3.6 – Please note if Contractor (Owner) fail to deliver the vessel on the date requested Company,
Contractor (Owner) will be penalized 0.25% of the total value of the agreement for every day of delay
maximum 5%

5.0 – Please clarify with Company for the rates, in this draft they still using USD instead of IDR.

5.1 – Please note cost of bunker, port charges, tugs and pilot fees

8.4 – cargoes and 10.4

9.1(c).1 – H&M and P&I equal to the full value or the vessel

10.4 – please note port fees, clearance expenses, custom fees, permits etc is on Company account.

11.5 – Please note, Contractor shall be responsible for any wharfage, port charges, port clearance
expenses, agency feed, pilot fees, custom fees, permits an other expenses relating to
mobilization/demobilization of its vessel

Kindly check also, under this clause Contractor shall appoint and be responsible for the cost of having
marine agent or we should provide marine agent at Sorong, West Papua.

13.3 – Please negotiate with Company if we can use LPEI to provide Performance Bond for this project,
as accommodated in PTK 007

Who will responsible for tank cleaning and when the fuel remaining on board will be calculated

4.4 – please note under this clause survey by independent surveyor is on Company cost

10.2 – please note if Contractor delay in delivering the vessel under this clause there is a penalty 0.1% of
max contract price up to 5%

13.1.5 – please clarify and make sure with Company, under this clause all of invoices will be
denominated and paid in USD instead of IDR.
