of
Crosswear lndustries Ltd can make new agreement with any construction mmpany / builders to construct the
building. ln that case MH Builders Ltd have no objection. Also we want to request you to do a Final Settlement with
MH Builders Ltd. We will submit all our bill/voucher that we work till 10th Feb 2018 to you as soon as possible. We
also want to assure you that, MH Builders Ltd will pay all the due bills of their supplier/sub-supplier those who supply
different materials in the project till 10th Feb 2018. 0n the other hand, we already have received BD TK. 7, 10,
00,000/= (Seven crore & ten lac ) of which will be adlusted with bills of level-03 and if any over payment was made of
bills by Crosswear lndustries ltd as well as financial compensation as per calculation for delaying the project will be
paid by MH Builders Ltd.

Therefore, considering all the above things we once again request you to CANCEL the agreement with MH
BUILDERS LTD.
