On July 4, 2017, Cody McCray was shot and killed by a Utah Highway Patrol Trooper following a
police pursuit that ended on Legacy Highway in Centerville, Utah. During the pursuit, officers
diverted Mr. McCray away from routes for parades occurring in Centerville and West Bountiful.
Although no firearms were found in the stolen car Mr. McCray was driving, he was endangering
people by going the wrong direction into oncoming traffic on a divided highway and using the
car as a weapon to escape from officers who had stopped and surrounded the car.

Because the shooting occurred in Centerville and no Centerville officer fired any rounds, the
Davis County Attorney’s Office appointed the Centerville Police Department to head the
criminal investigation into the shooting. The investigation was conducted by a team comprised
of over thirty investigators from agencies in Davis and Weber County, the Utah State crime lab,
and the Utah Office of the Medical Examiner. After compiling the evidence, the team
presented it to Davis County Attorney, Troy Rawlins for his review to determine whether
criminal charges should be filed against the Trooper who shot Mr. McCray. Mr. Rawlins has
concluded, based on his office’s review of the evidence, that “We do not believe the evidence is
reasonably likely to convince a unanimous jury to convict Sgt. Neff of murder, or any other
homicide crime.”

Centerville City and the Centerville Police Department thank the law enforcement officers
involved in the investigation for their hard work and professionalism in gathering and
presenting the evidence to the County Attorney for his review. They also express their sincere
condolences to Mr. McCray’s mother, father, loved ones and friends for their loss.
