NIA Road Quezon City NOTICE TO THE PUBLIC SUBJECT: Administrative Reconstitution of Manually-Issued Original Copies of Certificate of Title Lost and Destroyed Due to Fire in the Registry of Deeds for the Province of Isabela WHEREAS, the Registry of Deeds for the Province of Isabela (the "RD" or “the Registry") was severely damaged by fire on June 17, 2016 (the “incident”), where books, titles, documents, cash and property in the Registry of Deeds were either lost or damaged beyond recognition, and can no longer be used; WHEREAS, Section 3 of Republic Act (R.A.) No. 6732, dated July 17, 1989, with subject: "AN ‘ACT ALLOWING ADMINISTRATIVE RECONSTITUTION OF ORIGINAL COPIES OF CERTIFICATES OF TITLES LOST OR DESTROYED DUE TO FIRE, FLOOD AND OTHER FORCE MAJEURE, AMENDING FOR THE PURPOSE SECTION ONE HUNDRED TEN OF PRESIDENTIAL DECREE NUMBERED FIFTEEN TWENTY-NINE AND SECTION FIVE OF REPUBLIC ACT NUMBERED TWENTY-SIX", provides: "Section 3. Immediately after the loss or destruction of titles mentioned in Section 2 hereof, a true, complete and faithful inventory of all books, titles, documents, cash and property in the Registry of Deeds concerned shall be prepared by the Land Registration Authority through the newly designated reconstituting officer or Register of Deeds. Said inventory, duly signed and certified under oath by the Administrator of the Land Registration Authority, shall be published in a newspaper of general circulation in the province or city where the loss or destruction of titles occurred.” WHEREAS, as required by the Land Registration Authority (“LRA”) Central Office and in compliance with Section 3 quoted above, the Register of Deeds and personnel from the Registry of Deeds Office and the LRA Information and Communications Technology Division conducted, prepared and certified as correct an inventory of books, titles, documents, cash and property, that were not damaged in the incident, which is herewith attached as Annex “A”, “B” and °C” hereof; WHEREAS, the conditions relative to administrative reconstitution set forth under Section 1 of R.A. No. 6732, are as follows: "substantial loss or destruction of land titles due to fire, flood or other force ‘majeure as determined by the Administrator of the Land Registration Authority; provided that the number of certificates of title lost or damaged should be at east ten percent (10%) of the total number in the possession of the Office of the Register of Deeds: provided, further, that in no case shall the number of certificates of titles lost or damaged be less than five hundred (500),”; WHEREAS, the above-stated condition applies in the case of the Registry of Deeds for the Province of Isabela, considering that only 76,928 out of 268,617 active titles in the database were recovered by LRA, the listing of which is hereto attached as “Annex D” hereof recovered (71.13%) have either been lost or damaged, which list is likewise hereto attached as “Annex E” hereof. fr WHEREFORE, premises considered, this Authority shall implement the Administrative Reconstitution of manually-issued original copies of Certificate of Title that were lost and destroyed due to the incident, as follows: 1, The rules and regulations for the effective implementation of the Administrative Reconstitution shall be governed by the provisions of LRA Circular No. 13, issued on July 26, 1989, 2 copy of which is provided in the official LRA website (i.e, www.lra.gov,ph); 2. The List of the Titles, documents, cash and properties contained in Annexes “A”; "B"; “C’j and “D", referred in this Notice to the Public is likewise provided and may be ‘accessed by the public, in the LRA Website (www. lra.gov.ph) 3. Assample of the petition that may be used shall be provided in said LRA Website; 4. This Notice shall be published in the LRA Website, and in a newspaper of general Circulation in the province or city where the loss or destruction of titles occurred; after which the Registry may start receiving applications for Administrative Reconstitution. ‘SUBSCRIBED and SWORN to before me unist_! £82018 atQUEZON ERth Renato D.
