JURISDICTION OF THE OMBUDSMAN

(1) Any act or omission of any public officer


- not exclusive but concurrent jurisdction (ie non-involvement of Ombudsman
does not bar other prosecutory agencies to prosecute the information)

PRIMARY JURISDICTION
- Over cases congnizable by the Sanduganbayan
- May take over at any stage of the investigation
-simply means ("primary jurisdiction"; that the prosecution of cases
cognizable under the Sandiganbayan shall be under the exclusive control and
supervision of the Ombudsman.
- but no concurrent jurisdction between Ombudsman and other agencies re
cases conzignable by regular courts.

REVIEW OF DECISIONS OF THE OMBUDSMAN


- Provisionary orders are immediately final and executory

When reviewed:
- (As from RA 6770 Sec 27) only with respect to administrative disciplinary cases.
Decisions made by the Ombudsman re said cases are appealable to the SC via
certiorari.
- was declared uncosntitutional since the appealate juris of the SC cannot be
increased by law, without the SC's consent. Hence, the proper remedy now is via
petition for review under Rule 43 of the revised rules of Civil Procedure.
